In pursuance of the said impugned<br \/>\norder, the petitioner is detained in jail.\n<\/p>\n<p>\t\tHeard<br \/>\nthe learned advocate for the petitioner and the learned AGP for the<br \/>\nrespondents.\n<\/p>\n<p>No affidavit-in-reply is filed by the learned AGP on behalf of the<br \/>\nrespondents controverting the averments made in the petition.  The<br \/>\naffidavit-in-reply filed by the learned AGP on behalf of the<br \/>\nrespondents is taken on record and considered.\n<\/p>\n<p>\t\tFrom<br \/>\nthe grounds of detention, it appears that two offences being CR.I.No.<br \/>\n62 &amp; 258  of 2009 under sections 66 (1)b and 65(e)  etc.  under<br \/>\nthe Bombay Prohibition Act,  were registered with Ranavav police<br \/>\nstation, wherein country liquor was found from the possession of the<br \/>\ndetenu.    On the basis of registration of these cases, the detaining<br \/>\nauthority held that the present detenu was carrying on activities of<br \/>\nselling country liquor which is harmful to the health of the public.<br \/>\nIt is held by the detaining authority that as the detenu is indulged<br \/>\nin illegal activities, it is required to restrain him from carrying<br \/>\nout further illegal activities i.e. selling of liquor. The detaining<br \/>\nauthority has placed reliance  on  the above registered offences and<br \/>\nstatements of  unnamed witnesses.   In the opinion of this court, the<br \/>\nactivities of the detenu  can, by no stretch of reasoning, be said to<br \/>\nbe disturbing the public order.   It is seen from the grounds that a<br \/>\ngeneral statement that has been made by the detaining authority that<br \/>\nconsuming liquor is injurious to health.   In fact, a perusal of the<br \/>\norder passed by the detaining authority shows that the grounds which<br \/>\nare mentioned in the order are in reference to the situation of &#8216;law<br \/>\nand order&#8217; and not &#8216;public order&#8217;.  Therefore, on this ground, the<br \/>\nsubjective satisfaction of the detaining authority is vitiated on<br \/>\naccount of non-application of mind and the impugned order, therefore,<br \/>\ndeserves to be quashed and set aside.\n<\/p>\n<p>3.\t\tExcept<br \/>\ntwo statements of the anonymous witnesses, there is no material on<br \/>\nrecord which shows that the petitioner-detenu is carrying out illegal<br \/>\nactivities of selling  liquor which is harmful to the health of the<br \/>\npublic.  In the case of Ashokbhai Jivraj @ Jivabhai Solanki<br \/>\nv.Police Commissioner, Surat (2001 (1) GLH 393), having<br \/>\nconsidered the decision of the Hon&#8217;ble Apex Court in the case of Ram<br \/>\nManohar Lohia  v. State of Bihar (AIR 1966 SC 740), this<br \/>\ncourt held that the cases wherein the detention order are passed on<br \/>\nthe basis of the statements of such witnesses fall under the<br \/>\nmaintenance of   law and order  and not  public order .\n<\/p>\n<p>4.\t\tApplying<br \/>\nthe ratio of the above decisions, it is clear that before passing  an<br \/>\norder of detention of a detenu, the detaining authority must come to<br \/>\na definite finding that there is threat to the &#8216;public order&#8217; and it<br \/>\nis very clear that  the present case  would not fall within the<br \/>\ncategory of threat to a public order.  In that view of the matter,<br \/>\nwhen the order of detention has been passed by the detaining<br \/>\nauthority without having adequate grounds for passing the said order,<br \/>\ncannot be sustained and, therefore, it deserves to be quashed and set<br \/>\naside.\n<\/p>\n<p>6.\t\tIn<br \/>\nthe result,  This Special Civil<br \/>\nApplication is allowed.  The impugned order of detention  dated<br \/>\n17.8.2009 passed by the District Magistrate, Porbandar  is quashed<br \/>\nand set aside.  The detenu is  ordered to be set at liberty forthwith<br \/>\nif not required in any  other case.  Rule is made absolute.
