We have<br \/>\nseen the orders passed by this Court in aforesaid three writ<br \/>\npetitions. It appears from the facts of the case that these Special<br \/>\nCivil Applications have been admitted and Rule have been issued by<br \/>\nthis Court.\n<\/p>\n<p>4.\t\tLooking<br \/>\nto the orders passed in these three writ petitions, it appears that<br \/>\nCourt is in search of fact that there is any encroachment or not and<br \/>\nfor that, report has been called from the concerned respondent<br \/>\nauthority.\n<\/p>\n<p>5.\t\tIt<br \/>\nappears from the facts of the case the concerned respondent authority<br \/>\nhas initiated action under the provisions of The Contempt of Courts<br \/>\nAct,1971. It appears that thus, the fact Whether any encroachment<br \/>\nupon the land, is also matter subjudice under the provisions of<br \/>\nBombay Land Revenue Code,1879 and, therefore, we are not inclined to<br \/>\ntake any action against the respondent for removal of encroachment.<br \/>\nIn fact, Whether there is any encroachment or not? for that,<br \/>\nproceedings under the Bombay Land Revenue Code,1879 is also going on.<br \/>\nEncroachment is yet to be established. Who has done encroachment is<br \/>\nyet to be finalised by order of competent court \/ authority. Special<br \/>\nCivil Applications have been admitted and there is no direction by<br \/>\nthis Court upon any of the respondent for removal of encroachment.\n<\/p>\n<p>6.\t\tAs<br \/>\na cumulative effect of the aforesaid facts and pendency of the<br \/>\nproceedings under the Bombay Land Revenue Code,1879, we are not<br \/>\ninclined to entertain this contempt application at this stage. There<br \/>\nis no substance in this application and, therefore, the same are<br \/>\nhereby dismissed.
