A.G., Punjab,<br \/>\n           for the respondents.\n<\/p>\n<p>\nSATISH KUMAR MITTAL, J (ORAL)<\/p>\n<p>           The petitioner, who has prematurely retired on 21.10.2005<\/p>\n<p>from the office of Cooperative Societies, Amritsar, has filed the<\/p>\n<p>instant petition under Articles 226\/227 of the Constitution of India for<\/p>\n<p>issuing direction to the respondents to release his retiral benefits to<\/p>\n<p>him, which have been withheld due to the pendency of the<\/p>\n<p>departmental as well as judicial proceedings.<\/p>\n<p>           Due to the stay of the criminal proceedings by this Court,<\/p>\n<p>the departmental proceedings have not been initiated.<\/p>\n<p>           In view of these facts, counsel for the respondents, on<\/p>\n<p>instructions   from   Sh.   Davinder    Singh,    Assistant   Registrar<\/p>\n<p>Cooperative Societies, Amritsar, states that the department is ready<\/p>\n<p>to release the provisional pension to the petitioner in accordance<br \/>\n with law within a period of two months.\n<\/p>\n<p>             Learned counsel for the petitioner has accepted the said<\/p>\n<p>offer and states that this petition may be disposed of with the said<\/p>\n<p>direction.\n<\/p>\n<p>             In view of above, this petition is disposed of with a<\/p>\n<p>direction to respondent Nos.2 and 3 to release the provisional<\/p>\n<p>pension to the petitioner along with the arrears preferably within a<\/p>\n<p>period of two months, subject to the outcome of the departmental<\/p>\n<p>proceedings.\n<\/p>\n<p>20th August, 2009.
