SHAH\n\t\t\n\t\n\n \n\nDate\n: 24\/08\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\t\tThe<br \/>\npresent petition under Article 226 of the Constitution of India has<br \/>\nbeen preferred by the petitioner &#8211; original complainant for the<br \/>\nfollowing main reliefs:\n<\/p>\n<p>&#8220;12(A)\tYOUR<br \/>\nLORDSHIPS be pleased to issue appropriate writ, order or direction<br \/>\nand be pleased to call for the record and proceedings of the offence<br \/>\nregistered as C.R.No.I-57 of 2011 with Viramgam Rural Police Station,<br \/>\nAhmedabad Rural and after perusing the same be pleased to transfer<br \/>\nthe investigation of the above offence to CBI in the interest of<br \/>\njustice and or other investigating team for impartial investigation;\n<\/p>\n<p>(B)\tYOUR<br \/>\nLORDSHIPS be pleased to transfer the investigation of the offence<br \/>\nregistered as C.R.No.I-57 of 2011 with Viramgam Rural Police Station,<br \/>\nAhmedabad (Rural) to CBI and direct to  complete the investigator as<br \/>\nexpeditiously as possible and or any other investigating team for<br \/>\nimpartial investigation;\n<\/p>\n<p>(C)\tYOUR<br \/>\nLORDSHIPS be pleased to direct the respondent to submit the report<br \/>\nand the case diary of the above offence to show the reason for delay<br \/>\nin taking appropriate steps and not initiating appropriate steps of<br \/>\narrest immediately against the accused persons in the interest of<br \/>\njustice;\n<\/p>\n<p>2.\t\tThe<br \/>\nmain grievance, which is voiced in the present petition is that there<br \/>\nis a total lapse in the investigation by the concerned Investigating<br \/>\nOfficer and even main accused &#8211; Kamruddin Valibhai Sidani is<br \/>\nyet not arrested. It is submitted that the offences alleged are very<br \/>\nserious offences punishable under Sections 302, 325, 324, 147, 148<br \/>\nand 149 of the Indian Penal Code. Therefore, it is requested to<br \/>\nconsider prayer of the petitioner to transfer the investigation.\n<\/p>\n<p>3.\t\tIn<br \/>\nresponse to the Notice issued by this Court, Mr.K.P.Rawal, learned<br \/>\nAdditional Public Prosecutor has appeared on behalf of the<br \/>\nrespondents and has denied the allegation that there is any lapse on<br \/>\nthe part of the concerned Investigating Officer. Affidavit-in-reply<br \/>\nfiled on behalf of respondent No.2 submitting the steps taken by the<br \/>\nInvestigating Officer to arrest absconding accused &#8211;  Kamruddin<br \/>\nValibhai Sidani. It is further submitted that even warrant under<br \/>\nSection 70 of the Code of Criminal Procedure has been obtained and<br \/>\ndespite the best efforts, absconding accused could not be arrested.<br \/>\nIt is further submitted that even Public Notice in the local<br \/>\nnewspaper namely &#8220;Divyabhaskar&#8221; has also been published<br \/>\nalong with photograph of the absconding accused &#8211;  Kamruddin Valibhai<br \/>\nSidani on 22\/08\/2011. Even a report has been submitted before the<br \/>\nlearned Judicial Magistrate, First Class, Viramgam on 20\/08\/2011<br \/>\nrequesting learned Judicial Magistrate, First Class, Viramgam to<br \/>\nissue proclamation under Section 82 of the Code of Criminal Procedure<br \/>\nand order of the learned Judicial Magistrate, First Class,  Viramgam,<br \/>\nis awaited.\n<\/p>\n<p>4.\t\tHaving<br \/>\nheard Learned advocates appearing on behalf of the respective parties<br \/>\nand considering the above, it appears to the Court that further<br \/>\nopportunity should be given to the investigating Officer to trace out<br \/>\nthe whereabouts of the absconding accused &#8211;  Kamruddin Valibhai<br \/>\nSidani. As it is reported that a report is already submitted before<br \/>\nlearned Judicial Magistrate, First Class, Viramgam for proclamation<br \/>\nunder Section 82 of the Code of Criminal Procedure.\n<\/p>\n<p>\t\tLearned<br \/>\nJudicial Magistrate, First Class, Viramgam is hereby directed to<br \/>\nconsider the same and to pass appropriate order on the same<br \/>\nimmediately but not later than three days from the date of receipt of<br \/>\nwrit of the present order.
