Gandhi Maidan, Town and District Patna.\n                                                                           ---------- Petitioner\n                                           Versus\nThe State Of Bihar.\n                                                                       -------- Opposite Party\n                                         -----------\n<\/pre>\n<p>02\/-    26\/08\/2011                      Heard learned counsel for the petitioner and learned<\/p>\n<p>                          Additional Public Prosecutor for the State.\n<\/p>\n<p>                                        The petitioner apprehends his arrest, in connection with<\/p>\n<p>                          Complaint Case No. 1701(C) of 2009 for the offences punishable<\/p>\n<p>                          under Section 498A of the Indian Penal Code, is named accused in<\/p>\n<p>                          this case being husband of the complainant with allegation of demand<\/p>\n<p>                          of dowry, torture etc.<\/p>\n<p>                                         Submission is that under compelling circumstances,<\/p>\n<p>                          petitioner had to earlier file an application under Section 9 of the<\/p>\n<p>                          Hindu Marriage Act, seeking restitution of conjugal rights, but<\/p>\n<p>                          ultimately filed an another case under Section 13 bearing No. 766 of<\/p>\n<p>                          2009, pending before the Principal Judge, Family Court, Patna,<\/p>\n<p>                          wherein, on the prayer of the complainant under Section 24 of the Act<\/p>\n<p>                          as per ordered Rs. 2,000\/- per month is being paid and no amount is<\/p>\n<p>                          lying due.\n<\/p>\n<p>                                        Considering the facts and circumstances of the case, in<\/p>\n<p>                          the event of his arrest\/surrender before the court below within four<\/p>\n<p>                          weeks, let the above named petitioner be enlarged on bail on<\/p>\n<p>                          furnishing bail-bond of Rs. 10,000\/- (ten thousand only) with two<\/p>\n<p>                          sureties of the like amount each to the satisfaction of Judicial<br \/>\n<span class=\"hidden_text\">                                   2<\/span><\/p>\n<p>            Magistrate, 1st Class, Patna, in connection with Complaint Case No.<\/p>\n<p>            1701(C) of 2009, subject to condition laid down under Section 438(2)<\/p>\n<p>            of the Criminal Procedure Code with additional condition to remain<\/p>\n<p>            physically present before the court below on each and every date at<\/p>\n<p>            least for two years or till disposal of the case, whichever is earlier, in<\/p>\n<p>            case of failure on two consecutive dates, without giving any<\/p>\n<p>            reasonable explanation or even on single default in payment, the<\/p>\n<p>            liberty granted shall be deemed to be cancelled.<\/p>\n<pre>Praveen\/-                             ( Akhilesh Chandra, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Ravindra Kumar vs The State Of Bihar on 26 August, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
