Tiwari,, Chief Information Commissioner\n\n\nComplainant:            Shri Ashok Nayak\nRespondents:            Western Coalfields Ltd.<\/pre>\n<p>       Shri Ashok Nayak of Dist. Sambalpur has filed this on-line complaint dated<br \/>\n1.6.2010 before the Commission against Western Coalfields Ltd. (WCL), Kanhan<br \/>\nArea, Dist. Chhindwara (MP) for deemed refusal to his RTI-request dated 14.10.2009.\n<\/p>\n<p>2.     In order to avoid multiple proceedings under sections 19 and 18 of the RTI<br \/>\nAct, viz., appeals and complaints, the matter is remitted to PIO, Western Coalfields<br \/>\nLtd., Kanhan Area, P.O. Dungaria, Dist. Chhindwara-480553 (MP) (enclosing<br \/>\ntherewith copy of complaint and RTI-request), with the following directions:\n<\/p>\n<blockquote><p>       (i)       In case no reply has been given by PIO to the complainant to his RTI-\n<\/p><\/blockquote>\n<blockquote><p>                 request dated 14.10.2009, PIO should furnish a reply to the<br \/>\n                 complainant within two week of receipt of this order.\n<\/p><\/blockquote>\n<blockquote><p>       (ii)       In case PIO has already given a reply to the complainant in the matter,<br \/>\n                 he should furnish a copy of his reply to the complainant within one<br \/>\n                 week of receipt of this order.\n<\/p><\/blockquote>\n<blockquote><p>       (iii)     PIO should invariably indicate to the complainant the name and<br \/>\n                 address of the 1st Appellate Authority, before whom the complainant<br \/>\n                 can file first-appeal, if any.\n<\/p><\/blockquote>\n<blockquote><p>       (iv)      A copy of PIO&#8217;s reply should also be endorsed to the Commission.\n<\/p><\/blockquote>\n<p>3.     In case the complainant is not satisfied with the reply received from PIO, he,<br \/>\nunder section 19(1) of the RTI Act, may within the time prescribed, file his first-<br \/>\nappeal before the AA.\n<\/p>\n<p>4.    On receipt of the first appeal from the petitioner as per the above directions,<br \/>\nAA should dispose of the appeal within the period stipulated in the RTI Act.\n<\/p>\n<p>5.      In case complainant still feels aggrieved by the decision of AA, he shall be<br \/>\nfree to approach the Commission in second appeal under section 19(3), along with<br \/>\ncomplaint u\/s 18, if any, within the prescribed time limit.\n<\/p>\n<p> 6.
