The appellant in Criminal<\/p>\n<p>   1 1 10\/2007 is Accused No.1 (for short Al]. Appellant<\/p>\n<p>  Crirninal Appeal No.61 I \/ 2006 is Accused No.2 [for short A2)<\/p>\n<p>ifbefore the Trial Court.\n<\/p>\n<p>2. The deceased is the husband of A2. A1 is the<\/p>\n<p>neighbour of the deceased. One Smt.RathI1amma&#8211; PW} is the<\/p>\n<p>_3_<\/p>\n<p>complainant and sister&#8211;in&#8211;law of the deceased. PW3 is the<br \/>\nbrother of the deceased and he is also living near the house of<br \/>\nthe deceased. The deceased was preparing and selling jerhins to<\/p>\n<p>the retailers and he owned a shop in the Hong Kong&#8217;<\/p>\n<p>Bangalore. It is the case of. the prosecution that..u&#8217;\u00b0A1 <\/p>\n<p>relationship with A2 and they thought._tha&#8217;.\u00a7&#8217;deceased <\/p>\n<p>impediment.\n<\/p>\n<p>3. The A1 and A2 on &#8216;iSl9.,2004v~  sedative. 0&#8242;<\/p>\n<p>to the deceased, caused his death_llby__stranguiation._iihereafter,<br \/>\nA1 and A2 took the l\ufb02ieceasedt&#8217; ; o&#8221;rLf _ motor cycie to<br \/>\nVrishubhavathi Bridge  the face of the<br \/>\nbody and threxxrl&#8211;.the:\u00a7j:0tifu111;:.Qt:-the  river. The A2 had<br \/>\ntold PWl.-.__ah_d oth&#8217;er~s_:&#8217;that-deceased had gone to Rajasthan for<\/p>\n<p>sale of  PAW-it   constant enquiries about the<\/p>\n<p>V whereabouts. on ..o2.&#8217;li0.::o04, A1, A2, PW1 and others went to<\/p>\n<p>   lbharmasthala and came back on 05.10.2004. PW1<\/p>\n<p>was *f'(_2uhd4:the eonduct_of A2 strange in not being worried about Q_<\/p>\n<p> _ the a&#8217;%:;&gt;.sen._f:ie  husband. PW1 insisted A2 to give complaint.<\/p>\n<p> told  she is not worried about the husband and that PW1<\/p>\n<p>A   be bothered about that.\n<\/p>\n<p>4. On the same night at 10.30 p.m., PW1 went to the<\/p>\n<p>\u00abdhouse of A2. She found the doors were locked from inside, the<\/p>\n<p>bedroom Windows were open, the lights were on. PW1 went to<\/p>\n<p>the window side, she over heard the conversation between A1<\/p>\n<p><span class=\"hidden_text\">-5-<\/span><\/p>\n<p>aside. The appe11ants&#8211;aCeused are to be set free forthwith if not<\/p>\n<p>required to be detained in any other case.<\/p>\n<p>Sri Vishwanatha Poojary is appointed as Amicti\u00e9&#8217;<\/p>\n<p>The fee of Amicus Curiae is \ufb01xed at Rs.7,000\/&#8211;.
