(J)\n\nCITATION<\/a>:\n 1982 AIR  777\t\t  1982 SCR  (3)\t 43\n 1982 SCC  (1) 502\t  1982 SCALE  (1)2\n\n\nACT:\n     Delhi Rent\t Control Act-Section 14(1), proviso (a) read\nwith proviso to section 14(2)-scope of.\n\n\n\nHEADNOTE:\n     When a  tenant has\t neither paid nor tendered the whole\nof the\tarrears of  rent legally recoverable from him within\ntwo months of the date on which the notice of demand for the\narrears of  rent has  been served  on him  by  the  landlord\nproviso (a) to section 14(1) empowers the Controller to make\nan order for the recovery of possession of the premises. The\nproviso to  section 14(2)  states that\tno tenant  shall  be\nentitled to  the benefit  under the  sub-section  if  having\nobtained such  benefit once  in respect\t of any\t premises he\nagain makes  a default\tin the\tpayment\t of  rent  of  those\npremises for three consecutive months.\n     On 14th  December, 1973, the land-lady-appellant issued\na notice  to the  tenant stating  that he  had not  paid the\ndamages after  May 1973\t and called  upon  him\tto  pay\t the\narrears within\ttwo months  from the  date  of\tnotice.\t The\ntenant remitted\t the rent  to the  land-lady by\t money-order\ntowards the  end of  February 1974 but she refused to accept\nthe same.\n     On the  land-lady's application the Controller, and the\nTribunal in  appeal, held that the notice was valid and that\nthe expression\t\"damages for  the use  and occupation\" meant\nnothing more  nor less\tthan rent.  But the  High  Court  on\nappeal held  that the  term \"rent\"  and \"damages for use and\noccupation\" could  not be  taken to  be synonymous terms and\nthat the  notice issued by the land-lady did not satisfy the\nrequirements of\t clause (a)  of the proviso to section 14(1)\nof the Act in that it did not demand rent from the tenant.\n     Allowing the appeal and remitting the case to the Court\nbelow\n^\n     HELD: The\tnotice issued by the land-lady satisfies the\nrequirements of\t clause (a) of the proviso to section 14(1).\n[46 D]\n     The   High\t   Court   has\t  taken\t  an   unnecessarily\nhypertechnical view  of the  contents of  the  notice  which\nspecifically stated  that on  account of  the termination of\nthe tenancy  by an  earlier notice  the tenant\thad become a\nstatutory tenant and it was in this context that a claim was\nmade for damages for use and occupation at a rate equivalent\nto the\tagreed\trent.  The  demand  so\tmade  could  not  be\nconstrued as anything but a demand for rent. The short point arising for determination in<br \/>\nthis appeal  concerns the validity of a notice served by the<br \/>\nlandlady appellant  on the  tenant-respondent and purporting<br \/>\nto be one issued in accordance with the provisions contained<br \/>\nin clause  (a) of sub-section (1) of section 14 of the Delhi<br \/>\nRent Control Act (hereinafter called the Act), and we may at<br \/>\nthe very  outset reproduce  the relevant  provisions of that<br \/>\nsection:\n<\/p>\n<blockquote><p>\t  &#8220;14(1) Notwithstanding  anything to  the  contrary<br \/>\n     contained in  any other  law or  contract, no  order or<br \/>\n     decree for\t the recovery  of possession of any premises<br \/>\n     shall be  made by\tany court or Controller in favour of<br \/>\n     the landlord against a tenant:\n<\/p><\/blockquote>\n<blockquote><p>\t  Provided  that   the\t Controller   may,   on\t  an<br \/>\n     application made  to him in the prescribed manner, make<br \/>\n     an order for the recovery of possession of the premises<br \/>\n     on one or more of the following grounds only, namely:\n<\/p><\/blockquote>\n<blockquote><p>\t       (a) that\t the tenant  has  neither  paid\t nor<br \/>\n\t  tendered the\twhole of  the arrears  of  the\trent<br \/>\n\t  legally recoverable  from him within two months of<br \/>\n\t  the date  on which  a notice\tof  demand  for\t the<br \/>\n\t  arrears of  rent has\tbeen served  on him  by\t the<br \/>\n\t  landlord in  the manner provided in section 106 of<br \/>\n\t  the Transfer of Property Act, 1882;\n<\/p><\/blockquote>\n<blockquote><p>\t  14(2) No  order for  the recovery of possession of<br \/>\n     any premises  shall be  made on the ground specified in<br \/>\n     clause<br \/>\n<span class=\"hidden_text\">45<\/span>\n<\/p><\/blockquote>\n<blockquote><p>     (a) of  the proviso  to sub-section  (1), if the tenant<br \/>\n     makes payment or deposit as required by section 15:<br \/>\n\t  Provided that\t no tenant  shall be entitled to the<br \/>\n     benefit under this sub-section, if having obtained such<br \/>\n     benefit once in respect of any premises, he again makes<br \/>\n     a default\tin the payment of rent of those premises for<br \/>\n     three consecutive months.&#8221;<\/p><\/blockquote>\n<p>     2.\t The  tenant  respondent  has  remained\t absent\t and<br \/>\nunrepresented at  the hearing  and we have had the advantage<br \/>\nof being  addressed by Mr. Vinoo Bhagat, learned counsel for<br \/>\nthe appellant only.\n<\/p>\n<p>     3. It was not disputed before the High Court that in an<br \/>\nearlier proceeding  the tenant\thad taken  advantage of\t the<br \/>\nprovisions contained in sub-section (2) of section 14 of the<br \/>\nAct, that  he committed\t another default  in the  payment of<br \/>\nrent which  covered the\t period from  1.6.1973 to 30.11.1973<br \/>\nand that  it was  then that  a notice  dated 14.12.1973\t was<br \/>\nserved on him. The notice stated:\n<\/p>\n<blockquote><p>\t  &#8220;Your contractual  tenancy in respect of House No.<br \/>\n     A-54 (double-storey)  Kalkaji, New Delhi-19 had already<br \/>\n     been terminated  whereafter you  are a statutory tenant<br \/>\n     liable to\tpay damages  for use  and occupation  at the<br \/>\n     rate of Rs. 15\/- (Rupees fifteen per month) to me. That<br \/>\n     you have  not paid the said damages after May, 1973. In<br \/>\n     case you  do not clear the arrears upto date within two<br \/>\n     months from  the  date  of\t this  notice,\tI  shall  be<br \/>\n     compelled to  issue instructions to my legal adviser to<br \/>\n     file an application for your eviction &#8230;&#8230;&#8230;.&#8221;<\/p><\/blockquote>\n<p>     No attempt\t to pay\t the rent  was made  inspite of\t the<br \/>\nnotice till  the end  of February, 1974. Although thereafter<br \/>\nrent was  remitted to  the landlady through money orders but<br \/>\nshe refused  to accept\tthe same  and made an application to<br \/>\nthe Controller for eviction of the tenant on the sole ground<br \/>\nof a  second default  in  the  payment\tof  rent.  Both\t the<br \/>\nController and\tthe Tribunal  in the  appeal held  that\t the<br \/>\nnotice was  a valid one and that the expression &#8220;damages for<br \/>\nuse and\t occupation&#8221; contained therein meant nothing more or<br \/>\nless than  rent. In  a second appeal, a learned Single Judge<br \/>\ndiffered from  the Courts  below and was of the opinion that<br \/>\nthe word  &#8216;rent&#8217; and  the said expression could not be taken<br \/>\nto be<br \/>\n<span class=\"hidden_text\">46<\/span><br \/>\nsynonymous and\tthat there  was no  demand of  rent  in\t the<br \/>\nnotice in  question which  did not,  therefore, satisfy\t the<br \/>\nrequirements of the provisions contained in clause (a) above<br \/>\nextracted. It  is the  judgment of  the learned Single Judge<br \/>\nwhich is assailed in the present appeal.\n<\/p>\n<p>     4. After  hearing Mr. Vinoo Bhagat, learned counsel for<br \/>\nthe appellant, we are of the opinion that the learned Single<br \/>\nJudge has  taken an unnecessarily hypertechnical view of the<br \/>\ncontents of  the notice.  It is\t significant that the notice<br \/>\nspecifically stated  that on  account of  the termination of<br \/>\nthe tenancy  by an earlier notice the tenant had become what<br \/>\nis popularly  known as a statutory tenant and it was in this<br \/>\ncontext that  a claim  was made\t for  damages  for  use\t and<br \/>\noccupation at  a rate  equivalent to the agreed rent. We are<br \/>\nof the\topinion that  in the  circumstances of\tthe case the<br \/>\ndemand so  made could  not be  construed as  anything but  a<br \/>\ndemand for  rent. Consequently\tthe notice  must be  held to<br \/>\nsatisfy the requirements of clause (a) of sub-section (1) of<br \/>\nSection 14 of the Act.\n<\/p>\n<p>     5. For  the reasons stated above, we accept the appeal,<br \/>\nset aside  the impugned\t judgment and  restore the orders of<br \/>\nthe Controller\tand the\t Tribunal. The\tcase is remitted for<br \/>\nfurther proceedings  to the  Controller who shall dispose of<br \/>\nit within three months from the receipt of records from this<br \/>\nCourt.
