Justice P.S.GOPINATHAN\n\n Dated :13\/01\/2010\n\n O R D E R\n                   P.S.GOPINATHAN, J.\n\n                  = = = = = = = = = = = =\n\n                  Crl.M.C.No.2098 of 2006.\n\n                  = = = = = = = = = = = =\n\n           Dated this the 13th day of January, 2010.\n\n                         O R D E R\n<\/pre>\n<p>     The petitioner is the accused in ST.No.884\/2005 on the<\/p>\n<p>file of the Judicial Magistrate of the First Class-II,<\/p>\n<p>Thiruvananthapuram. The second respondent herein filed a<\/p>\n<p>complaint, copy of which is marked as Annexure-A, against<\/p>\n<p>the petitioner alleging offence under Section 138 of the<\/p>\n<p>Negotiable Instruments Act with a plea that in discharge of<\/p>\n<p>an existing liability, the petitioner issued four cheques.<\/p>\n<p>When presented, the cheques were returned with the<\/p>\n<p>endorsement `payment stopped by the drawer&#8217;. Though a<\/p>\n<p>lawyer notice demanding discharge of liability was caused<\/p>\n<p>the liability was not cleared, but a reply was sent.<\/p>\n<p>     2.    According to the petitioner, there is no liability<\/p>\n<p>subsisting    between    the   petitioner  and   the second<\/p>\n<p>respondent and that the cheques in dispute were issued<\/p>\n<p>Crl.M.C.No.2098 of 2006.\n<\/p>\n<p><span class=\"hidden_text\">                            -: 2 :-<\/span><\/p>\n<p>only to compromise certain cases pending between the<\/p>\n<p>second respondent and the brother-in-law of the petitioner.<\/p>\n<p>Annexure-C is the compromise. Annexure-D is the common<\/p>\n<p>judgment in pursuance of Annexure-C. In acknowledgment<\/p>\n<p>of the cheques, Annexure-B receipt was also issued.<\/p>\n<p>According to the learned counsel, a reading of Annexure-B<\/p>\n<p>would show that there was no outstanding liability and<\/p>\n<p>hence no offence under Sec.138 of the Negotiable<\/p>\n<p>Instruments Act is made out.\n<\/p>\n<p>      3.   In contra, the learned counsel for the second<\/p>\n<p>respondent would contend that there are sufficient<\/p>\n<p>averments in the complaint regarding the existence of the<\/p>\n<p>liability and that the second respondent is not admitting<\/p>\n<p>Annexure-B receipt and that with the materials on record<\/p>\n<p>there are sufficient averments to prosecute the petitioner<\/p>\n<p>under Sec.138 of the Negotiable Instruments Act and that<\/p>\n<p>the request to quash the proceedings in exercise of the<\/p>\n<p>powers vested on this Court under Sec.482 of the Criminal<\/p>\n<p>Crl.M.C.No.2098 of 2006.\n<\/p>\n<p><span class=\"hidden_text\">                             -: 3 :-<\/span><\/p>\n<p>Procedure Code is without any merit.\n<\/p>\n<p>      4.   Having heard either side and perusing the<\/p>\n<p>records, I find that in the complaint there is specific<\/p>\n<p>averment that the cheques in dispute were issued in<\/p>\n<p>discharge of an existing debt. Whether the cheques were<\/p>\n<p>issued in discharge of a debt or not is a matter for evidence.<\/p>\n<p>Whether Annexure-B receipt was executed or not is also a<\/p>\n<p>matter of evidence. These matters cannot be decided in a<\/p>\n<p>proceeding under Sec.482 of the Code of Criminal<\/p>\n<p>Procedure.      I find little material to quash Annexure-A<\/p>\n<p>complaint. This Criminal Miscellaneous Case is devoid of<\/p>\n<p>any merit.
