     Petitioners   are   the   defendants   1   and   2   in<\/p>\n
O.S.167\/04 on the file of Munsiff Court, Payyannur.\n<\/p>\n
First   respondent   is   the   plaintiff   and   second<\/p>\n
respondent the  third defendant.   First respondent<\/p>\n
filed   I.A.1642\/04   an   application   under   Order   XXXIX<\/p>\n
Rule 1 of Code of Civil Procedure seeking an order<\/p>\n
of   temporary   injunction   against   respondents   from<\/p>\n
trespassing   into   plaint   A   schedule   property   or<\/p>\n
constructing any  hospital building in violation of<\/p>\n
the Building Rules in plaint  schedule property.  B<\/p>\n
schedule   property   belongs   to     petitioners   and   A<\/p>\n
schedule   property   belongs   to     first   respondent.\n<\/p>\n
Petitioners   contended   that   first   respondent   has   no<\/p>\n
right   to   seek   an   order   of   temporary   injunction   as<\/p>\n
sought   for.     As   per   Ext.P5   order,   learned   Munsiff<\/p>\n
granted   an   order   of   temporary   injunction   till   the<\/p>\n
disposal   of   the   suit.     Petitioners   challenged   that<\/p>\n

order   before   Sub   Court   in   CMA   7\/05.     The   learned<\/p>\n
Sub   Judge   on   hearing     both   sides,   confirmed   the<\/p>\n
order and dismissed the appeal. It is challenged in<\/p>\n
this         petition         filed         under         Article         227         of<\/p>\n
Constitution of India.\n<\/p>\n
        2.     Learned   counsel   appearing   for   petitioners<\/p>\n
was heard.\n<\/p>\n
        3.   The   argument   of   learned   counsel   appearing<\/p>\n
for   petitioners   was   that                     plaint   B   schedule<\/p>\n
property  belongs  to  petitioners  and  it  lies  to  the<\/p>\n
east   of   the   plaint   A   schedule   property   which<\/p>\n
belongs   to     first   respondent   and   there   is   a   well<\/p>\n
demarcated   boundary   separating   the   two   properties<\/p>\n
as shown by the Commissioner in the plan and there<\/p>\n
is   a   compound   wall   constructed   in     stones   on   the<\/p>\n
line   B,   B1,   B2   and   b   as   demarcated   by   the<\/p>\n
Commissioner   and   from   b   to   c     the   eastern   wall   of<\/p>\n
the   building   forms   the   demarcating   boundary   and<\/p>\n
petitioners   are   constructing   the   building   in   the<\/p>\n
plaint   B   schedule   property   within   their   area   and<\/p>\n
the   identity   cannot   be   disputed   in   view   of   the<\/p>\n

existence   of   the   compound   wall   and   building   and<\/p>\n
therefore   courts   below   should   not   have   granted   an<\/p>\n
order of temporary injunction.\n<\/p>\n
      4.     On   hearing   learned   counsel   appearing   for<\/p>\n
petitioners,   as   is   clear   from   the   orders   of   the<\/p>\n
courts   below,     what   weighed   with   the   courts   was<\/p>\n
the fact that if the construction is allowed to be<\/p>\n
carried   out   in   the   plaint   B   schedule   property   in<\/p>\n
the   alleged   violation   of          Building   Rules   and<\/p>\n
finally in the suit   it is found that they are not<\/p>\n
entitled   to   construct   the   building,   it   would   cause<\/p>\n
irreparable   injury   and   therefore   balance   of<\/p>\n
convenience   is   in   favour   of   granting   the   order   to<\/p>\n
first respondent.  The arguments of learned counsel<\/p>\n
appearing   for   petitioners   is   that   by   carrying   out<\/p>\n
the   construction   of   the   building,   no   irreparable<\/p>\n
injury will be caused and on the other hand as  the<\/p>\n
suit   itself   is   not   maintainable   and     the   order   is<\/p>\n
to be quashed.   The finding of the learned Munsiff<\/p>\n
was confirmed by learned Sub Judge.  Exercising the<\/p>\n
extra   ordinary   jurisdiction   of   this   court   under<\/p>\n

Article 227 of the Constitution of India, it is not<\/p>\n
proper   to   interfere       with   the   factual   finding   in<\/p>\n
the   orders   of   the   courts   below.   The   suit   was<\/p>\n
instituted   in   2004.     The   suit   is   ripe   for   trial.\n<\/p>\n
The trial of the suit could be  expedited.\n<\/p>\n
      Writ   Petition   is   therefore   disposed   of   by<\/p>\n
directing   learned   Munsiff   to   dispose   of   O.S.167\/04<\/p>\n
as   expeditiously   as   possible   and   in   any   event<\/p>\n
within   four   months   from   the   date   of   receipt   of   a<\/p>\n
copy   of   the   judgment,   and       untrammelled   by   any<\/p>\n
observations   in   Ext.P5   and   P6   orders   or   this<\/p>\n
judgment.\n<\/p>\n
