DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 18\/02\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>This<br \/>\n\tapplication is filed under Section 439 of the Code of Criminal<br \/>\n\tProcedure in connection with first information report registered at<br \/>\n\tCR No.I 91\/2010 with Dahod Town Police Station, Dist. Dahod,  for<br \/>\n\tthe offences punishable under Sections 465, 406, 467, 471 and 114 of<br \/>\n\tthe Indian Penal Code.\n<\/p>\n<p>Learned<br \/>\n\tcounsel appearing for the applicants submits that the investigation<br \/>\n\tis on the verge of completion so far as the applicant herein is<br \/>\n\tconcerned and allegations against the applicant are to the extent<br \/>\n\tthat the order of the authority was prepared by him for regularizing<br \/>\n\ttransaction of the land belonging to the tribal, which took place as<br \/>\n\tearly as in the year 1971.  It is further submitted that the<br \/>\n\tapplicant has roots in the society, will not flee from justice and<br \/>\n\twill cooperate with the investigation as and when called for. It is<br \/>\n\tfurther submitted that in view of the above, the<br \/>\n\tapplicant may be enlarged on bail.\n<\/p>\n<p>Learned<br \/>\n\tAPP for the respondent &#8211; State however opposes bail on the<br \/>\n\tground that the applicant has tampered with the government record<br \/>\n\tand considering his past record, he may not be enlarged on bail.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel for the parties and perusing the record of the<br \/>\n\tcase, it transpires that so far as land in question is concerned,<br \/>\n\tthe order in question is set aside by the authority and the<br \/>\n\tapplicant being a government servant, now  placed under suspension,<br \/>\n\tis not likely to either influence the witnesses or tamper with the<br \/>\n\trecord, which is in the custody of the authority,  without<br \/>\n\tdiscussing the evidence in detail, at this stage, I am inclined to<br \/>\n\tenlarge the applicant on bail.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the parties do not press for further reasoned order.\n<\/p>\n<p>In<br \/>\n\tthe facts and circumstances of the case, the application is allowed<br \/>\n\tand the applicant is ordered to be released on bail in connection<br \/>\n\twith first information report registered at C.R. No.I 91\/2010 with<br \/>\n\tDahod Town Police Station, Dist. Dahod, on executing a bond of<br \/>\n\tRs.5,000\/- (Rupees Five thousand only) with one surety of the like<br \/>\n\tamount to the satisfaction of the trial Court and subject to the<br \/>\n\tconditions that he shall;\n<\/p>\n<p>not<br \/>\n\ttake undue advantage of liberty or misuse liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>surrender<br \/>\n\tpassport, if any, to the lower court within a week;\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>mark<br \/>\n\tpresence at the concerned police station on the first Sunday of<br \/>\n\tevery month between 10.00 a.m. and 3.00 p.m. for three months only;\n<\/p>\n<p>furnish<br \/>\n\tthe present address of his residence to the I.O. and also to the<br \/>\n\tCourt at the time of execution of the bond and shall not change the<br \/>\n\tresidence without prior \tpermission of this Court;\n<\/p>\n<p>The<br \/>\n\tAuthorities will release the applicant only if not required in<br \/>\n\tconnection with any other offence for the time being.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the Sessions<br \/>\n\tJudge concerned will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbond to be executed before the lower court having jurisdiction to<br \/>\n\ttry the case.\n<\/p>\n<p>At<br \/>\n\tthe trial, the trial court shall not be influenced by the<br \/>\n\tobservations of preliminary nature, qua the evidence at this stage,<br \/>\n\tmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute to the aforesaid extent.
