{"id":108679,"date":"2010-03-23T00:00:00","date_gmt":"2010-03-22T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/ms-renduchintala-rajlaxmi-vs-central-bureau-of-investigation-on-23-march-2010"},"modified":"2016-03-21T14:24:48","modified_gmt":"2016-03-21T08:54:48","slug":"ms-renduchintala-rajlaxmi-vs-central-bureau-of-investigation-on-23-march-2010","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/ms-renduchintala-rajlaxmi-vs-central-bureau-of-investigation-on-23-march-2010","title":{"rendered":"Ms. Renduchintala Rajlaxmi &#8230; vs Central Bureau Of Investigation &#8230; on 23 March, 2010"},"content":{"rendered":"<div class=\"docsource_main\">Central Information Commission<\/div>\n<div class=\"doc_title\">Ms. Renduchintala Rajlaxmi &#8230; vs Central Bureau Of Investigation &#8230; on 23 March, 2010<\/div>\n<pre>                CENTRAL INFORMATION COMMISSION\n                Complaint No. - CIC\/WB\/C\/2009\/000121 dated: 17.03.'09\n                     Right to Information Act- Section 18(1) (b)\n\nComplainant:        Ms. Renduchintala Rajlaxmi Sharma\nRespondent:         Central Bureau of Investigation (CBI), Nagpur, Maharashtra.\n                            Decision announced 23.3.'10\nFacts<\/pre>\n<p>:-\n<\/p>\n<p>      The Commission has received a complaint from Ms Renduchintala<br \/>\nRajlaxmi Sharma of Nagpur, Maharashtra that her request under RTI Act, 2005<br \/>\nsubmitted to the Central Public Information Officer, Central Bureau of<br \/>\nInvestigation, Nagpur, through which CPIO was requested to inform her<br \/>\nregarding time &amp; date when drugs, chemicals, metals, minerals were mixed in<br \/>\nher eatable and her drinking water by FBI USA together with other similar<br \/>\ninformation by collecting the same from FBI, USA, Queen Elizabeth U.K.,<br \/>\nGermany, Russia, G-8 Countries and all other countries, to enable her to seek<br \/>\ncompensation, has not been responded to, even though the same was duly<br \/>\nsubmitted on dated 09.06.2008.\n<\/p>\n<p>      Admitting the complaint of Miss Sharma under Section 18(1) (b) of RTI<br \/>\nAct, 2005 the commission served a notice on 26.02.2010 on CPIO, Central<br \/>\nBureau of Investigation, Nagpur for furnishing comments on the complaint. In<br \/>\nresponse, the CPIO Supdt. of Police, CBI, ACB, Nagpur has submitted his<br \/>\ncomments on 08.03.2010 with a copy endorsed to complainant. The CPIO has<br \/>\ninformed the Commission that, since the request dated 09.06.2008 of the<br \/>\ncomplainant which was received on 10.06.2008 was neither under the provision<br \/>\nof Right to Information Act, 2005 as no stamp charges\/ fees was affixed\/ paid<br \/>\nwith the application, nor did the application contain any relevant information and<br \/>\nwas not supported by any documents, and also because it was not relevant to<br \/>\nany matter under the purview of CBI, the same was filed after analyzing the<br \/>\ncomplaint in detail and proper application of mind. He has further informed that<br \/>\nMs. Sharma, thereafter, filed 1st appeal before the 1st appellate authority on<br \/>\n24.06.2009 along with purported stamped application which was disposed of by<\/p>\n<p><span class=\"hidden_text\">                                         1<\/span><br \/>\n the appellate authority through his reply dated 16.09.2009. The CPIO has made<br \/>\nthe Commission aware of the habit of the complainant for sending &#8220;vague<br \/>\ncomplaints narrating various incidents which happened are happening under the<br \/>\nsky&#8221; by enclosing a copy of similar complaints received from her with the<br \/>\ncomments.\n<\/p>\n<p>                                     Decision<br \/>\n       From a perusal of the facts available in the record, it would appear, that<br \/>\nthe application of the complainant indeed did not qualify as an application under<br \/>\nRTI Act, 2005 as no fee was paid by the complainant as per the provision of<br \/>\nRight to Information (Regulation of Fee &amp; Cost) Rule, 2005. It has also been<br \/>\nobserved that information that was purportedly sought by her through her<br \/>\napplication dated 09.06.2008 could not conceivably be held by or under the<br \/>\ncontrol of the CBI, and this has already been conveyed to appellant by the<br \/>\nappellate authority of the department in response to her appeal u\/s 19(1). In light<br \/>\nof the above facts present complaint is not sustainable and is hereby dismissed.\n<\/p>\n<p>       Announced this twenty-third day of March 2010.
