AND DISTT.- SAHARSA\n                                  -----------\n<\/pre>\n<p>2.   13.9.2010                Heard learned counsel for the petitioner and<\/p>\n<p>                 the State.\n<\/p>\n<p>                              By order dated 9.5.2008, the selection of the<\/p>\n<p>                 petitioner as Aganwari Sewika was set aside on grounds<\/p>\n<p>                 of residence. She questioned the same in appeal which<\/p>\n<p>                 has been rejected by order dated 12.9.2009 of the<\/p>\n<p>                 Commissioner, Koshi Division, Saharsa.<\/p>\n<p>                              Learned counsel for the petitioner makes a<\/p>\n<p>                 short submission, to urge that an appellate order is<\/p>\n<p>                 required to be reasoned and discussed, displaying<\/p>\n<p>                 application of mind not only to the original order but also<\/p>\n<p>                 the grounds urged to challenge the original order. There is<\/p>\n<p>                 no discussion in the appellate order of the grounds taken<\/p>\n<p>                 by    the    petitioner   assailing    the     original    order   of<\/p>\n<p>                 termination and why the appellate authority did not find<\/p>\n<p>                 any substance or justification in the grounds of challenge.<\/p>\n<p>                 The   submission      was    that     the    attack   is   more    on<br \/>\n<span class=\"hidden_text\">                     2<\/span><\/p>\n<p>procedures rather than the final order. In absence of any<\/p>\n<p>reasons contained in the appellate order, it becomes<\/p>\n<p>arbitrary.\n<\/p>\n<p>             Counsel for the State urged that the original<\/p>\n<p>order of termination was reasoned, that the petitioner was<\/p>\n<p>not a resident of the captive area.\n<\/p>\n<p>             An appellate order is required to display<\/p>\n<p>proper application of mind to the issues raised, the<\/p>\n<p>discussion of the original order followed by a critical<\/p>\n<p>analysis of the two to arrive at its own finding based on<\/p>\n<p>reasoned specified. It need not be very elaborate but must<\/p>\n<p>display appreciation, understanding and conclusion.<\/p>\n<p>             In (2008)3 SCC 469 ( Divisional Forest Officer<\/p>\n<p>Kotha Gudem &amp; Ors. Vs. Madhusudhan Rao ) discussing<\/p>\n<p>the duties of the appellate authority, it has been held at<\/p>\n<p>Paragraph 20 as follows:-\n<\/p>\n<blockquote><p>                            &#8220;20. It is no doubt also true that an<br \/>\n              appellate or revisional authority is not required to<br \/>\n              give detailed reasons for agreeing and confirming<br \/>\n              an order passed by the lower forum but, in our<br \/>\n              view, in the interests of justice, the delinquent<br \/>\n              officer is entitled to know at least the mind of the<br \/>\n              appellate or revisional authority in dismissing his<br \/>\n              appeal and\/or revision. It is ture that no detailed<br \/>\n              reasoned are required to be given, but some brief<br \/>\n              reasons should be indicated even in an order<br \/>\n              affirming the views of the lower forum.&#8221;<\/p><\/blockquote>\n<p>       This Court therefore finds it difficult to sustain the<\/p>\n<p>appellate order dated 12.9.2009 in its present form. It is<\/p>\n<p>set aside.     The matter is remanded to the appellate<br \/>\n<span class=\"hidden_text\">                              3<\/span><\/p>\n<p>           authority to pass a fresh, reasoned and speaking order of<\/p>\n<p>           his satisfaction from the materials on record, preferably<\/p>\n<p>           within a maximum period of four months from the date of<\/p>\n<p>           receipt\/production of a copy of this order, to facilitate<\/p>\n<p>           judicial review, should the need arise.<\/p>\n<p>                      The writ application stands allowed.\n<\/p>\n<\/p>\n<pre>P.
