\tIn
\nthis application in paragraph 9(a), a prayer is made to allow
\napplicant to appear in examination of TET (Teacher’s Eligibility
\nTest) to be held on or around 31st August, 2011. The very
\napplicants have filed Special Civil Application No.6781 of 2011,
\nwherein, this Court has passed an order on 9th June, 2011,
\nwhich is quoted as under :\n<\/p>\n
“1.\n<\/p>\n
Rule returnable on 28th
\nJuly 2011. Mr. Raval, learned A.G.P. waives service of
\nnotice of Rule on behalf of respondent Nos. 1 and 2.\n<\/p>\n
2. Mr. Raval, learned
\nA.G.P. places on record the further affidavit on behalf of respondent
\nNo.2. The same is taken on record.\n<\/p>\n
3. Heard learned
\nAdvocate Mr. Hiren M. Modi for the petitioners and learned A.G.P. Mr.
\nJanak Raval for the respondents, as regards the interim relief.\n<\/p>\n
4. The petitioners in
\nthe present petition have challenged the resolution dated 27th
\nApril, 2011 issued by the Education Department to the extent that no
\nrelaxation in the Minimum Qualifying Marks has been granted to the
\ncandidates belonging to the reserved category. The petitioners have
\nalso prayed for the interim relief directing the respondents to
\npermit the petitioners to appear in the examination of Teachers
\nEligibility Test (TET) to be held on 12th June, 2011.\n<\/p>\n
5. It has been submitted
\nby learned Advocate Mr. Modi for the petitioners that the petitioners
\nbelong to the SC\/ST and SEBC category and have passed their B.A. and
\nB.Ed. Examinations. According to Mr. Modi, on 27th April,
\n2011, the respondents have issued the resolution fixing the standards
\nfor the appointment of the Primary School Teachers\/Vidya Sahayaks and
\nHigher Primary School Teachers\/Vidya Sahayaks requiring the
\ncandidates to secure the qualifying marks in the TET, however, no
\nrelaxation in the Minimum Qualifying Marks has been given to the
\ncandidates belonging to the reserved category, like the petitioners.
\nMr. Modi, relying upon the communication dated 1st April
\n2011 of National Council for Teacher Education, addressed to all the
\nSecretaries and Commissioners of Education of the State Governments,
\ncommunicating the decision taken by the NCTE for relaxation up to 5%
\nin the qualifying marks to the SC\/ST candidates, in accordance with
\nthe extent policy of the State Governments, submitted that in view of
\nthe said decision taken by the NCTE, the State Government also should
\ngrant the relaxation in the Minimum Qualifying Marks to the reserved
\ncategory candidates. Mr. Modi submitted that till the State
\nGovernment takes the policy decision, in view of the said decision of
\nthe NCTE, the petitioners be permitted to appear in the examination
\nof TET, scheduled to be held on 12th June, 2011.\n<\/p>\n
6. Learned A.G.P. Mr.
\nRaval, however, relying upon the affidavit-in-reply and further
\naffidavit filed on behalf of respondent No.2 submitted that the
\npetitioners have no legal, much less fundamental rights to seek
\nrelaxation as prayed for in the petition. According to Mr. Raval, the
\nMinimum Qualifying Marks having been fixed by the Notification and
\nthe issue as to whether the relaxation should be granted to the
\ncandidates belonging to the reserved category or not, is a matter of
\npolicy decision, to be taken by the State Government. In reply to the
\nsubmission made by learned Advocate Mr. Modi as regards the letter of
\nNCTE dated 01.04.2011, Mr. Raval has stated that the NCTE has issued
\nthe said decision in accordance with the policy of the State
\nGovernment and that the State Government having passed the Resolution
\ndated 27.04.2011 wherein no such relaxation has been provided, the
\npetitioners cannot be permitted to appear in the examination of TET
\nto be held on 12th June, 2011.\n<\/p>\n
7. Having regard to the
\ncontentions raised by the learned Advocates for the parties, and the
\ndocuments on record, it clearly transpires that the petitioners have
\nsought to challenge the Resolution dated 27.04.2011 passed by the
\nrespondent Education Department wherein no relaxation in the
\nQualifying Marks to be obtained in TET, has been given to the
\ncandidates belonging to the reserved category, like SC\/ST & SEBC.
\nIt is true that NCTE appears to have taken the decision as contained
\nin the letter dated 01.04.2011 to the effect that the relaxation up
\nto 5% in the Qualifying Marks should be allowed to the SC\/ST
\ncandidates, however, it is subject to the policy of the concerned
\nState Governments\/Union Territories and other School Managements. In
\nview of the further affidavit filed by the respondent No.2, it
\nclearly transpires that the State Government in Education Department,
\nwhile passing the resolution dated 27.04.2011, has not granted any
\nsuch relaxation in the Qualifying Marks in the TET. Under the
\ncircumstances, as rightly submitted by learned A.G.P. Mr. Raval, this
\nbeing a matter of policy decision of the Government, the petitioners
\ncannot insist to grant relaxation in the Qualifying Marks. Since no
\nlegal much less fundamental rights of the petitioners have been
\nallegedly violated by the respondents, the respondents could not be
\ndirected to take a particular policy decision, and the petitioners
\ncould not be permitted to appear in the TET examination to be held on
\n12th June 2011 as prayed for by the petitioners by way of
\ninterim relief.\n<\/p>\n
8. In that view of the
\nmatter, the prayer of the petitioners to grant interim relief as
\nprayed for in para 11(b) could not be granted.”\n<\/p>\n
\tThe
\nvery same prayer, which has been made by applicant – petitioner
\nin aforesaid main Special Civil Application in paragraph 11(b), has
\nbeen rejected by this Court. Against which, no further challenge has
\nbeen made by petitioner. However, same relief has been prayed in
\npresent application only on ground that examination of TET is going
\nto be scheduled on or around 31st August, 2011.\n<\/p>\n
\tIf
\nthat be so, let applicant – petitioner may approach respondents
\nwith such a request.\n<\/p>\n
\tAs
\nand when such approach will be made by applicant, let respondents be
\nconsider it in accordance with law on or before 31st
\nAugust, 2011.\n<\/p>\n
\tIn
\nview of above observation and direction, present application is
\ndisposed of by this Court.\n<\/p>\n
\tDirect
