Respondents.\n                                    -----------\n<\/pre>\n<p>2.       01.04.2011                Having heard learned counsel for the<\/p>\n<p>                       parties as also taking into account that the claim of the<\/p>\n<p>                       petitioner for appointment on compassionate ground<\/p>\n<p>                       cannot be decided by the respondents inasmuch as two<\/p>\n<p>                       persons were\/are claiming to be adopted sons of the<\/p>\n<p>                       deceased employee, late Parmeshwari Devi who is said<\/p>\n<p>                       to have died on 18.9.2001, this Court would give<\/p>\n<p>                       liberty to the petitioner to file a civil suit seeking a<\/p>\n<p>                       declaration that he is the adopted son of late<\/p>\n<p>                       Parmeshwari Devi and the other person, namely,<\/p>\n<p>                       Santosh Kumar Gupta was never adopted by late<\/p>\n<p>                       Parmeshwari Devi.\n<\/p>\n<p>                                   It goes without saying that since such a<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>            civil suit is to be filed for the purpose of obtaining<\/p>\n<p>            compassionate appointment, the petitioner will also be<\/p>\n<p>            under obligation to implead the respondents of this case<\/p>\n<p>            as defendants in the suit where he can additionally also<\/p>\n<p>            seek a relief for his appointment on compassionate<\/p>\n<p>            ground as per government policy after he is held to be<\/p>\n<p>            sole adopted son of late Parmeshwari Devi by the Civil<\/p>\n<p>            Court.\n<\/p>\n<p>                        With the aforementioned observation and<\/p>\n<p>            liberty, this writ application is disposed of.<\/p>\n<pre>kanchan\/-                         ( Mihir Kumar Jha, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Rajesh Khanna vs The State Of Bihar &amp;Amp; Ors on 1 April, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA CWJC No.4635 of 2007 RAJESH KHANNA adopted son of Late Parmeshwari Devi, resident of vill- Mohinddin Nagar, P S.
