No. 3839 of 2008\n            -------------------------------------------------\n         Dated this the 21st day of October, 2008\n\n                               ORDER\n<\/pre>\n<p>     Three vehicles allegedly belonging to the petitioner were<\/p>\n<p>intercepted and seized by the police and revenue authorities<\/p>\n<p>on the allegation that the same were being utilised for illicit<\/p>\n<p>transportation of river sand. The petitioner has a case that the<\/p>\n<p>same is not river sand and is ordinary earth licitly imported<\/p>\n<p>from Tamil Nadu after payment of the requisite fee, charges<\/p>\n<p>etc.  The seizure was reported to the court.             It is submitted<\/p>\n<p>that the proceedings for confiscation are pending before the<\/p>\n<p>District Collector.\n<\/p>\n<p>     2. Be that as it may, the petitioner applied for release of<\/p>\n<p>the vehicles.   The learned Magistrate by the impugned order<\/p>\n<p>rejected the application.      The petitioner is aggrieved by the<\/p>\n<p>said rejection.\n<\/p>\n<p><span class=\"hidden_text\">Crl.M.C. No. 3839 of 2008 -: 2 :-<\/span><\/p>\n<p>      3. The learned counsel for the petitioner submits that the<\/p>\n<p>vehicles were not in any way involved in violation of the<\/p>\n<p>provisions of the Kerala Protection of River Banks and<\/p>\n<p>Regulation of Removal of Sand Act, 2001 (for short `the Act&#8217;)<\/p>\n<p>and that it was a bona fide transportation of ordinary earth<\/p>\n<p>which is not contumacious or culpable.        The learned counsel<\/p>\n<p>urges that, in these circumstances, the vehicles may be released<\/p>\n<p>unconditionally to the petitioner.\n<\/p>\n<p>      4. The learned Public Prosecutor opposes the application.<\/p>\n<p>The learned Public Prosecutor submits that, at the moment and<\/p>\n<p>with the available inputs, the conclusion appears to be<\/p>\n<p>irresistible that the sand transported in the vehicles is river sand<\/p>\n<p>and such transportation is contrary to the provisions of the Act.<\/p>\n<p>The learned Public Prosecutor, however, submits that the State<\/p>\n<p>has no objection against the release of the vehicles to the<\/p>\n<p>petitioner subject to appropriate conditions and reserving the<\/p>\n<p>right of the petitioner to raise all relevant contentions at the<\/p>\n<p>appropriate later stage.\n<\/p>\n<p>      5.  I reckon the said stand taken by the learned Public<\/p>\n<p>Prosecutor to be absolutely fair and reasonable.           It is not<\/p>\n<p>possible at the moment for this Court to come to any authentic<\/p>\n<p>conclusion as to whether the articles allegedly transported in the<\/p>\n<p><span class=\"hidden_text\">Crl.M.C. No. 3839 of 2008 -: 3 :-<\/span><\/p>\n<p>vehicles were river sand contrary to the provisions of the Act or<\/p>\n<p>only ordinary earth to which transportation no offence under the<\/p>\n<p>Act is attracted.   Reserving the right of the petitioner to raise<\/p>\n<p>all such contentions, directions to release the vehicles can be<\/p>\n<p>issued subject to appropriate conditions.      In coming to this<\/p>\n<p>conclusion, I imbibe the mandate of the decision of the Supreme<\/p>\n<p>Court in <a href=\"\/doc\/25703131\/\">Sunderbhai Ambalal Desai v. State of Gujarat (AIR<\/a><\/p>\n<p>2003 SC 638) which insists that the valuable properties should<\/p>\n<p>not be exposed to the risk of damage and deterioration by<\/p>\n<p>exposure to sun and rain.\n<\/p>\n<p>      6. In the result:\n<\/p>\n<p>      (a) This Crl.M.C. is allowed.\n<\/p>\n<p>      (b) The impugned order is set aside.\n<\/p>\n<p>      (c) The vehicles in question shall be released to the<\/p>\n<p>petitioner on the following terms and conditions:<\/p>\n<p>      (i)   The petitioner shall produce before the learned<\/p>\n<p>Magistrate all documents to show that he is the owner and is<\/p>\n<p>entitled to possession of the three vehicles concerned.<\/p>\n<p>      (ii) He shall execute a bond for an amount equal to the<\/p>\n<p>total value of the vehicles concerned as provisionally assessed by<\/p>\n<p>the learned Magistrate with two solvent sureties each for the<\/p>\n<p>like sum.\n<\/p>\n<p><span class=\"hidden_text\">Crl.M.C. No. 3839 of 2008 -: 4 :-<\/span><\/p>\n<p>      (iii) The petitioner shall deposit an amount of Rs.25,000\/-<\/p>\n<p>each in respect of each vehicle (Rs.75,000\/- in all) which amount<\/p>\n<p>shall be retained in court deposit and shall be released to the<\/p>\n<p>petitioner on proof that a favourable finding has been rendered<\/p>\n<p>by the District Collector in his favour in confiscation proceedings<\/p>\n<p>or that the amounts ordered in such confiscation proceedings<\/p>\n<p>have been deposited before the District Collector by the<\/p>\n<p>petitioner.\n<\/p>\n<p>      7. Hand over a copy of this order to the learned counsel for<\/p>\n<p>the petitioner.\n<\/p>\n<\/p>\n<p>                                                    Sd\/-\n<\/p>\n<p>                                         (R.
