Justice S.S.SATHEESACHANDRAN\n\n Dated :12\/10\/2009\n\n O R D E R\n            S.S.SATHEESACHANDRAN, J.\n          -----------------------------\n            W.P.(C).No.31650 OF 2008\n           --------------------------\n     Dated this the 12th day of October 2009\n     -------------------------------------\n\n\n                     JUDGMENT\n<\/pre>\n<p>        The writ petition is filed seeking the<\/p>\n<p>following reliefs.\n<\/p>\n<p>        i)  Call for the entire records leading to<\/p>\n<p>Ext.P4 and quash the same by issuing a writ a<\/p>\n<p>certiorari  or  any  other  appropriate   order  or<\/p>\n<p>direction.\n<\/p>\n<p>        ii)  Set aside Ext.P4 order and allow the<\/p>\n<p>prayer for declaration sought in I.A No.1771\/2007<\/p>\n<p>in O.S No.63\/2005.\n<\/p>\n<p>        iii)   Grant such other relief which are<\/p>\n<p>just and necessary in the interest of justice.<\/p>\n<p>        2.   Petitioner is the plaintiff in O.S<\/p>\n<p>No.63  of  2005  on  the  file  of  Munsiff  Court,<\/p>\n<p>Vadakanchery.   Suit was filed for a decree of<\/p>\n<p>perpetual   prohibitory    injunction,   and    the<\/p>\n<p>W.P.(C).No.31650 OF 2009     Page numbers<\/p>\n<p>respondents are the defendants.        Resisting the suit<\/p>\n<p>claim, the defendants filed a written statement<\/p>\n<p>contending that they are in possession of the<\/p>\n<p>plaint property.        Plaintiff then applied for an<\/p>\n<p>amendment to seek additional relief of declaration<\/p>\n<p>of   title    and    recovery  of    possession.     That<\/p>\n<p>amendment was objected to by the defendants filing<\/p>\n<p>objections.     The learned Munsiff after hearing both<\/p>\n<p>sides declined the amendment sought for vide Ext.P4<\/p>\n<p>order.     Propriety and correctness of Ext.P4 order<\/p>\n<p>is challenged in the writ petition invoking the<\/p>\n<p>supervisory jurisdiction vested with this court<\/p>\n<p>under Article 227 of the Constitution of India.<\/p>\n<p>          3.     I heard the counsel on both sides.<\/p>\n<p>Proposed amendment was declined by the court below<\/p>\n<p>under the impugned order,      according to the learned<\/p>\n<p>counsel for the petitioner, without taking into<\/p>\n<p>account the need and necessity for incorporating<\/p>\n<p>W.P.(C).No.31650 OF 2009     Page numbers<\/p>\n<p>such an amendment for a proper adjudication of the<\/p>\n<p>suit and its fair disposal.           The reasons given<\/p>\n<p>under the order for turning down the amendment<\/p>\n<p>sought for, it is submitted, are not correct.       The<\/p>\n<p>learned counsel for the respondents pointing out<\/p>\n<p>that in the writ petition,          petitioner\/plaintiff<\/p>\n<p>has confined his challenges against Ext.P4 order<\/p>\n<p>only in respect of the amendment declined as to the<\/p>\n<p>declaration of title sought for, but not relating<\/p>\n<p>to recovery of possession, submitted that, if at<\/p>\n<p>all the amendment is found allowable in reversal of<\/p>\n<p>Ext.P4 order passed by the court below, it may be<\/p>\n<p>allowed in respect of the amendment relating to<\/p>\n<p>declaration of title alone.       Perusing Ext.P4 order,<\/p>\n<p>challenge impugned in the writ petition, I find<\/p>\n<p>that the learned Munsiff was not correct in stating<\/p>\n<p>that   by    allowing    the proposed    amendment,  the<\/p>\n<p>character of the suit will change.       When the decree<\/p>\n<p>of    injunction      sought  by    the  plaintiff,   is<\/p>\n<p>W.P.(C).No.31650 OF 2009     Page numbers<\/p>\n<p>challenged by the defendants disputing his right<\/p>\n<p>over the property contending that they are in<\/p>\n<p>possession it may be become necessary for the<\/p>\n<p>plaintiff to prove his title over the property as<\/p>\n<p>well, for which, an amendment of the suit for<\/p>\n<p>declaration of his title may become essential.<\/p>\n<p>Amendments     are    intended  to    resolve  the  real<\/p>\n<p>controversies arising in a lis between the parties,<\/p>\n<p>and where it is so found essential for a fair<\/p>\n<p>adjudication of the dismissal, needless to point<\/p>\n<p>out, such amendment has to be allowed to avoid<\/p>\n<p>multiplicity of proceedings and to advance justice.<\/p>\n<p>Ext.P4 order in the given facts of the case cannot<\/p>\n<p>be sustained.        True, the petitioner in the writ<\/p>\n<p>petition    has    stated  that  with    respect to  the<\/p>\n<p>amendment sought for, he is interested only in<\/p>\n<p>canvassing the amendment for declaration of title<\/p>\n<p>but not of recovery of possession.           That can be<\/p>\n<p>canvassed by the respondents\/defendants before the<\/p>\n<p>W.P.(C).No.31650 OF 2009     Page numbers<\/p>\n<p>court below to consider as to what extent the<\/p>\n<p>amendment can be allowed.          Setting aside Ext.P4<\/p>\n<p>order, I direct the court below to consider Ext.P3<\/p>\n<p>amendment application moved by the plaintiff taking<\/p>\n<p>note of the observations made above, and dispose it<\/p>\n<p>in accordance with law.
