The petitioner&#8217;s<\/p>\n<p>grievance is that in the ballot paper their names have been<\/p>\n<p>shown as Moyan Kolakkadan and Moyan Kottammal,though there<\/p>\n<p>is difference in their residential names. The petitioner is seeking<\/p>\n<p>for a direction to the Returning Officer to publish his name as<\/p>\n<p>Moyan Kolakkadan and that of the 5th respondent as Moyin<\/p>\n<p>Kottammal. It is pointed out that the 5th respondent is mainly<\/p>\n<p>known as Moyin and not Moyan. In support of the above plea,<\/p>\n<p>Exhibit P4 voters list has been produced. Complaining about the<\/p>\n<p>action   of  the     Returning     Officer,    the    petitioner    filed a<\/p>\n<p>representation before the District Collector and failing to get any<\/p>\n<p>positive action in the matter, this Writ Petition has been filed.<\/p>\n<p>      2.   The 1st respondent has filed a statement, as directed<\/p>\n<p>by this Court. It is mainly contended that since the election to<\/p>\n<p>the local bodies is in progress, a Writ Petition under Article 226 of<\/p>\n<p>the Constitution of India cannot be entertained.                Reliance is<\/p>\n<p><span class=\"hidden_text\">W.P.(C)No.31837\/10                -2-<\/span><\/p>\n<p>placed on various decisions of the Apex Court and that of this<\/p>\n<p>Court   in   <a href=\"\/doc\/173865\/\">N.P.Ponnuswami v.         The Returning Officer,<\/p>\n<p>Namakkal Constituency (AIR<\/a> 1952 SC 64), Mohinder Singh<\/p>\n<p>Gill v. Chief Election Commissioner and others (AIR 1978<\/p>\n<p>SC 851), Anugrah Narain Singh v. State of UP(1996(6) SCC<\/p>\n<p>303), <a href=\"\/doc\/1247997\/\">Election Commission of India v. Ashok Kumar and<\/p>\n<p>others<\/a> (2000 (8) SCC 216), <a href=\"\/doc\/481682\/\">Harnek Singh v. Charanjith<\/p>\n<p>Singh and others<\/a> (2005 (8) SCC 383 and <a href=\"\/doc\/1530123\/\">Kurapati Maria<\/p>\n<p>Das v. Dr.Ambedkar Seva Samajan and others<\/a> (2009(7)<\/p>\n<p>SCC 387).\n<\/p>\n<p>      3.    It is further pointed out in paragraph No.8 that Rule<\/p>\n<p>28(4) of the Kerala Panchayat Raj (Conduct of Election)Rules,<\/p>\n<p>1995 provides that if two or more candidates bear the same<\/p>\n<p>name, they shall be distinguished by the addition of their<\/p>\n<p>occupation or residence or in some other manner.         The 5th<\/p>\n<p>respondent submitted an application on 7.10.2010 before the<\/p>\n<p>publication of list of contesting candidates to the Returning<\/p>\n<p>Officer that he is popularly known as Moyan Kottammal and his<\/p>\n<p>name in the ballot paper may be printed as Moyan Kottammal.<\/p>\n<p>Allotment of symbol also was made on the same date after the<\/p>\n<p><span class=\"hidden_text\">W.P.(C)No.31837\/10                -3-<\/span><\/p>\n<p>time fixed for withdrawal of candidature.        On receipt of the<\/p>\n<p>complaint of the petitioner, the District Collector called for a<\/p>\n<p>report from the Returning Officer. Finally it is pointed out that<\/p>\n<p>the election process has reached an advance stage and the date<\/p>\n<p>of polling is on 23.10.2010. The printing of ballot papers are over<\/p>\n<p>and postal ballots have been despatched.\n<\/p>\n<p>      4.    The learned counsel for the petitioner submitted that<\/p>\n<p>in the light of Section 52(4) of the Panchayat Raj Act, the<\/p>\n<p>Returning Officer had to verify the electoral roll to find out the<\/p>\n<p>description of the candidate also. It is therefore pointed out that<\/p>\n<p>herein the electoral roll has definitely given the name and the<\/p>\n<p>description of the 5th respondent as Moyin Kottammal instead of<\/p>\n<p>Moyan Kottammal and hence the action is unsupportable.<\/p>\n<p>      5.    Evidently, the action was taken by the Returning<\/p>\n<p>Officer in the light of the application filed by the 5th respondent.<\/p>\n<p>Rule 28(4) enables the Returning Officer to consider that<\/p>\n<p>application.\n<\/p>\n<p>      6.    As rightly pointed out by the learned Standing Counsel<\/p>\n<p>for the Election Commission, at this 11th hour, as the ballot<\/p>\n<p>papers have already been despatched, it may not be proper for<\/p>\n<p><span class=\"hidden_text\">W.P.(C)No.31837\/10                -4-<\/span><\/p>\n<p>this Court to interfere with the election process.<\/p>\n<p>      7.    The learned counsel for the petitioner submitted that<\/p>\n<p>he is prepared to meet the expenses for printing the ballot papers<\/p>\n<p>again.
