Bihar<\/p>\n<p>                  University, Muzaffarpur.\n<\/p>\n<p>                             The petitioner, who retired with<\/p>\n<p>                  effect     from       31.1.2002     as       Head   of     the<\/p>\n<p>                  Department of Geography from B.R.A. Bihar<\/p>\n<p>                  University,         has      made        a    prayer       for<\/p>\n<p>                  directing       the      respondents         to   grant    50%<\/p>\n<p>                  merger   of     Dearness       relief on          his    basic<\/p>\n<p>                  pension with effect from 1.1.2005 in terms<\/p>\n<p>                  of government resolution and also for a<\/p>\n<p>                  declaration        that       he    is       entitled      for<\/p>\n<p>                  revision      of      his    pension         in   terms     of<br \/>\n<span class=\"hidden_text\">                      2<\/span><\/p>\n<p>Government           Resolution              No.820      dated<\/p>\n<p>23.9.2009.\n<\/p>\n<p>             Learned counsel for the petitioner<\/p>\n<p>has drawn my attention to Annexure-2\/C to<\/p>\n<p>the writ petition, which is a photo copy<\/p>\n<p>of reported order passed by this Court,<\/p>\n<p>which has been reported in 2011(1)PLJR 900<\/p>\n<p>(Dr.     Himanshu         Bhushan        Vs.     Tilkamanjhi<\/p>\n<p>Bhagalpur         University           and     others).     He<\/p>\n<p>submits       that     in     similar        circumstances,<\/p>\n<p>this     Court,      in       case     of      Dr.    Himanshu<\/p>\n<p>Bhushan (Supra) as well as in other number<\/p>\n<p>of writ petitions, has allowed the writ<\/p>\n<p>petitions.\n<\/p>\n<p>             Learned counsel for the University<\/p>\n<p>is not in a position to dispute this fact.<\/p>\n<p>             In   view      of    the fact       that issue<\/p>\n<p>involved in the present case has already<\/p>\n<p>been decided in number of cases including<\/p>\n<p>in     the    case       of      Dr.   Himanshu        Bhushan<\/p>\n<p>(Supra), there is no reason to deny the<\/p>\n<p>relief to the petitioner.\n<\/p>\n<p>             Accordingly,          the       writ     petition<\/p>\n<p>stands       allowed     in      terms of       order    dated<\/p>\n<p>3.12.2010 passed in C.W.J.C.
