1.\tThe
\npetitioner has taken out present petition seeking below mentioned
\nrelief(s):-\n<\/p>\n
“8(A)\tYour
\nLordships may be pleased to issue a writ of certiorari or any other
\nappropriate writ order or directions and be pleased to direct the
\nrespondent authority to issue a necessary certificate (passport
\npolice certificate) for appear in interview taken by U.S. Embassy as
\nearly as possible.\n<\/p>\n
(B)\tDuring the
\npendency of final hearing and disposal of the petition, Your
\nLordships may be pleased to direct the respondent no.3 to issue a
\nnecessary (police clearance certificate) certificate to petitioner.”\n<\/p>\n
2.\tIt
\nemerges from the record of the petition that the request of the
\npetitioner for certificate is not being considered by the concerned
\nPolice Authority. The petitioner alleged that he was orally informed
\nthat since appeal preferred by the State against the judgment and
\norder dated 21.11.2009 passed by the Presiding Officer and Additional
\nSessions Judge, Fast Track Court No.5, Vadodara in Atrocity Case
\nNo.41 of 2007 is pending, his application is not considered. In view
\nof such oral intimation, the petitioner preferred present petition
\nseeking aforesaid reliefs.\n<\/p>\n
3.\tIt
\nappears that somewhere in 2000, a complaint was lodged against the
\npetitioner under the Scheduled Castes and Scheduled Tribes
\n(Prevention of Atrocities) Act, 1989. Subsequently, the proceedings
\nby way of Atrocity Case No.41 of 2007 were carried out before the
\nCourt of Competent Jurisdiction and by the judgment and order dated
\n21.11.2009, the learned Trial Court passed acquittal order in favour
\nof the petitioner.\n<\/p>\n
4.\tIt,
\nfurther, transpires from the record that somewhere in August, 2010 or
\nthereafter, the State has preferred appeal against the said judgment
\nand order dated 21.11.2009 and the said appeal is pending.\n<\/p>\n
5.\tIt
\nalso transpires from the record that the daughter and the wife of the
\npetitioner are residing in U.S.A and the petitioner appears  to have
\napplied for immigration visa. Differently put, it appears that the
\npetitioner intends to permanently shift and reside in U.S.A. That
\nappears to be the ground of and reason for objection against the
\npetitioner’s application. However, that does not mean that the
\npetitioner should not be conveyed, by the Competent Authority, the
\ndecision regarding his application for necessary certificate. The
\nauthority might be having good number of reasons for granting or
\nrefusing the certificate. However, if there are reasons to not to
\ngrant the certificate, the same should be conveyed to the petitioner.
\nIn present case, the petitioner is aggrieved by the inaction on the
\npart of the respondent authorities.\n<\/p>\n
6.\tIt
\nis only by way of reply affidavit in present petition that the
\nrespondent authorities have stated the reason, but any intimation has
\nnot been forwarded to the petitioner officially as of now. In para-7
\nof the reply affidavit, the respondent authority has stated that “I
\nstate and submit that the wife and daughter of the petitioner is
\nresiding in the United State of America. The petitioner wanted to go
\nabroad for permanent on immigration visa. Therefore, since the
\nCriminal Appeal is pending before this Hon’ble Court and till the
\nsaid Criminal Appeal is not decided finally by the Hon’ble Court the
\nPolice Clearance Certificate cannot be issued to go abroad.”\n<\/p>\n
7.\tLearned
\nadvocate for the respondent has relied upon the decision in the case
\nof  Dhiren Baxi, Chartered Accountant Vs. Regional Passport Officer,
\nAhmedabad (2003 (1) GLH 1) wherein the grievance made by the
\npetitioner was against the Passport Authority who
\nrefused to entertain application for passport on the ground
\nthat pendency case against the
\nacquittal. On the other hand, the petitioner has relied upon
\nthe order dated 25.11.2009 passed in Special Criminal Application
\nNo.1547 of 2009 by the Court (Coram: Mr.Akil A. Kureshi, J.) by order
\ndated 25.11.2009 directed the Police Authority to grant permission to
\nthe applicant to travel abroad on the conditions mentioned in the
\norder.\n<\/p>\n
8.\tIt
\ndeserves to be noted that said order was passed in Special Criminal
\nApplication and not in civil proceedings.\n<\/p>\n
9.\tIn
\npresent case, it is not in dispute that the Appeal No.687 of 2010
\nagainst the acquittal order dated 21.11.2009 has been filed by the
\nState and the said appeal is pending in the High Court.\n<\/p>\n
10.\tIn
\nview of the factual position which emerges from the record the
\nfollowing order is passed.\n<\/p>\n
10.1\tThe
\nCompetent Authority shall take necessary decision on or before 20th
\nApril, 2011 regarding the petitioner’s application. The Competent
\nAuthority may take decision independently on its own merits and
\nwithout being influenced by any orders. The decision may be taken in
\naccordance with law and applicable provision and having regard to the
\nfacts of the case. The decision shall be conveyed to the petitioner.
\nIf the petitioner is aggrieved by the decision, it would be open to
\nthe petitioner to take out appropriate proceedings. Besides this, the
\nremedy to seek permission from the Court where the aforesaid Criminal
\nAppeal is pending is also available to the petitioner. Present
\npetition or present order will not stand in the way of the petitioner
\nfor preferring application before the Court to seek appropriate
\norders therein.\n<\/p>\n
\tWith
\nthe aforesaid clarifications, observations and directions, the
\npetition is disposed of. Notice is discharged.\n<\/p>\n
\tDirect
\nservice is permitted.\n<\/p>\n
