No.1204 of 2006\n            ------------------------------------------------\n            Dated this the 28th day of October, 2008\n\n                          JUDGMENT\n<\/pre>\n<p>Koshy, J<\/p>\n<p>      Appellant\/claimant, a minor, at the age<\/p>\n<p>of 5 sustained head injury in a motor accident<\/p>\n<p>on 13\/04\/02. He with the help of his father<\/p>\n<p>filed an application for compensation claiming<\/p>\n<p>an amount of Rs.6,41,000\/-. The total amount<\/p>\n<p>awarded by the Tribunal was only Rs.2,38,000\/-.<\/p>\n<p>Out of which Rs.1,50,000\/- was awarded towards<\/p>\n<p>reimbursement of medical expenses proved by<\/p>\n<p>actual   bills.        Only         dispute           is    regarding<\/p>\n<p>quantum of compensation awarded in this case.<\/p>\n<p>      2. Appellant was on ventilation for about<\/p>\n<p>50 days. The Tribunal considered the medical<\/p>\n<p>certificate at para 14 to 17 as follows:-<\/p>\n<p><span class=\"hidden_text\">M. A. C. A. No.1204 of 2006               -2-<\/span><\/p>\n<blockquote><p>                       &#8220;Ext.A4(a) is the wound certificate issued from<br \/>\n               Indo American Hospital at Vaikom where petitioner<br \/>\n               was referred from Medical College              Hospital,<br \/>\n               Kottayam. C.T. Scan revealed diffused cerebral<br \/>\n               swelling and subarachnoid hemorrhage &#8211; left temporal<br \/>\n               lobe appeared bit swollen. He underwent left temporal<br \/>\n               lobotomy under general anaesthesia. The minor&#8217;s<br \/>\n               condition improved gradually.\n<\/p><\/blockquote>\n<blockquote><p>                       Ext.A5   is   discharge card.    He    remained<br \/>\n               hospitalised from 13\/04\/02 to 03\/06\/02 for a period of<br \/>\n               about 50 days. He was managed with anticonvulsents<br \/>\n               and antioedema measures and elective ventilation. Post<br \/>\n               operatively an elective tracheostomy was done and<br \/>\n               gradually weaned off the ventilator. He had left<br \/>\n               hemiparesis which started improving. At the time of<br \/>\n               discharge he was advised to undergo physiotherapy<br \/>\n               and to continue medicines. He got re-admitted on<br \/>\n               04\/09\/02 and remained hospitalised till 14\/09\/02 for a<br \/>\n               period of 10 days. He was given physiotherapy and his<br \/>\n               condition improved. Ext.A5(a) is also discharge<br \/>\n               record. He remained hospitalised again from 20\/05\/04<br \/>\n               to 29\/05\/04 for a period of 9 days. He underwent<br \/>\n               physiotherapy and improved Gait pattern.\n<\/p><\/blockquote>\n<blockquote><p>                       Ext.A6 is the certificate issued from Indo<br \/>\n               American Hospital stating that petitioner continued<br \/>\n               treatment for the head injury sustained. Ext.A6(a) is<br \/>\n               treatment    certificate  issued  from     hospital   at<br \/>\n               Vandiperiyar regarding physiotherapy given to minor<br \/>\n               petitioner.\n<\/p><\/blockquote>\n<blockquote><p>                       Ext.A7 is disability certificate. The Medical<br \/>\n               Board of the District Hospital, Kottayam certified 20%<br \/>\n               disability of temporary character as it has found the<br \/>\n               minor was recovering from hemophilia left following<br \/>\n               head injury.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>               3. The total compensation awarded by the<\/p>\n<p>      Tribunal are as follows:-\n<\/p><\/blockquote>\n<blockquote><p><span class=\"hidden_text\">M. A. C. A. No.1204 of 2006          -3-<\/span><\/p>\n<\/blockquote>\n<blockquote><p>                                          (in Rs.)<br \/>\n       Medical Expenses as per           1,50,000 Para 21 of<br \/>\n       admissible bills                           the award<br \/>\n       Extra nourishment &amp;                5,0000  Para 21 of<br \/>\n       attendants charges                         the award<br \/>\n       Transport to hospital               4,000  Para 21 of<br \/>\n                                                  the award<br \/>\n       Pain and suffering                 25,000  Para 22 of<br \/>\n                                                  the award<br \/>\n       Injuries                           20,000  Para 24 of<br \/>\n                                                  the award<br \/>\n       Disability                         50,000  Para 25 of<br \/>\n                                                  the award<br \/>\n       Loss of employment &amp;               12,000  Para 26 of<br \/>\n       amenities in life                          the award<br \/>\n       Shortened expectation in           12,000  Para 27 of<br \/>\n       life                                       the award<br \/>\n       Future medical expenses            5,000   Para 27 of<br \/>\n                                                  the award<br \/>\n                         TOTAL           2,83,000<\/p>\n<\/blockquote>\n<blockquote><p>               4. But due to an accidental mistake,<\/p>\n<p>      Tribunal totalled the same to Rs.2,38,000\/-<\/p>\n<p>      and awarded only the same (see Para 29 of the<\/p>\n<p>      decretory portion). Therefore, the claimant is<\/p>\n<p>      entitled             to  an   additional    amount   of<\/p>\n<p>      Rs.45,000\/-.\n<\/p><\/blockquote>\n<blockquote><p>               5.      The   Tribunal   after  seeing  Ext.A9<\/p>\n<p>      series         regarding   School   Education  Progress<\/p>\n<p><span class=\"hidden_text\">M. A. C. A. No.1204 of 2006          -4-<\/span><\/p>\n<p>      Report of the appellant, also found that there<\/p>\n<p>      occurred            depression    in  the  educational<\/p>\n<p>      progress           of  the  minor.  Even  though, the<\/p>\n<p>      Medical Board certified 20% disability and<\/p>\n<p>      Tribunal did not reject the same, compensation<\/p>\n<p>      was not awarded on a multiplier method. But<\/p>\n<p>      Rs.50,000\/- was awarded for the disability<\/p>\n<p>      occurred on account of hemophilia caused to<\/p>\n<p>      the minor appellant\/petitioner and Rs.20,000\/-<\/p>\n<p>      for the injuries. It is the contention of the<\/p>\n<p>      counsel for the appellant\/petitioner that the<\/p>\n<p>      appellant itself is not normal. His entire<\/p>\n<p>      future life is spoiled. The accident occurred<\/p>\n<p>      at the age of 5. He is unable to compete with<\/p>\n<p>      others because of hemophilia and it is a case<\/p>\n<p>      where even though physical disability is 20%,<\/p>\n<p>      compensation           should   be  granted for  100%<\/p>\n<p>      disability.          The   Tribunal  has granted only<\/p>\n<p>      Rs.5,000\/-            as   compensation   for   extra-<\/p>\n<p><span class=\"hidden_text\">M. A. C. A. No.1204 of 2006        -5-<\/span><\/p>\n<p>      nourishment and attendants charges. He was in<\/p>\n<p>      the hospital for 70 days. He continued his<\/p>\n<p>      treatment in his house. There will be many<\/p>\n<p>      expenses which are not covered by bills during<\/p>\n<p>      his inpatient treatment. He was on inpatient<\/p>\n<p>      treatment            for  many   spells.   Outpatient<\/p>\n<p>      treatment is also continuing. According to the<\/p>\n<p>      claimant,           even now he   is  continuing the<\/p>\n<p>      treatment. Extra nourishment and bystander&#8217;s<\/p>\n<p>      assistance are necessary at his young age. He<\/p>\n<p>      requires a bystander for six months. We are of<\/p>\n<p>      the view that he ought to have been awarded<\/p>\n<p>      Rs.20,000\/- for bystander&#8217;s expenses and extra<\/p>\n<p>      nourishment and incidental expenses is to be<\/p>\n<p>      paid.         Therefore,   he   is  entitled  to   an<\/p>\n<p>      additional amount of Rs.15,000\/- under this<\/p>\n<p>      head. For loss of studies, no amount was<\/p>\n<p>      granted even though at para 19 of the award,<\/p>\n<p>      claimant&#8217;s progress report and report of his<\/p>\n<p><span class=\"hidden_text\">M. A. C. A. No.1204 of 2006        -6-<\/span><\/p>\n<p>      twin brother are observed to show that there<\/p>\n<p>      is depression in the educational progress of<\/p>\n<p>      the        claimant.     Hence,   we   award  another<\/p>\n<p>      Rs.5,000\/- for loss of studies and thus, the<\/p>\n<p>      appellant is entitled to Rs.20,000\/- more. It<\/p>\n<p>      is stated that the amount awarded for future<\/p>\n<p>      medical expenses etc. are very meagre. But<\/p>\n<p>      considering the total compensation awarded, we<\/p>\n<p>      are not enhancing the compensation granted<\/p>\n<p>      under other heads. Thus, the total additional<\/p>\n<p>      amount of Rs.65,000\/- (Rs.20,000 + 45,000 &#8211;<\/p>\n<p>      occurred due to calculation mistake) should be<\/p>\n<p>      deposited by the third respondent\/Insurance<\/p>\n<p>      Company with 9% interest from the date of<\/p>\n<p>      application till its deposit over and above<\/p>\n<p>      the amount decreed by the Tribunal. Out of the<\/p>\n<p>      above,         Rs.30,000\/-  should  be  paid to   the<\/p>\n<p>      father of the claimant as he has already spent<\/p>\n<p>      huge       amount     for the   medical treatment  of<\/p>\n<p><span class=\"hidden_text\">M. A. C. A. No.1204 of 2006        -7-<\/span><\/p>\n<p>      claimant.           The balance  amount  should     be<\/p>\n<p>      deposited in a nationalised bank so as to<\/p>\n<p>      enable the appellant to withdraw the same when<\/p>\n<p>      he becomes major.\n<\/p><\/blockquote>\n<blockquote><p>               6.
