    This petition is filed under section 482 of    Code<\/p>\n
of Criminal Procedure to quash Annexure A1 complaint<\/p>\n
and Annexure A2 First Information Report registered by<\/p>\n
the Police, based on an order of the learned Magistrate<\/p>\n
for investigation under section 156(3) of the Code of<\/p>\n
Criminal  Procedure,  contending  that  no  offence  as<\/p>\n
alleged is made out in the complaint and therefore the<\/p>\n
proceedings is to be quashed.    The Sub Inspector of<\/p>\n
Police, Thodupuzha who is investigating the case filed<\/p>\n
an affidavit stating that   investigation revealed that<\/p>\n
no offence under section 420 IPC is   made out and  in<\/p>\n
view of the order of stay granted by this court no<\/p>\n
refer report could be filed.\n<\/p>\n
    2.    On hearing the learned counsel and going<\/p>\n
through  Annexure A1 complaint, it is clear that  claim<\/p>\n
of the third respondent de facto complainant, is that<\/p>\n
he was cheated by failure to pay the amount     by the<\/p>\n
petitioner pursuant to an agreement entered into.   The<\/p>\n
ingredients of an  offence under section 415 of Indian<\/p>\n
Crl.M.C.2172\/2007              2<\/span><\/p>\n
Penal Code       is necessary to constitute an offence under<\/p>\n
section 420. The complaint does not reveal the ingredients<\/p>\n
constituting the offence.      It is admitted by the Public<\/p>\n
Prosecutor also.     In view of the submission of the learned<\/p>\n
Public Prosecutor that based on the investigation only a<\/p>\n
refer report could be filed, I do not find it necessary    to<\/p>\n
quash the proceedings invoking the powers under section 482<\/p>\n
of the Code of Criminal Procedure.<\/p>\n
      Petition is disposed accordingly.<\/p>\n
