C No.238 of 2009\n          ------------------------------------------------\n          Dated this the 2nd day of January, 2009\n\n                        JUDGMENT\n<\/pre>\n<p>    The judgment debtor in E.P.57\/05 on the<\/p>\n<p>file of the Sub Court, Vadakara in execution<\/p>\n<p>of the decree in O.S.481\/04 on the file of the<\/p>\n<p>Sub Court, Thrissur is the petitioner and the<\/p>\n<p>decree holder is the respondent. The prayer in<\/p>\n<p>this Writ Petition is to set aside Ext.P5<\/p>\n<p>order directing the share of the petitioner<\/p>\n<p>being sold and to adjourn the sale till Ext.P3<\/p>\n<p>petition filed by him under Order 9 Rule 13<\/p>\n<p>CPC to set aside the ex parte decree in the<\/p>\n<p>suit  is  disposed           of       by      the        Sub Court,<\/p>\n<p>Thrissur; to direct the Sub Judge, Thrissur to<\/p>\n<p>serve notice on Ext.P3 petition to Advocate<\/p>\n<p>Sri.Subin  Raj       who       is       appearing          for  the<\/p>\n<p>respondent in the said suit on the execution<\/p>\n<p>side before Sub Court, Vadakara and to direct<\/p>\n<p><span class=\"hidden_text\">W. P. C No.238 of 2009         -2-<\/span><\/p>\n<p>      the Sub Judge, Thrissur to dispose of Ext.P3<\/p>\n<p>      petition as expeditiously as possible within a<\/p>\n<p>      time frame.\n<\/p>\n<p>             2. The suit O.S.481\/04 was decreed ex<\/p>\n<p>      parte by Sub Court, Thrissur on 21\/02\/05.<\/p>\n<p>      Ext.P3 petition to set aside the ex parte<\/p>\n<p>      decree was filed by the petitioner on 18\/02\/08<\/p>\n<p>      after almost three years. Service of notice to<\/p>\n<p>      the respondent\/plaintiff is still not effected<\/p>\n<p>      on Ext.P3. It is seen that the petitioner<\/p>\n<p>      moved E.A.37\/08 under Order 21 Rule 69 of the<\/p>\n<p>      CPC for adjournment of sale on the ground that<\/p>\n<p>      petition to set aside ex parte decree is<\/p>\n<p>      pending. The said petition was allowed by the<\/p>\n<p>      execution        court on  payment of cost  of<\/p>\n<p>      Rs.2,000\/- as per Ext.P4 order dt.21\/02\/08 and<\/p>\n<p>      the sale was adjourned to 03\/03\/08. As late as<\/p>\n<p>      on 17\/11\/08 vide Ext.P5 order the execution<\/p>\n<p>      court observing that there is no payment and<\/p>\n<p><span class=\"hidden_text\">W. P. C No.238 of 2009      -3-<\/span><\/p>\n<p>      no order setting aside ex parte decree is<\/p>\n<p>      produced ordered sale of 14\/140 shares of the<\/p>\n<p>      petitioner\/judgment debtor  in   the  property<\/p>\n<p>      jointly owned by him with others and ordered<\/p>\n<p>      sale being conducted on 05\/01\/09 fixing upset<\/p>\n<p>      price at Rs.8 lakhs. The amount for which the<\/p>\n<p>      decree is being executed is almost Rs.9 lakhs<\/p>\n<p>      and the petitioner has not paid any amount at<\/p>\n<p>      all from out of the said amount. There is no<\/p>\n<p>      reason for this Court to interfere in the<\/p>\n<p>      above circumstances and to stay the execution<\/p>\n<p>      or to direct notice on Ext.P3 petition pending<\/p>\n<p>      before Sub Court, Thrissur being served on the<\/p>\n<p>      counsel for the decree holder appearing on the<\/p>\n<p>      execution side before Sub Court, Vadakara or<\/p>\n<p>      to direct the Sub Judge, Thrissur to dispose<\/p>\n<p>      of Ext.P3 petition when notice in the said<\/p>\n<p>      petition is not served on the respondent. This<\/p>\n<p>      Writ Petition is ill-conceived and is aimed<\/p>\n<p><span class=\"hidden_text\">W. P.
