AND\n                    DISTRICT-SITAMARHI.\n                                         --OPP.PARTY\n\n\n                     For the Petitioners         : M\/s Sanjeev Kmumar\n                                                       Mishra &amp; Santa\n                                                       Kumar\n\n                     For the Opp.party           :   Mr. Uday Kumar\n\n                     For the State               :   Mr. Amarendra Prasad,\n                                                                    APP\n\n\n4   07.10.2010<\/pre>\n<p>                 Heard learned counsel for the petitioners,<\/p>\n<p>                 learned Additional Public Prosecutor for the State and Sri<\/p>\n<p>                 Uday Kumar for opposite party no.2.\n<\/p>\n<p>                               With the consent of the learned counsels, this<\/p>\n<p>                 application is being disposed of at the admission stage itself.<\/p>\n<p>                               This is an application seeking quashing of order<\/p>\n<p>                 dated 04.12.2008 passed in Trial no. 3413 of 2008 arising out<\/p>\n<p>                 of Complaint Case no. 1106 of 2007 passed by Judicial<\/p>\n<p>                 Magistrate, first class, Sitamarhi, taking cognizance for the<br \/>\n<span class=\"hidden_text\">                     2<\/span><\/p>\n<p>offences under Sections 420, 467, 468 and 471 of the Indian<\/p>\n<p>Penal Code.\n<\/p>\n<p>              The relevant facts of this case is that opposite<\/p>\n<p>party no.2 got a sale deed executed in her favour by the<\/p>\n<p>petitioners with respect to 14 dhurs land, old plot no.1390,<\/p>\n<p>new 743 for Rs.47,500\/-.         Subsequently, there was a<\/p>\n<p>proceeding under Sections 144 and 107 of the Code of<\/p>\n<p>Criminal Procedure between her and one Bachchi Devi, not<\/p>\n<p>party to the present case, wherein said Bachchi Devi claimed<\/p>\n<p>herself to be purchaser of plot in question from father of the<\/p>\n<p>petitioners much before. Undisputedly the relevant plot is of<\/p>\n<p>a bigger area and there was one partition suit between the<\/p>\n<p>family of original owners. The complainant opposite party<\/p>\n<p>no.2 in the criminal proceeding asserted her possession by<\/p>\n<p>virtue of the sale deed executed by the petitioners but during<\/p>\n<p>pendency of 107 proceeding itself the complaint petition<\/p>\n<p>before the court below was filed. There is nothing mentioned<\/p>\n<p>about result of 144 of the Code of Criminal Proceeding.<\/p>\n<p>However, it is now disputed that in said proceeding opposite<\/p>\n<p>party no.2 got an order against her.\n<\/p>\n<p>              At the time of execution of the sale deed in<br \/>\n<span class=\"hidden_text\">                      3<\/span><\/p>\n<p>favour of opposite party no.2 the petitioners have clearly<\/p>\n<p>recited in the deed that in case of any defect of title or the<\/p>\n<p>purchaser is out of possession due to such defects, they shall<\/p>\n<p>return the consideration with interest at a particular rate.<\/p>\n<p>              It is submitted on behalf of the petitioners that in<\/p>\n<p>earlier proceedings initiated much after transferring the land<\/p>\n<p>to her, the complainant opposite party no.2 has clearly<\/p>\n<p>asserted her possession but       left the litigation only after<\/p>\n<p>getting an order against her in the proceeding under Section<\/p>\n<p>144 of the Code of Criminal Procedure which was only for a<\/p>\n<p>limited purpose as preventive measure. She, at the instance of<\/p>\n<p>others got initiated the criminal proceeding wherein also there<\/p>\n<p>is nothing averred warranting commission of any offence.<\/p>\n<p>But, cognizance has been taken without any material. On the<\/p>\n<p>other hand, learned counsel for opposite party, while<\/p>\n<p>supporting the order, submitted that petitioners knowing fully<\/p>\n<p>well that some transaction is there in favour of another lady<\/p>\n<p>by their father, but now they are not ready to refund the<\/p>\n<p>money for which initially they were agreed.<\/p>\n<p>              It is evident from the deed in question that there<\/p>\n<p>is an agreement to refund the consideration in case of any<br \/>\n<span class=\"hidden_text\">                               4<\/span><\/p>\n<p>         defect in, title or dispossession due to such defects and in the<\/p>\n<p>         complaint petition in paragraph 3 it is averred that in<\/p>\n<p>         pursuance of such agreement in the deed on the request made<\/p>\n<p>         by the complainant petitioners initially were agreed to refund<\/p>\n<p>         but after initial avoidance, ultimately, refused to pay the<\/p>\n<p>         amount giving rise to complaint petition.<\/p>\n<p>                       The very averments in the complaint petition<\/p>\n<p>         supported with recitals in the sale deed indicates that in fact it<\/p>\n<p>         is a dispute relating to enforcement of an agreement to refund<\/p>\n<p>         the money on certain event.
