SHAH APP for\nRespondent(s) : 1, \n======================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE RAJESH \n\t\t\t\n\t\t\t \n\nH.SHUKLA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 29\/09\/2010  \n \nORAL\nORDER<\/pre>\n<p>\tThe<br \/>\n\tpresent application has been filed by the applicant-accused for<br \/>\n\tgrant of regular bail under Section 439 of Criminal Procedure Code,<br \/>\n\t1973.\n<\/p>\n<p>\tThe<br \/>\n\tapplicant-accused is charged with having committed offences<br \/>\n\tunder sections 66(1)(B), 65(A)(E) and 116 of Bombay Prohibition Act,<br \/>\n\tfor which, FIR has been lodged being Prohibition C.R.No.314\/2010 at<br \/>\n\tJafarabad Police Station.\n<\/p>\n<p>\tLearned<br \/>\n\tadvocate Mr.Pravin Gondaliya for Mr.B.S.Raiyani, learned advocate<br \/>\n\tfor the applicant, referred to the papers and submitted that the<br \/>\n\tconsidering the nature of offence and the role attributed to the<br \/>\n\tapplicant, present application may be allowed.\n<\/p>\n<p>\tLearned<br \/>\n\tA.P.P., Ms.Shah resisted the present application.\n<\/p>\n<p>\tHaving<br \/>\n\theard Mr.Gondaliya learned advocate for the applicant and Ms.Shah,<br \/>\n\tlearned APP and having considered the nature of offences, manner in<br \/>\n\twhich it is alleged to have been committed, role attributed as well<br \/>\n\tas the fact that custodial interrogation is over and recovery has<br \/>\n\tbeen made, present application deserves to be allowed.\n<\/p>\n<p>\tAccordingly,<br \/>\n\tpresent application stands allowed. The applicant is ordered to be<br \/>\n\treleased on regular bail in connection with Prohibition<br \/>\n\tC.R.No.314\/2010 at Jafarabad Police Station on his executing a bond<br \/>\n\tof Rs.5,000\/- (Rupees Five Thousand Only) with one solvent surety of<br \/>\n\tthe like amount to the satisfaction of the lower Court and subject<br \/>\n\tto the conditions that he shall:\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty.\n<\/p>\n<p>(b)\tnot<br \/>\nto try to tamper or pressurize the prosecution witnesses or<br \/>\ncomplainant in any manner.\n<\/p>\n<p>(c)\tnot<br \/>\nact in any manner injurious to the interest of the prosecution.\n<\/p>\n<p>(d)\tmaintain<br \/>\nlaw and order and should cooperate the investigating officers.\n<\/p>\n<p>(e)\tmark<br \/>\nhis presence before concerned Police Station on 1st Monday<br \/>\nof every month of English calender between 11:00 AM to 2:00 PM; till<br \/>\nthe trial commences;\n<\/p>\n<p>(f)\tfurnish<br \/>\nthe address of his residence to the Investigating Officer and also to<br \/>\nthe Court at the time of execution of the bond and shall not change<br \/>\nhis residence without prior permission of the Court.\n<\/p>\n<p>(g)\tsurrender<br \/>\nhis passport, if any, to the lower Court, within a week.\n<\/p>\n<p>\tIf<br \/>\n\tbreach of any of the above conditions is committed, the concerned<br \/>\n\tSessions Judge will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>\tBail<br \/>\n\tbefore the lower Court having jurisdiction to try the case. It would<br \/>\n\tbe open to the trial Court concerned to give time to furnish the<br \/>\n\tsolvency certificate if prayed for.\n<\/p>\n<p>\tRule<br \/>\n\tis made absolute to the aforesaid extent.
