Heard Shri Yugal Kishore, learned<\/p>\n<p>                 Senior Counsel appearing on behalf of the<\/p>\n<p>                 petitioner and learned counsel appearing on<\/p>\n<p>                 behalf of all the respondents\/Bihar State<\/p>\n<p>                 Co-operative          Land      Development       Bank<\/p>\n<p>                 (hereinafter referred to as the Bank).<\/p>\n<p>                         The    petitioner,       who   retired    with<\/p>\n<p>                 effect from 30.4.2006 from head office of<\/p>\n<p>                 the Bank, Patna as Assistant, has claimed<\/p>\n<p>                 that his pre and post retiral dues under<\/p>\n<p>                 the following heads :\n<\/p>\n<pre>                         (i)       Leave Encashment\n\n                         (ii)      Gratuity\n\n                         (iii)     Dearness allowance\n\n                                 (a)    due to increase of D.A.\n\n                                        w.e.f.    July,2007       from\n\n                                        243%      to    251       till\n<span class=\"hidden_text\">                   2<\/span>\n\n\n\n\n                        Sept,2001.\n\n                 (b)    Due to again increase of\n\n                        D.A.     w.e.f.      Jan,2001\n\n                        from 251% to 257% till\n\n                        May,2003.\n\n          (iv)        Salary for the period\n\n<\/pre>\n<p>                      During which the petitioner<\/p>\n<p>                      was on leave.\n<\/p>\n<p>have not been paid. Similarly, it has been<\/p>\n<p>claimed   for     increment      and   stagnation    of<\/p>\n<p>increment since 1989, fixation of pay due<\/p>\n<p>to    revision    of     scale    as   per    5th   Pay<\/p>\n<p>Revision along with interest. It has been<\/p>\n<p>asserted that for the claim raised in the<\/p>\n<p>present writ petition, the petitioner had<\/p>\n<p>approached       the     authority     concerned     on<\/p>\n<p>number of occasions. However, since no step<\/p>\n<p>was taken by the authority concerned, the<\/p>\n<p>petitioner was constrained to approach this<\/p>\n<p>Court by filing the present writ petition.<\/p>\n<p>          In this case, a counter affidavit<\/p>\n<p>has    been      filed     on     behalf      of    the<\/p>\n<p>respondents\/Bank. In the counter affidavit,<\/p>\n<p>virtually,        respondents\/Bank           has    not<\/p>\n<p>disputed the claim of the petitioner, but a<\/p>\n<p>plea of financial crunch has been taken. It<br \/>\n<span class=\"hidden_text\">                       3<\/span><\/p>\n<p>has    further       been        pleaded       that        in       Bank,<\/p>\n<p>arrear of retiral dues are being paid in<\/p>\n<p>chronological             manner        and        dues        of    the<\/p>\n<p>petitioner           will         be         paid        when        the<\/p>\n<p>petitioner&#8217;s               turn         will         come.            The<\/p>\n<p>respondents\/Bank                  along        with            counter<\/p>\n<p>affidavit has brought on record, number of<\/p>\n<p>orders       of    the     office       as     well       as    orders<\/p>\n<p>passed        by         this         Court.        In         similar<\/p>\n<p>circumstance, in a case of employee of a<\/p>\n<p>Bank,        same         plea        was     taken        by        the<\/p>\n<p>respondents\/Bank.                In    the    said        case,      the<\/p>\n<p>petitioner          had     filed           rejoinder          to    the<\/p>\n<p>counter affidavit and brought on record the<\/p>\n<p>fact that financial position of the Bank<\/p>\n<p>has    now        improved.       After       considering            the<\/p>\n<p>facts    and       circumstances,             this        Court,      by<\/p>\n<p>order    dated        12.8.2011,             allowed        C.W.J.C.<\/p>\n<p>No.13656 of 2007 (Sachida Nand Singh Vs.<\/p>\n<p>State    of       Bihar     &amp;    ors.)       and    directed          the<\/p>\n<p>respondents\/Bank,                particularly             respondent<\/p>\n<p>no.3\/Managing Director of the Bank to clear<\/p>\n<p>all the dues within a period of two months<\/p>\n<p>from the date of receipt\/production of a<\/p>\n<p>copy    of    this        order.       The    respondents\/Bank<\/p>\n<p>was further directed to pay interest at the<br \/>\n<span class=\"hidden_text\">                       4<\/span><\/p>\n<p>rate of 4% per annum on the dues from the<\/p>\n<p>date     of     retirement            till     the     date    of<\/p>\n<p>payment. Since the respondents\/Bank has not<\/p>\n<p>disputed the claim of the petitioner and<\/p>\n<p>similar plea taken by the Bank, which was<\/p>\n<p>taken in the case of Sachida Nand Singh&#8217;s<\/p>\n<p>case (Supra), there is no reason to pass a<\/p>\n<p>different order than the order passed in<\/p>\n<p>Sachida Nand Singh&#8217;s case (Supra). Almost<\/p>\n<p>in     similar     situation,           one     another       writ<\/p>\n<p>petition        was       allowed,       which       has      been<\/p>\n<p>reported      in      2011(3)     PLJR        573    (Mithilesh<\/p>\n<p>Kumar Singh Vs. Rajya Sahkari Bhumi Vikash<\/p>\n<p>Bank Ltd.).\n<\/p>\n<pre>           In         view       of     the         facts      and\n\ncircumstances,            this    writ        petition        also\n\nstands     allowed         in    the     same       terms.
