Yes\n\nV.B.Gupta, J.\n<\/pre>\n<p>      Present appeal has been filed by appellant<\/p>\n<p>challenging order dated 25th October, 2007, passed by<\/p>\n<p>the    court     of     Commissioner,      under       Workmen\u201fs<\/p>\n<p>Compensation Act, 1923 (for short as \u201eAct\u201f), vide which<\/p>\n<p>application for setting aside ex-parte orders dated 8th<\/p>\n<p>March, 2006 and 25th May, 2007 was dismissed.<\/p>\n<p>2.    Respondent\/claimant, filed a claim petition for<\/p>\n<p>compensation under the Act, as claimant was working<\/p>\n<p>as    mason      with       appellant.     During      course        of<\/p>\n<p>employment,       respondent        received    injuries      in     an<\/p>\n<p>accident.\n<\/p>\n<\/p>\n<p>3.    Notice of claim petition was issued to the<\/p>\n<p>appellant, but he remained absent.              After taking into<\/p>\n<p>consideration,        the    evidence    lead   by    respondent,<\/p>\n<p>Commissioner Workmen\u201fs Compensation (for short as<\/p>\n<p>\u201eCommissioner\u201f),             awarded       compensation              of<\/p>\n<p><span class=\"hidden_text\">FAO No.73\/2008                                       Page 2 of 8<\/span><br \/>\n Rs.2,36,472\/- to respondent\/claimant along with simple<\/p>\n<p>interest @ 12% p.a. with effect from the date of cause<\/p>\n<p>of action i.e. 9th March, 2004 till date.<\/p>\n<p>4.     In    proceedings   before    Commissioner       on    8th<\/p>\n<p>March, 2006, as appellant failed to appear and did not<\/p>\n<p>file    written      statement,     even    after    sufficient<\/p>\n<p>opportunities have been granted to him, he was<\/p>\n<p>proceeded ex-parte.\n<\/p>\n<\/p>\n<p>5.     Appellant filed an application for setting aside of<\/p>\n<p>ex-parte order.       That application was dismissed by<\/p>\n<p>Commissioner, on 25th October, 2007.<\/p>\n<p>6.     Aggrieved against these orders, appellant has<\/p>\n<p>filed this appeal.\n<\/p>\n<\/p>\n<p>7.     On 3rd March, 2008, when appeal came for<\/p>\n<p>hearing before this Court, following order was passed;<\/p>\n<blockquote><p>            &#8220;Appellant to place on record the entire<br \/>\n            order sheet of Commissioner Workmen\u201fs<br \/>\n            Compensation     and    additionally  to<br \/>\n            comply with Section 30 of the<br \/>\n            Workmen\u201fs Compensation Act.<br \/>\n            Re-notify for 14.7.2008.&#8221;\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">FAO No.73\/2008                                  Page 3 of 8<\/span><\/p>\n<p> 8.    It appears that this order has not been complied<\/p>\n<p>with, till date by appellant.     Since order dated 3rd<\/p>\n<p>March,      2008,   was   not   complied    by   appellant,<\/p>\n<p>respondent on 12th January, 2009, filed an application<\/p>\n<p>under Section 151 CPC read with Section 30 of the<\/p>\n<p>Act, for dismissal of appeal on ground of non deposit of<\/p>\n<p>awarded amount.\n<\/p>\n<\/p>\n<p>9.    No reply to this application has been filed by<\/p>\n<p>appellant, in spite of opportunities granted to him.<\/p>\n<p>10. It has been contended by learned counsel for<\/p>\n<p>respondent, that in view of Section 30 of the Act, as<\/p>\n<p>appellant has not deposited the awarded amount,<\/p>\n<p>present appeal is liable to be dismissed.<\/p>\n<p>11. On the other hand, it is argued by learned counsel<\/p>\n<p>for appellant that he filed an application for setting<\/p>\n<p>aside ex-parte order, as such provisions of Section 30<\/p>\n<p>of the Act, are not applicable to the present case and in<\/p>\n<p>support of its contentions he cited a decision of this<\/p>\n<p><span class=\"hidden_text\">FAO No.73\/2008                               Page 4 of 8<\/span><br \/>\n Court, reported as <a href=\"\/doc\/1973886\/\">Mohd. Idrish &amp; Sons v. Chagga<\/p>\n<p>Ali and Another,<\/a> 2003 (71) DRJ 147.\n<\/p>\n<p>12. Section 30 of the Act reads as under;<\/p>\n<blockquote><p>      &#8220;30. Appeals &#8211; An appeal shall lie to the<br \/>\n      High court from the following orders of a<br \/>\n      Commissioner, namely:-\n<\/p><\/blockquote>\n<blockquote><p>      (a) an order as awarding as compensation as<br \/>\n      lump sum whether by way of redemption of a<br \/>\n      half-monthly payment or otherwise or<br \/>\n      disallowing a claim in full or in part for a<br \/>\n      lump sum;\n<\/p><\/blockquote>\n<blockquote><p>      [(aa)] an order awarding interest or penalty<br \/>\n      under Section 4A;]\n<\/p><\/blockquote>\n<blockquote><p>      (b) an order refusing to allow redemption of<br \/>\n      a half-monthly payment;\n<\/p><\/blockquote>\n<blockquote><p>      (c) an order providing for the distribution of<br \/>\n      compensation among the dependents of a<br \/>\n      deceased workman, or disallowing any claim<br \/>\n      of a person alleging himself to be such<br \/>\n      dependant;\n<\/p><\/blockquote>\n<blockquote><p>      (d) an order allowing or disallowing any<br \/>\n      claim for the amount of an indemnity under<br \/>\n      the provisions of sub-section (2) of Section<br \/>\n      12; or\n<\/p><\/blockquote>\n<blockquote><p>      (e) an order refusing to register a<br \/>\n      memorandum of agreement or registering<br \/>\n      the same or providing for the registration of<br \/>\n      the same subject to conditions:<br \/>\n      Provided that no appeal shall lie against any<br \/>\n      order unless a substantial question of law is<br \/>\n      involved in the appeal, and in the case of an<\/p>\n<p><span class=\"hidden_text\">FAO No.73\/2008                              Page 5 of 8<\/span><br \/>\n       order than an order such as is referred to in<br \/>\n      clause (b), unless the amount in dispute in<br \/>\n      the appeal is not less than three hundred<br \/>\n      rupees:\n<\/p><\/blockquote>\n<blockquote><p>      Provided further that no appeal shall lie in<br \/>\n      any case in which the parties have agreed to<br \/>\n      abide by the decision of the Commissioner,<br \/>\n      or in which the order of the Commissioner<br \/>\n      gives effect to an agreement come to by the<br \/>\n      parties:\n<\/p><\/blockquote>\n<blockquote><p>      [Provided further that no appeal by an<br \/>\n      employer under clause (a) shall lie unless the<br \/>\n      memorandum of appeal is accompanied by a<br \/>\n      certificate by the Commissioner to the effect<br \/>\n      that the appellant has deposited with him the<br \/>\n      amount payable under the order appealed<br \/>\n      against.]<br \/>\n      (2) The period of limitation for an appeal<br \/>\n      under this section shall be sixty days.<br \/>\n      (3) The provisions of section 5 of [the<br \/>\n      Limitation Act, 1963)], shall be applicable to<br \/>\n      appeals under this section.\n<\/p><\/blockquote>\n<p>13. According to third proviso to this Section, no<\/p>\n<p>appeal by an employer under clause (a) shall lie unless<\/p>\n<p>the memorandum of appeal is accompanied by a<\/p>\n<p>certificate by the Commissioner to the effect that the<\/p>\n<p>appellant has deposited with him the amount payable<\/p>\n<p>under the order appealed against.\n<\/p>\n<p><span class=\"hidden_text\">FAO No.73\/2008                              Page 6 of 8<\/span>\n<\/p>\n<p> 14. Admittedly, at the time of filing of appeal,<\/p>\n<p>appellant did not deposit the amount payable under<\/p>\n<p>order appealed against, and that is why, on 3rd March,<\/p>\n<p>2008, when appeal was taken up for hearing, appellant<\/p>\n<p>was directed to comply with Section 30 of the Act.<\/p>\n<p>15. More than one year and four months have passed,<\/p>\n<p>but appellant has not complied with the provisions of<\/p>\n<p>Section 30 of the Act, which are mandatory. As such,<\/p>\n<p>the case law cited by learned counsel for appellant is<\/p>\n<p>not at all applicable to the facts of present case. The<\/p>\n<p>appeal       challenging     the     impugned       order      of<\/p>\n<p>Commissioner, thus, is not maintainable and it is<\/p>\n<p>hereby, dismissed with costs of Rs.10,000\/-.<\/p>\n<p>16. Appellant is directed to deposit the costs within<\/p>\n<p>one month from today with Registrar General of this<\/p>\n<p>Court,     failing   which   it    shall   be   recovered,     in<\/p>\n<p>accordance with law.\n<\/p>\n<\/p>\n<p>17. The application stands allowed and appeal is<\/p>\n<p>dismissed, being not maintainable.<\/p>\n<p><span class=\"hidden_text\">FAO No.73\/2008                                   Page 7 of 8<\/span><br \/>\n +CM Nos.3132-33\/2008 in FAO No.73\/2008<br \/>\n*\n<\/p>\n<p>18.
