This appeal by the   against the
\nimpugned judgment;=fa11_d 2181 February
\n2005, passed- in  by the VI
\nAdditional  Claims Tribunal,<\/p>\n
Bangaldre  ‘Tribunal’ ) for<\/p>\n
enhan–ce1*nentlllC-f’-<:e1nperi'satiOn on the ground that, the<\/p>\n
compensatioia ef_  awarded in his favour as<\/p>\n
   clai'1'n..f0.r?O5.OO lakhs, is inadequate.<\/p>\n
    appellant claims to be aged about 32<\/p>\n
yeai's andlriwcirking as coolie, earning a sum. of ?3,000\/–<\/p>\n
 per He was hale and healthy prior to the date of<\/p>\n
l  aeeident. That at about 10:30 A.M., on 15-0e-2003,<\/p>\n
 when the appellant was standing by the side of A.V.<\/p>\n
Road and waiting for the bus, to return to his residence<\/p>\n

said road and dashed again._s"t~\u00bb..him,""as a.revsu'l.tV'of'which',"<\/p>\n
he fell down and sustainedgggrieiroiisoi inj1iries.. <\/p>\n
3. It is the   that he has
\nspent considierablegg   ‘_j ..  conveyance,
\nnourishing’  charges including
\n and”-vothei'”incidental expenses and
\nthereilorel. he   reasonably.\n<\/p>\n
_ 4. li’On” the injuries sustained in the<\/p>\n
  the ‘appellant \ufb01led the claim petition under<\/p>\n
  “of the Motor Vehicles Act, before the<\/p>\n
 compensation of a sum of ?O5.00<\/p>\n
 lakhs .against the respondents. The said claim petition<\/p>\n
hadrfcome up for consideration before the Tribunal on<\/p>\n
    let’ February 2005. The Tribunal, after considering the<\/p>\n
relevant material avaiEa%on file and after appreciation

of the oral and documentary evidence, aliowed the claim<\/p>\n
petition in part, awarding a sum of ?65,500\/ff-{with<\/p>\n
interest at 7% per annum from the date oil<\/p>\n

contributory negligence on the;\n<\/p>\n

 Awe are: of the View that, the Tribunal, after proper<\/p>\n
l’  ‘assessment of oral and documentary evidence available<\/p>\n
  at  file, has rightly fixed the contributory negligence on<\/p>\n
the part of the appella t at 10% and we uphold the
\nAM<\/p>\n
same. It is not in dispute that the appeilant was aged<\/p>\n
about 32 years at the time of accident and Was”<\/p>\n
as COOli\u20ac. The Tribunal has erred in as–ses,singi,ti1el’v,<\/p>\n
income of the appellant at ?i~,5O(‘)\/M <\/p>\n

income of the appellant  to meet

\nfracture to jtlie;  2 abdomen and

\nis stated’ that  “treatment for a total period<\/p>\n
of 9_daysl”i-nythe’,-Hospital. During this period, he must<\/p>\n
” V’  have 2,_spent reasonable amount towards conveyance,<\/p>\n
   i\u00bb.fo_’_od and attendant charges, apart i from<\/p>\n
rr1edicaI.e\u00a7gpenses. The Doctor has assessed disability<\/p>\n
 Atowards’ spine at 45%, and 22% towards whole body,<\/p>\n
  the Tribunal has rewassessed the Whoie body<\/p>\n
  V. ..,\/disability at 15%, which is just and proper and we<\/p>\n
accept the same. In V’ W of the said disability, the<\/p>\n

appellant, being aged only 32 years, has to pull on the
\nlife with this disability for the rest of his life and he<\/p>\n
cannot do the work as he was doing before,” Hiaying<\/p>\n

\nawarding a’  towards conveyance,<\/p>\n
nourishing. food’, andldattendant charges as against<\/p>\n

   taking the income of the appellant at<\/p>\n

part of the appellant. The  <\/p>\n
comes to ? 69,860\/- {i.e.\u00a7’l_.35,A35’0″\/- –  <\/p>\n
interest at 6% per annum,’ll\u00b01=o’t11 _theld-ate ‘of petition till
\nthe date of rea1ization._\u00a7”:\u00ab- ‘   l I  ‘V<\/p>\n
The Corporatvio.n,:’_  deposit the
\nenhanced” –, with interest
\nthereonvatv,6t%1’}_1ger  four weeks from the
\ndate judgment and award.\n<\/p>\n
 the Corporation, out of the<\/p>\n
enhanced compensation of ?69,860\/-, 50% of it with<\/p>\n
*;proportio1aa”te_’ interest shall be deposited in Fixed<\/p>\n
  Nationalised or Scheduled Bank, in the<\/p>\n
nanlcteoflxthe appellant, for a period of five years.<\/p>\n

The remaining 50% of the enhanced compensation <\/p>\n
