{"id":109203,"date":"2009-10-30T00:00:00","date_gmt":"2009-10-29T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/sachin-and-others-vs-state-of-haryana-and-another-on-30-october-2009"},"modified":"2015-04-09T18:15:34","modified_gmt":"2015-04-09T12:45:34","slug":"sachin-and-others-vs-state-of-haryana-and-another-on-30-october-2009","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/sachin-and-others-vs-state-of-haryana-and-another-on-30-october-2009","title":{"rendered":"Sachin And Others vs State Of Haryana And Another on 30 October, 2009"},"content":{"rendered":"<div class=\"docsource_main\">Punjab-Haryana High Court<\/div>\n<div class=\"doc_title\">Sachin And Others vs State Of Haryana And Another on 30 October, 2009<\/div>\n<pre>IN THE HIGH COURT OF PUNJAB AND HARYANA AT\nCHANDIGARH\n\n\n\n               CRM-M 25454 of 2009 (O&amp;M)\n               Decided on Oct 30,2009\n\n\n   Sachin and others                       --Petitioners\n\n                           Versus\n\n\n\n   State of Haryana and another           --Respondents<\/pre>\n<p>   CORAM: HON&#8217;BLE MR.JUSTICE RAKESH KUMAR JAIN<\/p>\n<p>   PRESENT: Mr.R.S.Mamli,Advocate,for the petitioners<\/p>\n<p>               Ms.Shalini Attri,AAG, Haryana.\n<\/p>\n<p>               Mr.Nirmal Mittal,Advocate, for the complainant.<\/p>\n<p>   Rakesh Kumar Jain, J: (Oral)<\/p>\n<p>               CRM 46114 of 2009<\/p>\n<p>               Allowed as prayed for.\n<\/p>\n<p>               CRM-M 25454 of 2009<\/p>\n<p>               This is a petition under Section 482 of the Code of<\/p>\n<p>   Criminal Procedure, 1973 (for short,&#8217;Cr.P.C.&#8217;) for quashing of FIR No.<\/p>\n<p>   192 dated 26.4.2009, registered under Sections 498-A, 406, 323,506<\/p>\n<p>   IPC at Police Station City Fatehabad, District Fatehabad, and all other<\/p>\n<p>   subsequent proceedings arising therefrom on the basis of a compromise<\/p>\n<p>   between the parties.\n<\/p>\n<p>               Learned counsel for the petitioner has submitted that the<\/p>\n<p>   FIR Annexure P-1 has been registered at the instance of Sweta,<br \/>\n       CRM-M 25454 of 2009 (O&amp;M)                        -2-\n<\/p>\n<p>daughter of Om Parkash.\n<\/p>\n<p>             During the course of hearing of CRM-M 16951 of 2009,<\/p>\n<p>which was filed by her husband       for grant of anticipatory bail, a<\/p>\n<p>compromise was entered into between the parties in terms of which,<\/p>\n<p>the petitioner had to pay Rs.5,00,000\/- (Five lakh) by way of demand<\/p>\n<p>draft towards full and final settlement which has been accepted by<\/p>\n<p>the complainant Sweta.\n<\/p>\n<p>              On 11.9.2009, notice of motion was issued for today and<\/p>\n<p>this case was ordered to be listed alongwith CRM-M 16951 of 2009.<\/p>\n<p>Pursuant to notice of motion, respondent No.2 has put in appearance<\/p>\n<p>through Mr. Nirmal Mittal,Advocate and has been identified by him.<\/p>\n<p>              In terms of the compromise which was struck between the<\/p>\n<p>parties,   the petitioner No.1\/husband Sachin has handed over two<\/p>\n<p>demand drafts dated 06.10.2009 of Rs. 1,00,000\/- each, two demand<\/p>\n<p>drafts dated 07.10.2009 of Rs. 1,00,000\/- each and one demand draft<\/p>\n<p>dated 8.10.2009 of Rs.1,00,000\/-personally to the complainant Sweta,<\/p>\n<p>drawn in her name.\n<\/p>\n<p>             After hearing the learned counsel for the parties and<\/p>\n<p>keeping in view the facts and circumstances of the case in which<\/p>\n<p>compromise has been effected between the parties, I feel that no useful<\/p>\n<p>purpose would be served to proceed with the present FIR, therefore, in<\/p>\n<p>view of the Full bench decision of this Court in the case of Kulwinder<\/p>\n<p>Singh and others Vs.
