JOSEPH FRANCIS, JJ.\n              - - - - - - - - - - - - - - - - - - - - - - - - - -\n                 W.P.(C).No. 11590 of 2010 R\n              - - - - - - - - - - - - - - - - - - - - - - - - - -\n              Dated this the ... day of April, 2010\n\n                             JUDGMENT\n<\/pre>\n<p>Joseph Francis, J.\n<\/p>\n<p>      This Writ Petition        under Articles 226 and 227 of the<\/p>\n<p>Constitution of India is filed with the following prayer:<\/p>\n<blockquote><p>             &#8221; to set aside the order dated 19.3.2010 of the<\/p>\n<p>       Family Court, Malappuram returning Ext.P1 filed<\/p>\n<p>       by the petitioners under Section 13 B of the Hindu<\/p>\n<p>       Marriage Act for non-production of Marriage<\/p>\n<p>       Certificate and direct the Family Court to receive<\/p>\n<p>       Ext.P1 on file and consider the same on merits.&#8221;<\/p><\/blockquote>\n<p>      2. Briefly the case of the petitioner is as follows. The<\/p>\n<p>petitioners belong to Thiyya Community and professing Hindu<\/p>\n<p>Religion. The marriage of the petitioners were solemnized on<\/p>\n<p>W.P.(C).No. 11590 of 2010<\/p>\n<p><span class=\"hidden_text\">                                     2<\/span><\/p>\n<p>31.10.2008 as per the customs prevalent among members of Thiyya<\/p>\n<p>community of Hindu Religion.          The petitioners have decided to<\/p>\n<p>dissolve their marriage mutually under Section 13B of the Hindu<\/p>\n<p>Marriage Act. Accordingly, the petitioners submitted a petition dated<\/p>\n<p>16.3.2010 before the Family Court, Malappuram for divorce on mutual<\/p>\n<p>consent under Section 13B of the Hindu Marriage Act. Along with the<\/p>\n<p>said petition, the petitioners also submitted a petition dated 16.3.2010<\/p>\n<p>to dispense with the stipulation of 6 months period from presentation<\/p>\n<p>of the petition under Section 13B of Hindu Marriage, for granting of<\/p>\n<p>mutual divorce.\n<\/p>\n<p>      3. It is submitted that the Family Court has returned Ext.P1<\/p>\n<p>petition stating that Registration of marriage is compulsory        after<\/p>\n<p>28.2.2008 and directed the petitioners to produce          the marriage<\/p>\n<p>registration certificate. Ext.P1 is the true copy of the petition dated<\/p>\n<p>16.3.2010 filed by the petitioners under Section 13B of the Hindu<\/p>\n<p>Marriage Act before the Family Court, Malappuram, along with the<\/p>\n<p>W.P.(C).No. 11590 of 2010<\/p>\n<p><span class=\"hidden_text\">                                     3<\/span><\/p>\n<p>order of Family Court, Malappuram dated 19.3.2010. Ext.P2 is true<\/p>\n<p>copy of the petition filed by the petitioners dated 16.3.2010 to dispense<\/p>\n<p>with the waiting period of 6 months. Aggrieved by the order of the<\/p>\n<p>Family Court the petitioners filed this Writ Petition.<\/p>\n<p>      4. We heard the learned counsel for the petitioners and the<\/p>\n<p>learned Government Pleader.\n<\/p>\n<p>      5. The learned counsel for the petitioners raised the following<\/p>\n<p>contentions. The Family Court has no power or authority to return the<\/p>\n<p>petition under Section 13B filed by the husband and wife, whose<\/p>\n<p>marriage had been solemnized as per Hindu Customary law, stating<\/p>\n<p>that the marriage registration certificate was not produced when the<\/p>\n<p>petitioners filed the affidavit stating that they were married as per the<\/p>\n<p>Hindu Customary law and that their marriage had not been registered.<\/p>\n<p>The Kerala Registration of Marriages (Common) Rules, 2008 do not<\/p>\n<p>stipulate that the marriage should be registered as a condition precedent<\/p>\n<p>for making application under Section 13B of the Hindu Marriage Act.<\/p>\n<p>W.P.(C).No. 11590 of 2010<\/p>\n<p><span class=\"hidden_text\">                                   4<\/span><\/p>\n<p>      6. The petitioners are entitled to file affidavit to the effect that<\/p>\n<p>they were married as per Hindu Customary law in the absence of<\/p>\n<p>certified extract of Hindu Marriage Register. The marriage of the<\/p>\n<p>petitioners were complete and valid on solemnization of their marriage<\/p>\n<p>under the Hindu customary law and non-registration of the marriage<\/p>\n<p>of the petitioners will not make the marriage void and invalid.<\/p>\n<p>       7. There is no law or rule stipulating that the production of<\/p>\n<p>Marriage Certificate is compulsory to maintain a petition under Section<\/p>\n<p>13B of the Hindu Marriage Act. The returning of the petition filed by<\/p>\n<p>the petitioners for non-producing the marriage certificate is therefore<\/p>\n<p>without jurisdiction.\n<\/p>\n<p>       8. Learned counsel for the petitioners invited our attention to<\/p>\n<p>the decision reported in Anitha Marginic v. Annadurai (1992<\/p>\n<p>KLT 2 (Case No.2), in which it was held:\n<\/p>\n<p>W.P.(C).No. 11590 of 2010<\/p>\n<p><span class=\"hidden_text\">                                   5<\/span><\/p>\n<p>              &#8220;When the factum of marriage is disputed,<\/p>\n<p>        evidence regarding performance of           marriage<\/p>\n<p>        according to Hindu rites must be brought on record<\/p>\n<p>        to show that there had been a valid marriage. The<\/p>\n<p>        registration is not the sole proof of marriage in<\/p>\n<p>        order to become a valid marriage.&#8221;\n<\/p>\n<\/p>\n<p>      9. In the present case, the marriage between the petitioners is<\/p>\n<p>not disputed. Section 13B of the Hindu Marriage Act, 1955 was<\/p>\n<p>inserted   by Act 78 of 1976 and provides for divorce by mutual<\/p>\n<p>consent. In order to attract the provisions of this section, the spouses<\/p>\n<p>should have been living separately for a period of one year or more and<\/p>\n<p>must not have been able to live together and have mutually agreed that<\/p>\n<p>the marriage should be dissolved. If all the three ingredients of<\/p>\n<p>Section 13B are proved by the parties, divorce cannot be refused. In<\/p>\n<p>order that they must not hastily applied for divorce by mutual consent<\/p>\n<p>it is provided in sub section (2) that the parties may withdraw the<\/p>\n<p>W.P.(C).No. 11590 of 2010<\/p>\n<p><span class=\"hidden_text\">                                    6<\/span><\/p>\n<p>petition. If the parties have not withdrawn the petition, the Court may<\/p>\n<p>after six months and before 16 months pass a decree of divorce.<\/p>\n<p>Before doing so, the Court must be satisfied after hearing the parties<\/p>\n<p>and after making such enquiry as it thinks fit that a marriage has been<\/p>\n<p>solemnized and that the averments in the petition are true.<\/p>\n<p>      10. In the decision reported in       Padmakiran Rao v. B.<\/p>\n<p>Venkateramana Rao (1996 (2) H.L.R. 271) it was held that &#8216;hearing&#8217;<\/p>\n<p>does not necessarily mean that both the parties have to be examined.<\/p>\n<p>The word &#8216;hearing&#8217; is often used in a broad sense which need not<\/p>\n<p>always mean personal hearing. Where the husband             is living in<\/p>\n<p>U.S.A., evidence in the form of an affidavit on the husband&#8217;s side can<\/p>\n<p>be legitimately taken into account in view of Order 19 Rule 1 C.P.C.<\/p>\n<p>unless there are suspicious circumstances or any particular reason to<\/p>\n<p>think that the averments in the affidavit may not be true.<\/p>\n<p>      11.   Rule 4 of the Hindu Marriage        (Kerala)   Rules, 1963<\/p>\n<p>provides that every petition filed under the Hindu Marriage Act, 1955<\/p>\n<p>W.P.(C).No. 11590 of 2010<\/p>\n<p><span class=\"hidden_text\">                                    7<\/span><\/p>\n<p>shall be accompanied by a certified extract from the Hindu Marriage<\/p>\n<p>Register maintained under Section 8 of the Act and in the absence of<\/p>\n<p>the same an affidavit to that effect that the petitioner was married to<\/p>\n<p>respondent.\n<\/p>\n<p>      12. Kerala Registration of Marriages (Common) Rules, 2008<\/p>\n<p>came into force on 29.2.2008. Rule 6 of that Rules provides that all<\/p>\n<p>marriages solemnized in the State after the commencement of the Rules<\/p>\n<p>shall be registered irrespective of religion of parties. Rule 15 of that<\/p>\n<p>Rules reads as follows.\n<\/p>\n<\/p>\n<p>             Consequences of non-registration: After the<\/p>\n<p>       commencement of these Rules, the Government shall<\/p>\n<p>       not accept for any purpose, any certificate of marriage<\/p>\n<p>       issued by any authority other than those authorised<\/p>\n<p>       under these Rules or under any other statutory<\/p>\n<p>       provisions. However this provision is not applicable to<\/p>\n<p>W.P.(C).No. 11590 of 2010<\/p>\n<p><span class=\"hidden_text\">                                      8<\/span><\/p>\n<p>       the marriages solemnized before the commencement of<\/p>\n<p>       these Rules.\n<\/p>\n<\/p>\n<p>      13. There is no stipulation either in the Hindu Marriage Act or<\/p>\n<p>the rules framed there under that the petitioners in a petition under<\/p>\n<p>Section 13B of the Hindu Marriage Act should compulsorily produce<\/p>\n<p>the Marriage Certificate. There is no such stipulation in the Kerala<\/p>\n<p>Registration of Marriages (Common) Rules, 2008 also. It is submitted<\/p>\n<p>that Rule 3 of the Hindu Marriage (Kerala) Rules, 1955 framed by this<\/p>\n<p>Court stipulates that every petition filed under Hindu Marriage Act<\/p>\n<p>shall be accompanied by a certified extract from the Hindu Marriage<\/p>\n<p>Register maintained under Section 8 of the Act and in the absence of<\/p>\n<p>the same, an affidavit to the effect that the petitioner was married to the<\/p>\n<p>respondent. The said Rule does not stipulate that the production of<\/p>\n<p>marriage certificate is compulsory. The petitioners have filed affidavit<\/p>\n<p>to the effect that they were married as per Hindu customary law and<\/p>\n<p>W.P.(C).No. 11590 of 2010<\/p>\n<p><span class=\"hidden_text\">                                     9<\/span><\/p>\n<p>that the marriage is not registered. As such the Court below has no<\/p>\n<p>jurisdiction to insist for the marriage registration certificate as a pre-<\/p>\n<p>condition for entertaining the petition filed by the petitioners.<\/p>\n<p>      14. Accordingly this Writ Petition is allowed. We set aside the<\/p>\n<p>order dt. 19.3.2010 of the Family Court, Malappuram returning Ext.P1<\/p>\n<p>filed by the petitioners under Section 13B of Hindu Marriage Act for<\/p>\n<p>non-production of the marriage certificate and direct the Family Court<\/p>\n<p>to receive Ext.P1 on file and consider the same on merits and in<\/p>\n<p>accordance with law.\n<\/p>\n<\/p>\n<p>                                           (K.
