Justice M.C.HARI RANI\n\n Dated :26\/10\/2010\n\n O R D E R\n            K.M.JOSEPH &amp; M.C.HARI RANI, JJ.\n            -----------------------------------------------\n                   W.P.(C) No.32639 of 2010\n                   -----------------------------------\n         Dated this the 26th day of October 2010\n\n\n                         J U D G M E N T\n<\/pre>\n<p>     Petitioners have approached this Court seeking the<\/p>\n<p>following reliefs :-\n<\/p>\n<blockquote><p>     &#8220;i.   Issue a writ of mandamus or other writ or order<\/p>\n<p>     directing the respondents to act upon Ext.P1 to P4<\/p>\n<p>     ensuring law and order situation properly enabling the<\/p>\n<p>     voters to reach the polling station and to exercise where<\/p>\n<p>     votes peacefully without any obstruction of hindrance in<\/p>\n<p>     whatsoever manner.\n<\/p><\/blockquote>\n<blockquote><p>\n     ii.   Direct the respondents to deploy necessary police<\/p>\n<p>     officials giving adequate police protection to the voters,<\/p>\n<p>     candidate and authorized agents ensuring peaceful<\/p>\n<p>     conduct of the election in Ward No.1 to 14 of<\/p>\n<p>     Maruthonkara Grama Panchayath by acting upon Ext.P1<\/p>\n<p>     to P4.<\/p><\/blockquote>\n<p>     iii.  Direct the respondents 1 to 3 to allow necessary<\/p>\n<p>     video graph in and around the polling booths where the<\/p>\n<p>W.P.(C) No.32639 of 2010<\/p>\n<p><span class=\"hidden_text\">                               -: 2 :-<\/span><\/p>\n<p>     votes are being polled in connection with the election of<\/p>\n<p>     the petitioners as candidates in Ward No.1 to 14 in the<\/p>\n<p>     Maruthonkara      Grama   Panchayath    ensuring     that<\/p>\n<p>     impersonation and other election offences are not being<\/p>\n<p>     allowed to commit in whatsoever manner.&#8221;<\/p>\n<p>     2.    The case of the petitioners in brief as follows:-<\/p>\n<p>           Petitioners are candidates from Ward No.1 to 14<\/p>\n<p>of the G 17 Maruthonkara Grama Panchayath. From 2008<\/p>\n<p>onwards political rivalry exists in respect of Maruthonkara<\/p>\n<p>Service Co-operative Bank Ltd. in that area. It is stated that<\/p>\n<p>large scale violence and massive attacks were done at the<\/p>\n<p>instance of LDF against UDF persons from the very<\/p>\n<p>inception of the declaration of election and filing of<\/p>\n<p>nomination papers. They submit that for the last several<\/p>\n<p>years political rivalry exist in that area and hence the office<\/p>\n<p>bearers of the UDF alliance as well as the petitioners<\/p>\n<p>submitted Exts.P1 to P4 petitions before the authorities.<\/p>\n<p>     3.    We heard the learned counsel for the petitioners,<\/p>\n<p>the learned Standing Counsel appearing on behalf of the<\/p>\n<p>Respondent Nos.1, 2 &amp; 3 and the learned Government<\/p>\n<p>W.P.(C) No.32639 of 2010<\/p>\n<p><span class=\"hidden_text\">                            -: 3 :-<\/span><\/p>\n<p>Pleader on behalf of the Respondent Nos.4 to 7.<\/p>\n<p>     4.    The learned Standing Counsel appearing on<\/p>\n<p>behalf of the Commission submits that the State Election<\/p>\n<p>Commission has issued a proceedings dated 26.10.2010<\/p>\n<p>addressed to the Director General of Police to deploy police<\/p>\n<p>force in that area and to see that the District Collector takes<\/p>\n<p>steps for arranging of videography. The learned Standing<\/p>\n<p>Counsel would also submit that as far as the request for<\/p>\n<p>videography made by the petitioners is concerned, that will<\/p>\n<p>be allowed. [Ofcourse, the petitioners will have to meet the<\/p>\n<p>expense of the videography.]<\/p>\n<p>     5.    The learned Government Pleader would submit<\/p>\n<p>that, the request of the Commissioner will be complied with<\/p>\n<p>and sufficient police force will be deployed so that the<\/p>\n<p>election is held in a safe and fair manner. The learned<\/p>\n<p>Government Pleader would also submit that there will be<\/p>\n<p>general police patrolling done so as to ensure that the<\/p>\n<p>polling is conducted in a smooth manner.<\/p>\n<p>W.P.(C) No.32639 of 2010<\/p>\n<p><span class=\"hidden_text\">                            -: 4 :-<\/span><\/p>\n<p>           We record these submissions and dispose of this<\/p>\n<p>writ petition in the above manner.
