He approached this court<\/p>\n<p>aggrieved by the refusal on the part of the respondent to<\/p>\n<p>permit him to participate in the tender. Due to the alleged<\/p>\n<p>deficiency in the earnest money deposit, the tender was<\/p>\n<p>rejected.   The learned single Judge dismissed the writ<\/p>\n<p>petition and hence the writ appeal. When the matter was<\/p>\n<p>pending before us, we had directed the first respondent to<\/p>\n<p>get instruction as to what is the present situation. It is<\/p>\n<p>informed that since the tender of the writ petitioner was<\/p>\n<p>rejected in view of the huge price difference, the first<\/p>\n<p>respondent verified whether the nearest lower tenderers<\/p>\n<p>were prepared to match the price offered by the writ<\/p>\n<p>petitioner.  Since they were not prepared to match the<\/p>\n<p>W.A.No.1303 of 2009<\/p>\n<p><span class=\"hidden_text\">                                -:2:-<\/span><\/p>\n<p>price, it is submitted that the first respondent has now<\/p>\n<p>decided to initiate retender proceedings in respect of 14 items<\/p>\n<p>quoted by the writ petitioner. It is also submitted that since<\/p>\n<p>the writ petitioner is not otherwise disqualified he can also<\/p>\n<p>participate in the retender proceedings. In that view of the<\/p>\n<p>matter we dispose of the writ appeal with liberty to the writ<\/p>\n<p>petitioner to participate in the retender proceedings.
