The petitioner  b\u00e9f\u00e9ge the<\/p>\n
trial Court. It is all_e.-yeti accused, a<\/p>\n
person:’.._Abelc>ngjir-\u00a33-.Alto’4″i’rsia’i–du’ community, obtained a
\nczertificate “from tlhecill\ufb01ehsildar, Bangalore north<\/p>\n
as belonging lAdi- Dravida caste for securing a<\/p>\n
  the government. He submitted an<\/p>\n
I  13.7.1978 for the post of the<\/p>\n
Security~~Guu..aArd in the ITI company, wherein the<\/p>\n
3”-w___V’posts “we_re to be filled up in accordance with the<\/p>\n
  “r_eVse’riA’atic\u00bbn. It is alleged that though the<\/p>\n
ix”..__\ufb01”‘acl\u20ac;used belonged to Naidu community, obtained a<\/p>\n
u\ufb02certificate to the effect that he belonged to<\/p>\n
Adiw\ufb01ravida and as there was a post reserved for<\/p>\n
K<\/p>\n
On appreciation of the material on record,<\/p>\n
the trial Court convicted the accused for. the<\/p>\n
above said offences and sentenced him t\u00e9 undergo _<\/p>\n
imprisonment for two years for each. ef _the\ufb01_”<\/p>\n
offences and ordered the” Sentence =rto;_ runj<\/p>\n
concurrently. Aggrievedp by dthe, conuictidn Band >,<\/p>\n

5. It is the contention of the learned
\ncounsel for the petitioner that there is no
\nevidence that the certificate given by hinV is<\/p>\n
either forged or false and that the;enii\u00a7ufnou&<\/p>\n
question of cheating. In the circumstanoea;ihef’i-<\/p>\n
submits that the conviction and sentence ereereo\ufb01<\/p>\n
by the Courts below are illegal and perver3e.”i<\/p>\n

in, helongEto_Seheduled Caste community and that he<\/p>\n
Ain’9aoApereonjwbelonging to Naidu community and<\/p>\n
reeuested i\u00a7W.1 to make an enquiry and to take<\/p>\n
Z”*_ appropriate action, as the certificate produced<\/p>\n
V”\u00ab. \ufb02y _the accused as belonging to Adi–Karnataka<\/p>\n
i”aiicante is a false certificate. He verified and<\/p>\n
ijfound that accused had given such a certificate<\/p>\n
and thereafter he submitted a report to the’<\/p>\n
Deputy Inspector General of police under Ex.P.3.<\/p>\n
is\/\\t<\/p>\n
the caste of the accused has been shown as Hlndu\n<\/p>\n
— Naidu. So, the perusal of the dooueeata
\nreferred to above and Exs.P.24, 25 and \u00e9\u00e9 \u00a7\u00a7\u00a7aa: I
\nthat the accused belongs to Nalou commue\u00a3ty{: So; ”<\/p>\n
thereafter he looked into 3*’-‘;:..ts>,.f7o_’.nfiv in’:’.y&h14\u00a2:i~:g._;r;;;rT<\/p>\n
caste has been shown as ,a person beloaoahgg to  \u00b0<\/p>\n
Adi~Bravida i.e., Scheduled: caste =oomeuolty- and
\nafter collecting all;_theaet:oocamentaFh eroduced
\nthem before the police oarihorthe”lgrestigation.\n<\/p>\n
9. pw,4 la the eetir\u00e9o teacher, Sevashrama
\nHigh schoo\ufb02issued Ex.P.1′?, the
\nadmission ehtract, ih=ehlch it was revealed that
\nthe aoouaed   z\u00e9aidu community and he<\/p>\n
also speak; about the oroduction of Ex.P.l4, 15<\/p>\n
_V and j17u.to VP\ufb02;3. : P.5 is also the retired<\/p>\n
;?V teacher}: Qherein he states that when he was<\/p>\n
‘Aw\u00ab.\u00a7rk’:;igV-:”:’as;’_ af.~:teacher in Sevashrama high school<\/p>\n
the v\ufb01oiice ‘have showed him the extract of the<\/p>\n
1h”ahadiasioa register of the school and the register<\/p>\n
h\u00ab.”revealed that the accused belongs to Naidu<\/p>\n
‘”\u00bb\ufb01fcommunity. The extract has been produced at<\/p>\n
‘tvEx.P.19. PW.6 is the ASI, who registered the<\/p>\n
complaint in Crime No.22i88 and sent the sai\u00e9<\/p>\n
complaint – Ex.P.20 to the Magistrate along with<\/p>\n
0\/more<\/p>\n

\nFIR. Furthermore, PW.7 is the retired Dy.5.P who<\/p>\n
has recorded the statement of these witnesses.\n<\/p>\n
10. From this evidence the prosecution<\/p>\n
intends to establish that the accused ‘has<\/p>\n
committed an offence UfS 198, 419 and 42% ef the .<\/p>\n
IPC. It is relevant to note that in the transfers<\/p>\n
certificate at Ex.P.22, the religion, o\u00a7,itheh<\/p>\n
accused has been shown as Hindus and ;;n- colnmni’<\/p>\n
No.9 as to whether the candidate belongs to SC or
\nST, the blank is filled in mentioning as ‘haidu’.
\nThe cumulative record *” .\ufb01\u00a7iP.i3″ has also been<\/p>\n
produced which’ reve\u00e9l” that ,the lceste of the<\/p>\n
accused. has. heeniishcy\ufb01~ as Hindu (A.D) to mean
\nAdi–Dravida.t_ i’_\ufb01n,P;\u00a7~’ is the copy of the<\/p>\n
app3,i}:cstAion “f’i_vi:ed for the post in which the<\/p>\n
;V_ accnsed has stated that he belongs to Adi–Dravida<\/p>\n
Acaste.~ Eg.\u00a7L5 is the caste certificate which is<\/p>\n
it” siened by the Tahsildar, Bangalore North taluk,<\/p>\n
3″”g in which it is certified that the accused beiongs<\/p>\n
i’\u00bb to Adi–Dravida caste. Ex.?.6 is the form which<\/p>\n
‘\u00b0\u00bb\ufb01fa1so contains the caste as Adi-Dravida and Ex.P.7<\/p>\n
i=is the affidavit sworn by the accused stating<\/p>\n
that he belongs to Adi*Dravida M SC community.\u00a7%i:\\<\/p>\n
I1<\/p>\n
signature said to have been forged. If a charge
\nof forgery has to be proved, it is necessary for<\/p>\n
the investigating agency or the prosecutionf1teW.<\/p>\n
prove the diesimilarities in the _ei\u00a7netere_ by5_f*<\/p>\n
examining the expert and by eeneing the a\u00a7\u00a2gm\u00a7\ufb01g$\u00a7
\nto the opinion of the expert}: inc \u00a7\u00a7g\u00a7;.ef\ufb01\u00a7:%”
\nhas been made at all to :\u00a7rove ‘theta the hcaete<\/p>\n
certificate does net_ beer ‘the “signatnre~ of the<\/p>\n
Tahsildar. The reiiance;_en’ the} letter of the<\/p>\n
Tahsildar and ithe :\ufb01ep\ufb01\u00a7yfVC\u00a7m@iseiener, without<\/p>\n
examining ,~th\u00a2e f iehf’com\ufb01Ietei\u00a7$ illegal and<\/p>\n
imProPeF\ufb02.fyficK i iii if: V<\/p>\n
12\u00a2 _r\u00a7\u00a3\u00a3he\u00a3eo:e{i~_when the prosecution
\nclaims that the “eae\ufb01eg certificate is forged or<\/p>\n
fal3e;”it is necessary to examine the concerned<\/p>\n
iTaheiidar’ who ieened the certificate. It is<\/p>\n
ireleeantzto mete that whenever a certificate has<\/p>\n
to he issned by any person, who is authorised in<\/p>\n
f*\u00bb,*law td_iesue, he has to make verification and an<\/p>\n
7enqeiry and thereafter has to issue the<\/p>\n
f=_f\u00b0certificate. Leave apart that with regard to the<\/p>\n
u”.enquiry or verification the prosecution has not<\/p>\n
at all examined the Tahsildar who says that his<\/p>\n
signature has been forged. In the circumstances,<\/p>\n

the perusal of the evidence at PWs.1 to 33 does
\nnot reveal anything as regards the fdrged<\/p>\n
signatures.\n<\/p>\n
13. New coming to the questi&\u00a7 ga?llt5lu<\/p>\n
whether the accused has. ~given tiara false,<\/p>\n
certificate, he states that the\ufb01 belongs’ toia\ufb01di\u00e9e.<\/p>\n
Dravida community and it\ufb01g Cu\ufb01ul3tiVee”recerd =l<\/p>\n
produced at Ex.P.18, in the ceiuen efsrelieion at
\npage 2 of the said abeueentg it is stated Hindu
\n(AD). Though, it is,statee ey tee witnesses that
\nthe word ‘A\ufb02’ is net efitge\ufb01 ty them, that much<\/p>\n
of material rts\u00e9if is iesuffieient to prove that<\/p>\n
there is an ih$erti6n;~_’Furthermore, Ex.\ufb02.1 and
\nD.2 are the=do\u00e9ument\u00a7”preduced by the accused and<\/p>\n
perusal_ef these deeuments reveal that Ex.D.1 is<\/p>\n
it \ufb02the eg\ufb01gegt pf the register of birth during the<\/p>\n
imenth’of2Se\ufb01tember 1954. The name of the father<\/p>\n
of the ace\ufb01sed has been written as Nmniswamy and<\/p>\n
i*u_*the name of the mother has been written as<\/p>\n
“hajaeea. In the column regarding the caste, it<\/p>\n
i*rliis;mentioned as ‘AD’ to mean Adi-Dravida. Ex.D.2<\/p>\n
i*.:s the certificate issued by the Administrative<\/p>\n
officer of the Gram panchayath, wherein it is<\/p>\n
stated that the father of the accused as<\/p>\n
K<\/p>\n

Muniswamy and mother as Thayamma, who are the
\npersons belonging to Scheduled caste community.
\nThe comparison of \u00a333. B1 and D2 reveaia:hthe~u
\nchange in the name of the mother of the accnaedi\ufb02
\nEx.D.1, contains the name gaf~.th\u00a7”\ufb02\u00a7\u00a7{5\u00a7goja5_
\nRajamma. Ex.B.2 containa the nape as \u00a7ha\u00a7aa\u00a7a;t
\nOn the basis of this itseif, ithevgtriai”*Cohrt
\nrejected the version of the accused. ..in<\/p>\n
14. It is relevant to note that the accused
\nstates that his father ehiieradnitting him to the
\nschool to _o\u00a7er\u00a75\u00a2ei the Vhneiiiation stated the
\ncaste as \u20acfNai\u00a7n5K’enaf there} is no reason to
\ndisbelieeeiAthiggiaitferenoeiwalso. The documents
\nissued ty the ecncationat authorities are not the<\/p>\n
documents to rai\u00e9e Conclusive proof of caste of a<\/p>\n
h’aperaoh.,: The V investigating agency has not<\/p>\n
“,ap\u00a7:eacn\u00e9a the authorities concerned who make the<\/p>\n
entries Aof: birth and death to find out as to<\/p>\n
‘ whether ,the accused belongs to Scheduled caste<\/p>\n
xtigcommanity or Naidu community. In the absence of<\/p>\n
_j,anye such investigation, the mere production of<\/p>\n
~ ‘the documents and getting them marked itself is<\/p>\n
” not sufficient to prove the guilt of the accused.<\/p>\n
