SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 05\/09\/2008 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>RULE.\n<\/p>\n<p>\tMs.Falguni Patel, learned Additional Public Prosecutor waives the<br \/>\n\tservice of notice of rule for the respondent -State.\n<\/p>\n<p>Present<br \/>\n\t petition is filed by the petitioner ?  original accused No.2 for<br \/>\n\tan appropriate order to release the Passport  of  the   petitioner<br \/>\n\tbearing   registration   No.A-4217459  and permit the petitioner to<br \/>\n\tgo United State of America to attend her daughter, who according to<br \/>\n\tthe petitioner is not keeping good health.\n<\/p>\n<p>In<br \/>\n\tsupport of ill-health of the daughter, the petitioner  has relied<br \/>\n\tupon one communication produced at Annexure-B.\n<\/p>\n<p>Ms.Jayshree<br \/>\n\tBhat, learned advocate appearing on behalf of the petitioner has<br \/>\n\theavily relied upon the decision of the Hon&#8217;ble Supreme Court<br \/>\n\trendered in  Criminal Appeal  No.179 of 2008 in the case of Suresh<br \/>\n\tNanda Vs. C.B.I.  dtd.24\/1\/2008, reported in 2008 Criminal<br \/>\n\tLaw Journal 1599   in support of her submission  that such a<br \/>\n\tcondition  directing to surrender the Passport, cannot be imposed,<br \/>\n\tas the powers to impound the passport are only with the passport<br \/>\n\tauthority.\n<\/p>\n<p>Ms.Falguni<br \/>\n\tPatel, learned Additional Public Prosecutor while opposing the<br \/>\n\tpresent petition has submitted  that as such on the basis of<br \/>\n\tcommunication at Annexure-B, the petitioner cannot be permitted to<br \/>\n\tgo to  U.S.A. It is submitted that even from the communication at<br \/>\n\tAnnexure-B, it appears that the Doctors are taking care.  It is<br \/>\n\tfurther submitted that even the wife of the petitioner  can also go<br \/>\n\tto USA to attend the daughter and it is not that the only petitioner<br \/>\n\tcan be helpful to his daughter in U.S.A. It is also further<br \/>\n\tsubmitted that the decision of the Hon&#8217;ble Supreme Court in the case<br \/>\n\tof Suresh Nanda (supra) will not be applicable to the facts of the<br \/>\n\tpresent case, as in the said case before the Hon&#8217;ble Supreme Court,<br \/>\n\tpassport was seized by the C.B.I. during the course of investigation<br \/>\n\tand in that connection the Hon&#8217;ble Supreme Court was considering the<br \/>\n\tissue whether investigating officer has any power  to seize passport<br \/>\n\tas muddamal or not and considering the facts of the said case, the<br \/>\n\tHon&#8217;ble Supreme Court in the said decision has observed  that the<br \/>\n\tinvestigating officer has no authority to seize passport and the<br \/>\n\tsaid powers are only  vest with the passport authority. It is<br \/>\n\tsubmitted that the said decision would not be applicable in a case<br \/>\n\twhere the accused is released on bail on certain conditions and one<br \/>\n\tof the condition is that the accused shall not leave India and<br \/>\n\ttherefore, the accused has to surrender passport. It is submitted<br \/>\n\tthat the said decision is not with respect to the powers of the<br \/>\n\tcourt to impose condition while granting bail. Submitting<br \/>\n\taccordingly, it is requested to dismiss the present petition.\n<\/p>\n<p>Heard<br \/>\n\tthe learned advocate appearing on behalf of the respective parties.\n<\/p>\n<p>At<br \/>\n\tthe outset, it is required to be noted that the next date of hearing<br \/>\n\tof the trial is 10\/11\/2008 and the petitioner  is released on bail<br \/>\n\tby the learned Single Judge of this Court in connection with the<br \/>\n\tcomplaint being CR No.209 of 1997 for the offences punishable under<br \/>\n\tsecs.467, 468, 419, 120B and 34 of Indian Penal Code  and one of the<br \/>\n\tconditions of the bail order initially was  that he shall not leave<br \/>\n\tGandhingar District without permission of the trial court except for<br \/>\n\tthe purpose of attending the Court and the said condition<br \/>\n\tsubsequently came to be deleted by the learned Single Judge.<br \/>\n\tHowever, the petitioner was directed to deposit passport before the<br \/>\n\ttrial court and accordingly, the petitioner has surrendered the<br \/>\n\tPassport. Now, therefore, the aforesaid condition is imposed by the<br \/>\n\tlearned Single Judge while releasing the petitioner on bail.<br \/>\n\tLearned advocate appearing on behalf of the  petitioner has heavily<br \/>\n\trelied upon the decision of the Hon&#8217;ble Supreme Court in the case of<br \/>\n\tSuresh Nanda (supra). However, considering the  decision of the<br \/>\n\tHon&#8217;ble Supreme Court  of Suresh Nanda (supra), it appears that the<br \/>\n\tcontroversy\/issue before the Hon&#8217;ble Supreme Court  in the said case<br \/>\n\twas whether investigating officer has any power to seize passport<br \/>\n\tduring the investigation and there was no controversy and\/or dispute<br \/>\n\tbefore the Hon&#8217;ble Supreme Court  that whether a competent court<br \/>\n\twhile releasing an accused on bail, has power to impose condition to<br \/>\n\tdeposit passport  or not. Considering the provisions of the Passport<br \/>\n\tAct and Code of Criminal<br \/>\n\tProcedure, the Hon&#8217;ble Supreme Court observed that the<br \/>\n\tinvestigating officer has no jurisdiction and\/or authority to seize<br \/>\n\tpassport, as seizing of passport would be impounding the Passport<br \/>\n\tand those  powers are only with the Passport Authority.   As stated<br \/>\n\tabove, the decision of the Hon&#8217;ble Supreme Court  in the case of<br \/>\n\tSuresh Nanda (supra) is not dealing with the powers of the court to<br \/>\n\trelease an accused on one of the condition that the accused shall<br \/>\n\tnot leave India without  prior permission and the accused shall<br \/>\n\tsurrender passport  with the trial court.  Powers of the court to<br \/>\n\timpose condition  of not to leave India and surrender passport,<br \/>\n\twhile releasing accused on bail, are not affected by the aforesaid<br \/>\n\tdecision and the same was not even the issue before the Hon&#8217;ble<br \/>\n\tSupreme Court.   The Hon&#8217;ble Supreme Court in para 17 of the<br \/>\n\taforesaid decision in the case of Suresh Nanda (supra), has made it<br \/>\n\tclear that the Hon&#8217;ble Supreme Court has not decided whether the<br \/>\n\tPassport can be impounded  as a condition for grant of bail or not.<br \/>\n\tThe said decision would not be applicable to the facts of the<br \/>\n\tpresent case, as in the present case, the passport is not seized by<br \/>\n\tthe investigating officer, but learned Single Judge of this Court,<br \/>\n\twhile releasing the petitioner on bail, has directed the petitioner<br \/>\n\tto surrender the passport.\n<\/p>\n<p>Even<br \/>\n\ton merits also, no case is made out  for releasing the passport of<br \/>\n\tthe petitioner. No supporting medical evidence with respect to the<br \/>\n\tailment of the daughter  is produced on record. Further the wife of<br \/>\n\tthe petitioner can very well attend her daughter, who according to<br \/>\n\tthe petitioner is sick in USA.\n<\/p>\n<p>Under<br \/>\n\tthe circumstances,  the petition is required to be dismissed. In the<br \/>\n\tfacts and circumstances of the case when the trial is of the year<br \/>\n\t1997 and next date of trial is 10\/11\/2008 and even when it is<br \/>\n\treported that some of the witnesses have also been examined, the<br \/>\n\tends of justice would be met if appropriate directions for early<br \/>\n\tdisposal of the trial  are issued.\n<\/p>\n<p>For<br \/>\n\tthe reasons stated above, the petition deserves to be dismissed and<br \/>\n\tis accordingly dismissed. Rule is discharged.
