Justice K.HEMA\n\n Dated :20\/11\/2008\n\n O R D E R\n                               K.HEMA, J.\n                    ---------------------------------------------\n                           B.A.No.6935 of 2008\n                    ---------------------------------------------\n                 Dated this the 20th November, 2008\n\n\n                                  O R D E R\n<\/pre>\n<p>       This petition is for bail.\n<\/p>\n<p>       2.    The alleged offence is under Section 55(a)(b)(i) of<\/p>\n<p>Kerala Abkari Act. According to prosecution, on 16.10.2008, at<\/p>\n<p>about 7.30 a.m., petitioners (A1 to A4) were found in possession<\/p>\n<p>of 175 litres of illicit toddy and saccharine used for manufacture<\/p>\n<p>of illicit toddy. They were also found engaged in manufacture of<\/p>\n<p>illicit toddy for the purpose of sale.<\/p>\n<p>       3.    Petitioners were arrested on 16.10.2008 and they are<\/p>\n<p>in custody since then. Learned public prosecutor submitted that<\/p>\n<p>he has no objection in granting bail, but, stringent conditions<\/p>\n<p>may be imposed. It is also pointed out that the fourth accused is<\/p>\n<p>a native of Tamil Nadu. Hence, local sureties may be insisted<\/p>\n<p>while granting bail.\n<\/p>\n<p>       On hearing both sides, I find that bail can be granted to the<\/p>\n<p>petitioners on stringent conditions.<\/p>\n<p>       Hence, the following order is passed:<\/p>\n<p>         (i) Petitioners shall execute bond for Rs.25,000\/- each<\/p>\n<p>             with two solvent sureties each (sureties shall be local<\/p>\n<p><span class=\"hidden_text\">BA No.6935 \/2008                   2<\/span><\/p>\n<p>            sureties) for the like sum to the satisfaction of the<\/p>\n<p>            Magistrate   Court      concerned   on    the  following<\/p>\n<p>            conditions:\n<\/p>\n<blockquote><p>                 (ii)  Petitioners     shall  report    before  the<\/p>\n<p>                       Investigating Officer on every Monday,<\/p>\n<p>                       Wednesday and Saturday between 10 a.m.<\/p>\n<p>                       and 1 p.m. until further orders.<\/p>\n<\/blockquote>\n<blockquote><p>                 (iii) Petitioners shall not leave the limits of the<\/p>\n<p>                       police station within which crime is<\/p>\n<p>                       registered except with prior permission of<\/p>\n<p>                       the learned Magistrate.\n<\/p><\/blockquote>\n<blockquote><p>                (iv)   Petitioners shall not influence or intimidate<\/p>\n<p>                       any witness or commit any offence while on<\/p>\n<p>                       bail and in case of breach of this condition,<\/p>\n<p>                       bail is liable to be cancelled.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<p>    The petition is allowed.\n<\/p>\n<\/p>\n<p>                                                  K.HEMA, JUDGE<br \/>\ncsl<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Biji vs State Of Kerala Represented By on 20 November, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 6935 of 2008() 1.
