It is the case of the petitioner<br \/>\nthat said Abdul Rasid was born on 18.06.1954 at Dhandhuka but,<br \/>\ninadvertently, his birth date was entered as 21.06.1954 in the<br \/>\nRegister maintained under the Act.\n<\/p>\n<p>3.\tThe<br \/>\npetitioner had, therefore, made an application u\/s.13(3) of the Act<br \/>\nbefore the trial Court requesting to correct the birth date, as<br \/>\nentered in the Register. However, the said application came to be<br \/>\nrejected by the trial Court by impugned order dated 22.09.2009.<br \/>\nHence, this petition.\n<\/p>\n<p>4.\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record. It is a settled law that for carrying out correction of<br \/>\ndate of birth or place of birth or name, powers have been conferred<br \/>\nunder the Act on the Registrar as well as the Judicial Magistrate,<br \/>\nFirst Class, as the case may be, when the correction is sought to be<br \/>\nmade in the school record. Such principle has also been laid down in<br \/>\na recent decision of this Court rendered in the case of Regional<br \/>\nPassport Officer v. Kokilaben, w\/o. Jaswantlal Panchal &amp; Ors.,<br \/>\n2009(2) G.L.H. 1246.\n<\/p>\n<p>5.\tIn<br \/>\nthe case on hand, the trial Court has refused to entertain the<br \/>\napplication preferred by the petitioner mainly on the ground of<br \/>\njurisdiction. As stated herein above, under the provisions of the<br \/>\nGujarat Registration of Births &amp; Deaths Act and the Rules framed<br \/>\nthereunder, the learned J.M.F.C. or the Registrar, as the case may<br \/>\nbe, has jurisdiction to carry out necessary correction in the<br \/>\nRegister of Births &amp; Deaths. Hence, the trial Court has committed<br \/>\nan error in rejecting the application of the petitioner.\n<\/p>\n<p>6.\tConsequently,<br \/>\nthe petition is allowed. The impugned order passed by the learned<br \/>\nJ.M.F.C., Dhandhuka in Application No.40\/2009 dated 22.09.2009 is<br \/>\nquashed and set aside. The learned J.M.F.C. concerned is directed to<br \/>\nhold an enquiry on the application made by the applicant for change<br \/>\nof birth date in the Register of Births. The petitioner shall be<br \/>\ngiven a notice by the learned J.M.F.C. concerned for appearance<br \/>\nbefore them, with all documentary and oral evidence, to substantiate<br \/>\nhis claim for change of date of birth in the Register of Births. Let<br \/>\nthe learned J.M.F.C. complete the enquiry within a reasonable period<br \/>\nof four weeks from the date of service on them of a copy of this<br \/>\njudgment and pass consequential orders of granting change in the<br \/>\nentry regarding date of birth in the Register of Births and issue a<br \/>\nCertificate on the said entry to the petitioner, if the petitioner is<br \/>\nable to substantiate his claim before it.\n<\/p>\n<p>7.\tWith<br \/>\nthe above observations, the petition stands disposed of. Rule is made<br \/>\nabsolute to the above extent with no order as to costs.
