MUKHOPADHAYA)<\/p>\n<p>\tThis<br \/>\nappeal has been preferred by the appellant   borrower against the<br \/>\norder dated 24.2.2010 passed by the learned Single Judge in Special<br \/>\nCivil Application No. 12543 of 2009.  By the said order, the learned<br \/>\nSingle Judge dismissed the writ petition which was preferred against<br \/>\nthe order for recovery of the dues of Dena Bank (hereinafter referred<br \/>\nto as  the respondent   bank ) under Section 165 of the Bombay<br \/>\nLand Revenue Code, 1879 read with Rule 129 of the Land Revenue Rules.\n<\/p>\n<p>2.\tThe<br \/>\nlearned Single Judge held that the appellant   borrower is not<br \/>\nentitled for waiver and dismissed the petition, but has not decided<br \/>\nthe question whether the bank&#8217;s dues can be recovered under Section<br \/>\n165 of the Bombay Land Revenue Code, 1879.\n<\/p>\n<p>3.\tAs<br \/>\nnoticed above, the learned counsel for the appellant has taken a plea<br \/>\nthat the bank had no jurisdiction to take measures for recovering the<br \/>\ndues under Section 165 of the Bombay Land Revenue Code.  It is<br \/>\ncontended that the agricultural loan was taken by the appellant from<br \/>\nthe bank pursuant to a scheme floated by NABARD and, therefore, the<br \/>\nbank cannot recover the dues under the Code aforesaid.\n<\/p>\n<p>4.\tThe<br \/>\nlearned counsel for the bank relied on Section 15 of the Gujarat<br \/>\nAgricultural (Provision of Facilities) Act, 1979 (Gujarat Act No. 19<br \/>\nof 1979)  [hereinafter referred to as  the Gujarat Agricultural<br \/>\nCredit Act, 1979 ] and Section 3(2) of the Gujarat Public Moneys<br \/>\n(Recovery of Dues) Act, 1979 (Gujarat Act No. 17 of 1979)<br \/>\n[hereinafter referred to as  the Gujarat Public Moneys Act, 1979  ]<br \/>\nand submitted that the recovery of dues of the bank can be made as<br \/>\narrears of land revenue and, therefore, such recovery can be made<br \/>\nunder Section 165 of the Bombay Land Revenue Code.  However, such<br \/>\nsubmission cannot be accepted for the reasons mentioned hereunder.\n<\/p>\n<p>\tSection<br \/>\n15 of the the Gujarat Agricultural Credit Act, 1979 deals with<br \/>\nrecovery of dues in respect of financial assistance to carry out<br \/>\nState sponsored scheme as arrears of land revenue and reads as under<br \/>\n:-\n<\/p>\n<p> 15.\tRecovery<br \/>\nof dues in respect of financial assistance to carry out<br \/>\nState-sponsored Scheme as arrears of land revenue. &#8211; Notwithstanding<br \/>\nanything contained in the foregoing provisions of this Chapter, the<br \/>\nState Government, by an order published in the Official Gazette,<br \/>\ndirect that any amount due from the agriculturist towards financial<br \/>\nassistance given to him by the bank for the purpose of carrying out<br \/>\nany State-sponsored scheme may be recovered on behalf of such bank as<br \/>\nan arrear of land revenue.  Any amount so recovered on behalf of the<br \/>\nbank shall be paid over to the bank after deducting such portion<br \/>\nthereof as cost of collection as the Collector may determine to be<br \/>\nreasonable.\n<\/p>\n<p>\tIt<br \/>\nis true that the respondent   bank comes within the definition of<br \/>\n bank  under Section 3(d) of the the Gujarat Agricultural Credit<br \/>\nAct, 1979 ,  However, in the present case, we find that neither the<br \/>\nloan having given out of any State-sponsored scheme nor the State<br \/>\nGovernment has published any notification in the official gazette<br \/>\ndirecting recovery of the agricultural dues of the respondent<br \/>\nbank for the purpose of carrying out any State-sponsored scheme.\n<\/p>\n<p>5.\tWe<br \/>\nhave noticed Section 2(l) of the Gujarat Public Moneys Act, 1979<br \/>\nwherein the  State-sponsored scheme  has been defined which means<br \/>\na scheme sponsored or adopted by the State Government or an officer<br \/>\nauthorized by it in this behalf for development of agriculture or<br \/>\nindustry and notified as such by the State Government or the<br \/>\nauthorized officer, by a notification in the Official Gazette, for<br \/>\nthe purposes of the said Act.  Therefore, the respondent bank cannot<br \/>\nderive the advantage of Section 15 of the Gujarat Agricultural Credit<br \/>\nAct, 1979.\n<\/p>\n<p>6.\tSo<br \/>\nfar as Section 3(2) of the Gujarat Public Moneys Act, 1979 is<br \/>\nconcerned, the said provision is also not applicable in the present<br \/>\ncase.\n<\/p>\n<p>\tSection<br \/>\n3 relates to recovery of certain dues as arrears of land revenue<br \/>\nwhere any person is a party and taken for the purposes as mentioned<br \/>\nin Section 3(1).  In such case, the Collector on receiving the<br \/>\ncertificate may make an inquiry and recover the amount under Section<br \/>\n3(2) of the Gujarat Public Moneys Act, 1979.  This will be evident<br \/>\nfrom the provisions as quoted hereunder :-\n<\/p>\n<p> 3.\tRecovery<br \/>\nof certain dues as arrears of land revenue. (1) Where any person is a<br \/>\nparty &#8211;\n<\/p>\n<p>(a)\tto<br \/>\nany agreement relating to a loan, advance or grant given to him or<br \/>\nrelating to credit in respect of, or relating to hire-purchase of<br \/>\ngoods sold to him by the State Government or the Corporation, by way<br \/>\nof financial assistance, or<\/p>\n<p>(b)\tto<br \/>\nany agreement relating to a loan, advance or grant given to him or<br \/>\nrelating to credit in respect of, or relating to hire-purchase of<br \/>\ngoods sold to him by a bank or a Government Company, as the case may<br \/>\nbe, under a State sponsored scheme; or<\/p>\n<p>(c)\tto<br \/>\nany agreement relating to a guarantee given by the State Government<br \/>\n\tor the Corporation in respect of a loan raised by an industrial<br \/>\nconcern; or<\/p>\n<p>(d)\tto<br \/>\nany agreement providing that any money payable thereunder to the<br \/>\nState Government or the Corporation shall be recoverable as arrears<br \/>\nof land revenue:\n<\/p>\n<p>and<br \/>\nsuch person &#8211;\n<\/p>\n<p>(i)\tmakes<br \/>\nany default in payment of the loan or advance of any installment<br \/>\nthereof,<\/p>\n<p>(ii)\thaving<br \/>\nbecome liable under the conditions of the grant to refund the grant<br \/>\nor any portion thereof, makes any default in the refund of such grant<br \/>\nor portion or any installment thereof, or<\/p>\n<p>(iii)\totherwise<br \/>\nfails to comply with the terms of the agreement then, in the case of<br \/>\nthe State Government, such officer as may be authorized in that<br \/>\nbehalf by the State Government by notification in the Official<br \/>\nGazette, in the case of a Corporation or a Government Company, the<br \/>\nManaging Director thereof or where there is no Managing Director, the<br \/>\nChairman thereof, by whatever name called, and in the case of a bank,<br \/>\nthe local agent thereof, by whatever name called, may send to the<br \/>\nCollector a certificate as early as possible in the prescribed form<br \/>\nmentioning the sum due from such persons and requesting that such sum<br \/>\nmay be recovered as if it were an arrear of land revenue.\n<\/p>\n<p>(2)\tThe<br \/>\nCollector on receiving the certificate shall after making such<br \/>\ninquiries (including giving hearing to the party affected) as he<br \/>\ndeems fit proceed to recover the amount stated therein as aforesaid<br \/>\nas arrears of land revenue.\n<\/p>\n<p>(3)\tOn<br \/>\nrecovery of any amount under sub-section (2), the same shall be paid<br \/>\nover to the State Government, Corporation, Government Company, or as<br \/>\nthe case may be, bank after deducting, except in the case of amount<br \/>\nto be paid to the State Government, such portion of the amount<br \/>\nrealized, as cost of collection, as the Collector may deem to be<br \/>\nreasonable.\n<\/p>\n<p>(4)\t&#8230;\t\t&#8230;\t\t&#8230;\t\t&#8230;\t\t&#8230;\n<\/p>\n<p>\tTherefore,<br \/>\nthe respondent   bank also cannot recover the amount under Section<br \/>\n3 of the Gujarat Public Moneys Act, 1979.\n<\/p>\n<p>7.\tAs<br \/>\nwe have noticed that the Bombay Land Revenue Code, 1879 is not<br \/>\nattracted in the present case, we hold that the respondent   bank<br \/>\ncould not have directed the Talati-cum-Mantri, Vasai to take steps<br \/>\nfor auction sale of the property as intimated by letter dated<br \/>\n2.11.2009 nor the Deputy Mamlatdar &amp; Special Recovery Officer,<br \/>\nRegional Office, Dena Bank, Mehsana could have issued auction notice<br \/>\nas issued at page 56 to the writ petitioner.  For the said reasons,<br \/>\nwe set aside the letter dated 2.11.2009 issued by the respondent<br \/>\nbank to the Talati-cum-Mantri, Vasai and the auction notice dated<br \/>\n6.12.2008 issued by  Deputy Mamlatdar &amp; Special Recovery Officer,<br \/>\nRegional Office, Dena Bank, Mehsana.\n<\/p>\n<p>8.\tThe<br \/>\nlearned Single Judge failed to notice the aforesaid provisions and<br \/>\nthereby could not notice that the respondent   bank had no<br \/>\njurisdiction to recover the amount under Section 165 of the Bombay<br \/>\nLand Revenue Code, 1879 or the Rules framed thereunder.\n<\/p>\n<p>9.\tSo<br \/>\nfar as the appellant&#8217;s right for waiver of loan is concerned,  we are<br \/>\nnot deliberating on such issue.  The learned Single Judge has held<br \/>\nthat the appellant has failed to show his right of waiver.  If there<br \/>\nis any provision under which the appellant can claim right of waiver,<br \/>\nhe may bring the same to the notice of the bank.\n<\/p>\n<p>10.\tThough<br \/>\nwe have set aside the the letter dated 2.11.2009 issued by the<br \/>\nrespondent   bank to the Talati-cum-Mantri, Vasai and the auction<br \/>\nnotice dated 6.12.2008 issued by  Deputy Mamlatdar &amp; Special<br \/>\nRecovery Officer, Regional Office, Dena Bank, Mehsana, but this order<br \/>\nshall not stand in the way of the respondent   bank to recover its<br \/>\ndues in accordance with law.\n<\/p>\n<p>11.\tThe<br \/>\nLetters Patent Appeal and the Civil Application both stand disposed<br \/>\nof with the aforesaid observations.
