Govt.Pleader for the\nrespondents. \n=========================================================\n\n\n \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE MD SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 30\/06\/2008 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>1.\t\tThe<br \/>\npetitioner-detenu has preferred this petition under Article 226 of<br \/>\nthe Constitution of India for appropriate writ, order or direction<br \/>\nfor quashing and  setting aside the order dated 2.11.2007 passed by<br \/>\nrespondent No.1-Police Commissioner, Ahmedabad City, whereby, in<br \/>\nexercise of power under sub-section (2) of section 3 of the  Gujarat<br \/>\nPrevention of Anti Social Activities Act, 1985 (for short, &#8216;PASA<br \/>\nAct&#8217;)  the petitioner has been detained as a bootlegger.  In<br \/>\npursuance of the said impugned order, the petitioner is detained in<br \/>\njail.\n<\/p>\n<p>\t\tHeard the learned advocate<br \/>\nfor the petitioner and the learned AGP for the respondents.\n<\/p>\n<p>\t\tNo<br \/>\naffidavit-in-reply is filed by the learned AGP on behalf of the<br \/>\nrespondents controverting the averments made in the petition.\n<\/p>\n<p>\t\tFrom the grounds of<br \/>\ndetention, it appears that five offences being CR.I.No. 5093, 5105,<br \/>\n5156 of  2005, 5024 and 5106 of 2007 under sections 66 (1)b and 65(e)<br \/>\n etc.  under the Bombay Prohibition Act,  were registered with Rajkot<br \/>\npolice station, wherein   country liquor was found from the<br \/>\npossession of the detenu.    On the basis of registration of these<br \/>\ncases, the detaining authority held that the present detenu was<br \/>\ncarrying on activities of selling country liquor which is harmful to<br \/>\nthe health of the public.  It is held by the detaining authority that<br \/>\nas the detenu is indulged in illegal activities, it is required to<br \/>\nrestrain him from carrying out further illegal activities i.e.<br \/>\nselling of liquor. The detaining authority has placed reliance  on<br \/>\nthe above registered offences and statements of  unnamed witnesses.<br \/>\nIn the opinion of this court, the activities of the detenu  can, by<br \/>\nno stretch of reasoning, be said to be disturbing the public order.<br \/>\nIt is seen from the grounds that a general statement that has been<br \/>\nmade by the detaining authority that consuming liquor is injurious to<br \/>\nhealth.   In fact, a perusal of the order passed by the detaining<br \/>\nauthority shows that the grounds which are mentioned in the order are<br \/>\nin reference to the situation of &#8216;law and order&#8217; and not &#8216;public<br \/>\norder&#8217;.  Therefore, on this ground, the subjective satisfaction of<br \/>\nthe detaining authority is vitiated on account of non-application of<br \/>\nmind and the impugned order, therefore, deserves to be quashed and<br \/>\nset aside.\n<\/p>\n<p>3.\t\tExcept<br \/>\ntwo statements of the anonymous witnesses, there is no material on<br \/>\nrecord which shows that the petitioner-detenu is carrying out illegal<br \/>\nactivities of selling  liquor which is harmful to the health of the<br \/>\npublic.  In the case of Ashokbhai Jivraj @ <a href=\"\/doc\/687998\/\">Jivabhai Solanki  v.<br \/>\nPolice Commissioner, Surat<\/a> (2001 (1) GLH 393), having<br \/>\nconsidered the decision of the Hon&#8217;ble Apex Court in the case of Ram<br \/>\nManohar Lohia  v. State of Bihar (AIR 1966 SC 740), this<br \/>\ncourt held that the cases wherein the detention order are passed on<br \/>\nthe basis of the statements of such witnesses fall under the<br \/>\nmaintenance of  \u00fdSlaw and order\u00fd\u00fd and not \u00fdSpublic order\u00fd\u00fd.\n<\/p>\n<p>4.\t\tApplying<br \/>\nthe ratio of the above decisions, it is clear that before passing  an<br \/>\norder of detention of a detenu, the detaining authority must come to<br \/>\na definite finding that there is threat to the &#8216;public order&#8217; and it<br \/>\nis very clear that  the present case  would not fall within the<br \/>\ncategory of threat to a public order.  In that view of the matter,<br \/>\nwhen the order of detention has been passed by the detaining<br \/>\nauthority without having adequate grounds for passing the said order,<br \/>\ncannot be sustained and, therefore, it deserves to be quashed and set<br \/>\naside.\n<\/p>\n<p>5.\t\tIn the result, this Special<br \/>\nCivil Application is allowed.  The impugned order of detention  dated<br \/>\n2.11.2007 passed by the Commissioner of Police, Ahmedabad,  is hereby<br \/>\nquashed and set aside.  The detenu is ordered to be set at liberty<br \/>\nforthwith, if not required in any other case.  Rule is made absolute<br \/>\naccordingly.
