P.C. in connection with CR No.I-46 of 2010 registered<br \/>\nwith Khanpur Police Station, Panchmahal for the offences punishable<br \/>\nunder Sections-406, 420, 465, 467, 468, 471, 477-A and 120-B of<br \/>\nIndian Penal Code.\n<\/p>\n<p>2.\tHeard<br \/>\nlearned advocate Mr. B. M. Mangukia appearing for applicant and<br \/>\nlearned APP Mr. K. L. Pandya appearing for respondent State.\n<\/p>\n<p>3.\tCase<br \/>\nof the prosecution, prima facie, appears to be that many persons not<br \/>\neligible to receive aid from the Government towards compensation<br \/>\nbeing riot victims, was paid.  It was decided that the amount towards<br \/>\ncompensation paid to the persons not entitled was to be recovered and<br \/>\nthe proceedings for the recovery of the same were to be undertaken by<br \/>\na few government officials, including the present applicant, who at<br \/>\nthe relevant point of time was serving as Asst. Taluka Development<br \/>\nOfficer.  The record reveals that everything transpired way-back in<br \/>\nthe year 2002-2004.  The applicant was on the post of Asst. Taluka<br \/>\nDevelopment Officer from May 17, 2002 to March 31, 2004 at Khanpur.<br \/>\nThereafter, the applicant opted for voluntary retirement.  Taking the<br \/>\ncase of the prosecution at its best, so far as the present applicant<br \/>\nis concerned, it can be that of negligence and dereliction of duty.<br \/>\nIn any view of the matter, the applicant has retired long time back,<br \/>\npractically all the co-accused charge-sheeted in the alleged offence<br \/>\nhave been enlarged on the bail by various orders passed by the High<br \/>\nCourt.  In my view, custodial interrogation is not necessary.  In the<br \/>\nfact and circumstances of the case and considering the nature of<br \/>\nallegations and the role attributed to the accused applicant, without<br \/>\ndiscussing the evidence in detail, prima facie, this Court is of the<br \/>\nopinion that the discretion can be exercised in favour of the<br \/>\naccused, applicant.\n<\/p>\n<p>4.\tTaking<br \/>\ninto consideration the relevant aspects referred to above and further<br \/>\ntaking into consideration the law laid down by the Apex Court in the<br \/>\ncase of <a href=\"\/doc\/1108032\/\">Siddhram Satlingappa Mhetre v. State of Maharashtra &amp;<br \/>\nOrs.,<\/a> reported in (2011) 1 SCC 694, wherein the Hon&#8217;ble Supreme<br \/>\nCourt reiterated the law laid down by the constitutional Bench in the<br \/>\ncase of Shri Gurubaksh Singh Sibbia &amp; Ors. (1980) 2 SCC 565,<br \/>\nthis application is allowed by directing that in the event of the<br \/>\napplicant herein being arrested<br \/>\npursuant CR No. I-46 of 2010, registered with Khanpur<br \/>\nPolice Station, Panchmahal, the applicant shall be released on Bail<br \/>\non his furnishing a Bond of Rs.10,000\/- (Rupees ten thousand only)<br \/>\nwith one surety of like amount on condition that &#8211;\n<\/p>\n<p>a)\the<br \/>\nshall co-operate with the investigation and make himself available<br \/>\nwhenever required;\n<\/p>\n<p>b)\the<br \/>\nshall not enter the revenue limits of Ahmedabad City till the<br \/>\nconclusion of the trial.\n<\/p>\n<p>c)\the<br \/>\nshall remain present before the Investigating Officer, Khanpur Police<br \/>\nStation, Panchmahal, on 3rd October, 2011<br \/>\nat 11.00 am.\n<\/p>\n<p>d)\the<br \/>\nshall not hamper the investigation in any manner nor shall directly<br \/>\nor indirectly make any inducement, threat or promise to any witness<br \/>\nso as to dissuade them for disclosing such facts to the Court or to<br \/>\nany Police Officer;\n<\/p>\n<p>e)\tat<br \/>\nthe time of execution of Bond, he shall furnish his address to the<br \/>\nI.O. and the Court concerned and shall not change the residence till<br \/>\nthe final disposal of the case or till further orders;\n<\/p>\n<p>f)\tthat<br \/>\nhe will not leave India without the permission of the Court and, if<br \/>\nis holding a Passport, surrender the same before the trial Court<br \/>\nimmediately;\n<\/p>\n<p>g)\tIt<br \/>\nwould be open to the Investigating Officer to \tfile an application<br \/>\nfor remand, if considers it just and proper and the concerned<br \/>\nMagistrate would decide it on merits;\n<\/p>\n<p>h)\tthis<br \/>\norder will be operative if the applicant is arrested at any time<br \/>\nwithin a period of 90 days;\n<\/p>\n<p>i)\twithin<br \/>\na period of ten days from the date of arrest, the applicant shall<br \/>\napply for regular bail which application shall be decided by the<br \/>\ncompetent Court in accordance with law without being influenced by<br \/>\nthe fact that anticipatory bail was granted.\n<\/p>\n<p>5.\tLearned<br \/>\nadvocate for the applicant assured that applicant will appear before<br \/>\nconcerned police station as per direction of this Court.\n<\/p>\n<p>6.\tWith<br \/>\nthese directions, this Criminal Miscellaneous Application is disposed<br \/>\nof. Rule is made absolute.
