    The writ petition is filed seeking for various reliefs<\/p>\n
including a direction to the first and second respondents<\/p>\n
to take immediate measures to close down the dumping of<\/p>\n
waste, its collection and environment pollution caused by<\/p>\n
the fifth respondent in the petitioner’s property.    There<\/p>\n
is a further relief sought by way of a direction to the<\/p>\n
fifth respondent to remove the already collected waste in<\/p>\n
the petitioner’s property and to adequately compensate the<\/p>\n
petitioner for the damages done to his property.<\/p>\n
    2.   It is a case where the petitioner has executed<\/p>\n
Ext.P1 agreement with the fifth respondent for using his<\/p>\n
property on payment of Rs.10,000\/- as monthly rent for<\/p>\n
different purposes including rearing of buffaloes as well<\/p>\n
as for manufacture of organic manure from vegetable waste<\/p>\n
for which the fifth respondent is allowed to use certain<\/p>\n
portions of properties the extent of which is mentioned in<\/p>\n
condition No.3 of Ext.P1.   Certain other stipulations have<\/p>\n
also been made in Ext.P1.\n<\/p>\n
    3.   What is alleged in the writ petition is that the<\/p>\n
fifth respondent, without obtaining any licence, started to<\/p>\n
dump  all  kinds  of  waste  collected  from  the Cherthala<\/p>\n

Municipality      including   waste   materials  from  hospitals,<\/p>\n
dangerous     chemicals   etc.   into   the  property.   Certain<\/p>\n
photographs have been produced in support of the said plea.<\/p>\n
The petitioner        has also  produced   along  with the   writ<\/p>\n
petition, Exts.P2 and P3 which are representations said to<\/p>\n
have been submitted by the Parent-Teacher Association of<\/p>\n
the   Government      Polytechnic   College,  Cherthala and  the<\/p>\n
Principal,      Government    Polytechnic    College,  Cherthala<\/p>\n
respectively in this regard alleging public nuisance and<\/p>\n
pollution.      In support of the plea that the people of the<\/p>\n
locality have been complaining the matter to the petitioner<\/p>\n
Ext.P4 representation has been produced.<\/p>\n
     4.      The petitioner is permanently residing in New<\/p>\n
Delhi and on coming to know about the activities of the<\/p>\n
fifth respondent, he has filed this writ petition seeking<\/p>\n
various reliefs.\n<\/p>\n
     5.      Heard the learned counsel for the petitioner and<\/p>\n
the learned Standing Counsel appearing for the Municipality<\/p>\n
and the learned counsel for the fifth respondent.<\/p>\n
     6.      When the matter came up for hearing on 24\/05\/2010,<\/p>\n
the learned Standing Counsel for the Municipality submitted<\/p>\n
that    speedy    steps  are  being   taken  for  finding  out a<\/p>\n
permanent solution with regard to dumping of waste and<\/p>\n
appropriate action will be taken within one week.         It was<\/p>\n

also submitted that the Municipality will have to find out<\/p>\n
suitable places for dumping of waste.       This submission was<\/p>\n
made on realising that the arrangement made between the<\/p>\n
petitioner and the fifth respondent cannot be used for<\/p>\n
dumping the entire waste materials generated within the<\/p>\n
Municipality limits through the fifth respondent in the<\/p>\n
property in question.        The fifth respondent has filed a<\/p>\n
counter affidavit in the matter disputing the contentions<\/p>\n
raised by the petitioner.\n<\/p>\n
     7.      The learned counsel for the Municipality submitted<\/p>\n
that going by the terms of Ext.P1, the petitioner has<\/p>\n
allowed the fifth respondent to collect vegetable waste for<\/p>\n
converting it as organic manure.        It is submitted that to<\/p>\n
that extent, the arrangement between the petitioner and the<\/p>\n
fifth respondent can be continued.       But with regard to the<\/p>\n
dumping     of  other   types of    waste materials, the  fifth<\/p>\n
respondent will have to see that the same will not be<\/p>\n
dumped into the petitioner’s property.\n<\/p>\n
     8.      Even though the learned counsel for the petitioner<\/p>\n
submitted     that    the fifth  respondent  cannot  bring  any<\/p>\n
materials to the property, in the light of the conditions<\/p>\n
specified in Ext.P1 it can be seen that the petitioner has<\/p>\n
permitted the fifth respondent to bring vegetable waste for<\/p>\n
the purpose of manufacturing organic manure.         Therefore,<\/p>\n

the stand taken by the petitioner that the fifth respondent<\/p>\n
cannot bring such type of waste is not supportable.<\/p>\n
     9.      The learned counsel for the petitioner submitted<\/p>\n
that under the cover of the agreement and misusing the<\/p>\n
terms of the agreement, the entire waste generated within<\/p>\n
the limits of the Municipality cannot be brought in by the<\/p>\n
fifth respondent on the basis of any arrangement made by<\/p>\n
him with the Municipality.       That will be beyond the scope<\/p>\n
of the agreement.\n<\/p>\n
     10. There is dispute between the parties with regard<\/p>\n
to the question whether the entire property is now utilised<\/p>\n
for dumping waste.      That is a matter which can be enquired<\/p>\n
into by a competent officer of the fourth respondent,<\/p>\n
namely, the Kerala State Pollution Control Board, who will<\/p>\n
depute a competent Officer to conduct an inspection of the<\/p>\n
entire    property    including   the  quantity of  the  waste<\/p>\n
collected there and the items which have been collected and<\/p>\n
prepare a report.        He should also find out whether any<\/p>\n
pollution     is   created by  the   dumping of waste  in  the<\/p>\n
property.      A copy of the report will be furnished to the<\/p>\n
petitioner,       the  Municipality   as  well as   the  fifth<\/p>\n
respondent after conducting the inspection within a period<\/p>\n
of one week.\n<\/p>\n

     11. The Municipality will see that any extra items of<\/p>\n
waste not covered by the terms of Ext.P1 agreement which<\/p>\n
are dumped into the property are removed to any convenient<\/p>\n
site to be found out by them through the fifth respondent<\/p>\n
himself or by other means.          The same will also be done<\/p>\n
within ten days from the date of submission of the report<\/p>\n
by the Officer of the fourth respondent.\n<\/p>\n
     12. If       the  petitioner   is aggrieved by  any other<\/p>\n
actions of the fifth respondent, namely, alleged violation<\/p>\n
of the terms of the agreement etc., he can approach an<\/p>\n
appropriate forum in the matter.\n<\/p>\n
     With     the    above directions,  the  writ petition  is<\/p>\n
disposed of. No costs.\n<\/p>\n<\/p>\n
