No.9\/2011 with Railway Police Station, Surat for the offences<br \/>\n\tpunishable under Sections 399, 333, 402 and 120(B) of Indian Penal<br \/>\n\tCode and u\/s. 135 of Bombay Police Act.\n<\/p>\n<p>Learned<br \/>\n\tadvocate for the applicant submits that the accused against whom the<br \/>\n\tallegation of inflicting injury on the police constable, is made in<br \/>\n\tthe FIR, has been released on bail by order dated 28.06.2011 passed<br \/>\n\tin Criminal Misc. application No.8516 of 2011. Learned Counsel<br \/>\n\tappearing for the applicant submits that the case of the applicant<br \/>\n\tis different than that of the co-accused released who is on bail<br \/>\n\tsince in the said case the allegations are of inflicting injury to<br \/>\n\tthe police personnel on duty, who wanted to apprehend the accused<br \/>\n\twhile he was preparing to commit robbery in the train, but in case<br \/>\n\tof the applicant such allegation is not made in the FIR and upon<br \/>\n\ttaking into account other considerations like  period of custody of<br \/>\n\tthe applicant coupled with the fact that the co-accused i.e. accused<br \/>\n\tNo.1 against whom change of inflicting injury to police personnel is<br \/>\n\tmade, is released and that all interrogation offer, remand are over<br \/>\n\tand charge-sheet is filed, by imposing suitable conditions, the<br \/>\n\tapplicant may be enlarged on bail.\n<\/p>\n<p>Heard<br \/>\n\tlearned APP Mr.Jashvant Shah for the respondent-State.\n<\/p>\n<p>Having<br \/>\n\theard learned counsels for the parties and perusing the record of<br \/>\n\tthe case and taking into consideration the facts of the case, nature<br \/>\n\tof allegations, role attributed to the applicant, by imposing<br \/>\n\tsuitable conditions, I deem it just and proper to enlarge the<br \/>\n\tapplicant on bail.\n<\/p>\n<p>Learned<br \/>\n\tCounsels for the parties do not press for further reasoned order.\n<\/p>\n<p>In<br \/>\n\tthe facts and circumstances of the case, the application is allowed<br \/>\n\tand the applicant is ordered to be released on bail in connection<br \/>\n\twith First Information Report registered as I-C.R. No.9\/2011 with<br \/>\n\tRailway Police Station, Surat, on executing a bond of Rs.10,000\/-<br \/>\n\t(Rupees Ten Thousand Only) with one surety of the like amount to the<br \/>\n\tsatisfaction of the Trial Court and subject to the conditions that<br \/>\n\the shall;\n<\/p>\n<p>(a)<br \/>\n\t\tnot take undue advantage of liberty or misuse liberty;\n<\/p>\n<p>(b)<br \/>\n\t\tnot act in a manner injurious to the interest of the \tprosecution;\n<\/p>\n<p>(c)<br \/>\n\t\tsurrender his passport, if any, to the lower court within a \tweek;\n<\/p>\n<p>(d)<br \/>\n\t\tnot leave the State of Gujarat without prior permission of \tthe<br \/>\n\tSessions Judge concerned;\n<\/p>\n<p>(e)<br \/>\n\t\tmark presence at the concerned Police Station on the \tfirst Sunday<br \/>\n\tof every month between 10.00 a.m. and \t3.00 p.m. for three months<br \/>\n\tonly;\n<\/p>\n<p>(f)\tfurnish<br \/>\n\tthe present address of his residence to the \tInvestigating Officer<br \/>\n\tand also to the Court at the time of \texecution of the bond and<br \/>\n\tshall not change the \tresidence without prior permission of this<br \/>\n\tCourt;\n<\/p>\n<p>(g)<br \/>\n\t\tnot to enter Surat city and particularly, the area of \tRailway<br \/>\n\tStation and nearby area of Surat City until the \ttrial is over.\n<\/p>\n<p>The<br \/>\n\tauthorities will release the applicant only if not required in<br \/>\n\tconnection with any other offence for the time being.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the Sessions<br \/>\n\tJudge concerned will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbond to be executed before the lower court having jurisdiction to<br \/>\n\ttry the case.\n<\/p>\n<p>At<br \/>\n\tthe trial, the Trial Court shall not be influenced by the<br \/>\n\tobservations of preliminary nature, qua the evidence at this stage,<br \/>\n\tmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>Rule<br \/>\n\tmade absolute.
