Justice K.BALAKRISHNAN NAIR\n\n Dated :13\/07\/2007\n\n O R D E R\n                     K.BALAKRISHNAN NAIR,J.\n\n                           -------------------------\n\n                     W.P ( C) No.14186  of 2007\n\n                           --------------------------\n\n               Dated this the 13th day of July, 2007\n\n\n                             J U D G M E N T\n<\/pre>\n<p>      The   petitioner   is   an   Attender     working   in   Government<\/p>\n<p>Homoeo Dispensary, Aranmula.  She is a physically handicapped<\/p>\n<p>person as evident from Exhibit P1 certificate.  By Exhibit-P2, she<\/p>\n<p>has   been   transferred   from   Aranmula   to   Government   Homoeo<\/p>\n<p>Dispensary,   Kalloopara.     This   writ   petition   is   filed   challenging<\/p>\n<p>Exhibit-P2.   She submits the present station  is   at a distance of<\/p>\n<p>30   kilometers   away   from   her   residence.     She   is   suffering   from<\/p>\n<p>cardiac decease.   She has submitted    Exhibit-P4  representation<\/p>\n<p>pointing   out   other   dispensaries,   where   she   may   be<\/p>\n<p>accommodated.     Thereafter,   this   writ   petition   is   filed   seeking<\/p>\n<p>appropriate reliefs against Exhibit-P2.\n<\/p>\n<p>      2.     Heard.  Learned Government Pleader upon instruction<\/p>\n<p>submitted   that   the   petitioner   is   a   quarrelsome   person   and   in<\/p>\n<p>public   interest   she   was   transferred   to   Kallooppara.     She   was<\/p>\n<p>shown in the   draft transfer list with the proposal to transfer to<\/p>\n<p>Kalloopara.   She did not object to it.   Therefore, she was finally<\/p>\n<p>transferred to the proposed station.\n<\/p>\n<p>W.P ( C) No.14186  of 2007<\/p>\n<p><span class=\"hidden_text\">                                          2<\/span><\/p>\n<p>       3.     Learned   Counsel   for   the   petitioner   submits   that   she<\/p>\n<p>was   never   shown   the   draft     list   and   she   did   not   get   an<\/p>\n<p>opportunity   to   object   to   it.     Having   regard   to   the   facts   of   the<\/p>\n<p>case, the 2nd  respondent is directed to consider and pass orders<\/p>\n<p>on Exhibit-P4 , in accordance with law, within six weeks from the<\/p>\n<p>date of production  of a copy of this judgment.
