Rev. No.465\/2007\n19.09.2011<\/pre>\n<p>                  I have heard learned counsel for the applicant and<br \/>\n             learned counsel for the State.\n<\/p>\n<p>                  By the impugned order, the trial Court has found, on<br \/>\n             the basis of evidence of the victim and her husband<br \/>\n             recorded by it, that a prima facie case under Section<br \/>\n             376(1) of I.P.C. and Section 3(2)(v) of the Scheduled<br \/>\n             Castes &amp; Scheduled Tribes (Prevention of Atrocities) Act<br \/>\n             1989 is also made out, and has accordingly framed<br \/>\n             additional charges. The trial Court has also, by the same<br \/>\n             order allowed the request of the accused of further cross-<br \/>\n             examine the victim and her husband.\n<\/p>\n<p>                  The record shows that the victim was examined on<br \/>\n             oath before the trial court and she stated that she had<br \/>\n             been raped. A detailed cross-examination was conducted<br \/>\n             by the accused side in which the accused could not elicit<br \/>\n             much. Similarly, the husband of the victim also testified in<br \/>\n             his statement on oath before the trial Court about the rape.<br \/>\n             He was also cross-examined at length by the accused but<br \/>\n             nothing could be brought out to doubt the witness.\n<\/p>\n<p>                  If the trial Court has come to a prima facie conclusion<br \/>\n             on the basis of this evidence, which could not be<br \/>\n             demolished in the cross-examination, that a case under<br \/>\n             Section 376 of IPC and Section 3(2)(v) of the Scheduled<br \/>\n             Castes &amp; Scheduled Tribes (Prevention of Atrocities) Act<br \/>\n             1989 is also made out and has accordingly framed an<br \/>\n            additional charges, the revisional Court cannot interfere<br \/>\n           because there is no illegality and the scope of revision<br \/>\n           cannot be enlarged to the level of appeal.
