No.37059 of 2010\n                  BHOLA RAI @ PREM CHANDRA KUMAR son of\n                  Rajendra Rai, resident of village-Bhimalpur, P.S.-\n                  Mehsi, Dist.-East Champaran, Motihari.\n                                Versus\n                        THE STATE OF BIHAR\n                               -----------\n<\/pre>\n<p>3.   7.12.2010.                  Heard Mr. Sarda Nand Mishra learned counsel for<\/p>\n<p>                  the petitioner and Mr. Shyam Bihari Singh learned counsel for the<\/p>\n<p>                  State.\n<\/p>\n<p>                                 The petitioner, who is in custody in connection with<\/p>\n<p>                  Mehsi P.S.Case No.51 of 2010 for the offences under sections 364<\/p>\n<p>                  and 379 of the Indian Penal Code, has prayed for grant of bail.<\/p>\n<p>                                 The accusation in the first information report is that<\/p>\n<p>                  the truck of the informant loaded with some consignment were<\/p>\n<p>                  intercepted by the accused persons and, thereafter, the truck was<\/p>\n<p>                  found in abandoned condition . About 32 bundles of cloths were<\/p>\n<p>                  looted from the truck and truck driver as well as cleaner is still<\/p>\n<p>                  traceless. The petitioner&#8217;s name has transpired on the basis of<\/p>\n<p>                  confession of co-accused.\n<\/p>\n<p>                                 Learned counsel for the petitioner submits that only<\/p>\n<p>                  on the basis of confession of co-accused, the petitioner has been<\/p>\n<p>                  made accused. It was submitted that the petitioner is having clean<\/p>\n<p>                  antecedent and only due to the reason that the petitioner was not in<\/p>\n<p>                  good terms with the co-accused, namely, Sahindra Ram, the<\/p>\n<p>                  petitioner has been made accused by co-accused Sahindra Ram.<\/p>\n<p>                  Learned counsel for the petitioner further submits that co-accused,<\/p>\n<p>                  namely, Pintu Pathak @ Surendra Kumar has been extended<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>        privilege of anticipatory bail vide Cr.Misc. No.36790 of 2010 on<\/p>\n<p>        8.11.2010.    It was submitted that the petitioner is in jail since<\/p>\n<p>        20.6.2010.\n<\/p>\n<p>                        Mr.Shyam Bihari Singh, learned Additional Public<\/p>\n<p>        Prosecutor appearing on behalf of the State, has vehemently<\/p>\n<p>        opposed the prayer for bail of the petitioner. It was submitted that<\/p>\n<p>        on the basis of confession of co-accused, who had named the<\/p>\n<p>        petitioner as one of the associates, a search was conducted in the<\/p>\n<p>        house of some of the accused persons and recovery of looted<\/p>\n<p>        bundles of cloths were also affected. It was submitted that co-<\/p>\n<p>        accused in his confession had disclosed that while doing operation<\/p>\n<p>        of kidnapping and loot, they were also using tranquilizer\/injection.<\/p>\n<p>        On search of the house of the petitioner, it was submitted by learned<\/p>\n<p>        counsel for the State, at least two amples of tranquilizer\/injection<\/p>\n<p>        were recovered. This shows that the petitioner was directly involved<\/p>\n<p>        in the present case.\n<\/p>\n<p>                        In view of materials brought on record and the<\/p>\n<p>        seriousness of accusation and also the fact that investigation is still<\/p>\n<p>        continuing for tracing other accused as well as kidnapped driver and<\/p>\n<p>        cleaner, I am not inclined to extend privilege of bail to the<\/p>\n<p>        petitioner. Accordingly, his prayer for bail is rejected.<\/p>\n<p>                        However, liberty is granted to renew his prayer for<\/p>\n<p>        bail after conclusion of final investigation, if something is brought<\/p>\n<p>        on record showing innocence of the petitioner.<\/p>\n<pre>Md.S.
