Draft amendment is granted.\n<\/p>\n<p>2.\tHeard<br \/>\nMr. Mihir Thakore, learned Senior Counsel with Mr. Dipen Desai and<br \/>\nMs. Vyoma Jhaveri for the petitioners.\n<\/p>\n<p>3.\tNOTICE<br \/>\nreturnable on 9.11.2011.\n<\/p>\n<p>4.\tThe<br \/>\npetitioners are directed to file fresh amended memo of petition<br \/>\nbefore the returnable date.\n<\/p>\n<p>5.\tAs<br \/>\nsuch, the petitioners have prayed for a very wide interim relief in<br \/>\nPara 6(B) of the petition. However, considering the submissions made<br \/>\nand taking into consideration the fact that the matters pertain to<br \/>\nelection of Market Committee and as per the election programme, the<br \/>\nfinal list as per Rule 8 is to be published on 5.11.2011, in order to<br \/>\navoid any irretrievable situation and taking into consideration the<br \/>\nprima facie case, respondent No.4 is directed to include the name of<br \/>\nthe petitioners in the final list that may be published as per the<br \/>\nelection programme on 5.11.2011, subject to further orders of this<br \/>\nCourt. As per the election programme, the stage of Rule 10(B) is to<br \/>\ntake place on 7.12.2011.  Hence, no further interim relief is<br \/>\nnecessary at this stage.
