\u00a0 an \u00a0 application \u00a0 was \u00a0 filed \u00a0 with \u00a0 the\u00a0<\/p>\n<p>prayer\u00a0to\u00a0summon\u00a0the\u00a0account\u00a0maintained\u00a0by\u00a0the\u00a0defendant\u00a0in\u00a0State\u00a0Bank\u00a0of\u00a0<\/p>\n<p>India.\u00a0The\u00a0application\u00a0was\u00a0rejected\u00a0by\u00a0the\u00a0trial\u00a0court\u00a0on\u00a0the\u00a0ground\u00a0that\u00a0there\u00a0<\/p>\n<p>was\u00a0no\u00a0averment\u00a0in\u00a0the\u00a0plaint\u00a0that\u00a0the\u00a0amount\u00a0said\u00a0to\u00a0have\u00a0been\u00a0received\u00a0as\u00a0<\/p>\n<p>earnest\u00a0money\u00a0was\u00a0deposited\u00a0in\u00a0the\u00a0account\u00a0and\u00a0the\u00a0said\u00a0bank\u00a0account\u00a0has\u00a0<\/p>\n<p>been \u00a0 closed. \u00a0 Thereafter \u00a0 the \u00a0 plaintiff\u00adpetitioner \u00a0 moved \u00a0 an \u00a0 application \u00a0 for\u00a0<\/p>\n<p>amendment\u00a0to\u00a0bring\u00a0on\u00a0record\u00a0the\u00a0fact\u00a0that\u00a0the\u00a0amount\u00a0of\u00a0earnest\u00a0money\u00a0by\u00a0<\/p>\n<p>the \u00a0 defendant\u00adrespondent \u00a0 was \u00a0 deposited \u00a0 in \u00a0 his\u00a0 account \u00a0 in \u00a0 the \u00a0 State \u00a0 Bank.\u00a0<\/p>\n<p>Trial\u00a0court\u00a0rejected\u00a0the\u00a0amendment\u00a0application.\u00a0The\u00a0plaintiff\u00adpetitioner\u00a0went\u00a0up\u00a0<\/p>\n<p>in\u00a0revision.\u00a0During\u00a0the\u00a0course\u00a0of\u00a0argument,\u00a0a\u00a0statement\u00a0was\u00a0made\u00a0on\u00a0behalf\u00a0of\u00a0<\/p>\n<p>the\u00a0plaintiff\u00adpetitioner\u00a0before\u00a0the\u00a0revisional\u00a0court\u00a0that\u00a0in\u00a0case\u00a0the\u00a0amendment\u00a0<\/p>\n<p>application \u00a0 is \u00a0 allowed, \u00a0 he \u00a0 shall \u00a0 not \u00a0 seek \u00a0 to \u00a0 lead \u00a0 any \u00a0 evidence. \u00a0 On \u00a0 this\u00a0<\/p>\n<p>statement, \u00a0 the \u00a0 counsel \u00a0 appearing \u00a0 for \u00a0 the \u00a0 defendant\u00adrespondent \u00a0 conceded\u00a0<\/p>\n<p>before \u00a0 the \u00a0 revisional \u00a0 court \u00a0 for \u00a0 the \u00a0 amendment \u00a0 application \u00a0 to \u00a0 be \u00a0 allowed.\u00a0<\/p>\n<p>Revisional \u00a0 court \u00a0 vide \u00a0 order \u00a0 dated \u00a0 19.03.2007 \u00a0 allowed \u00a0 the \u00a0 revision \u00a0 and\u00a0<\/p>\n<p>permitted \u00a0 amendment \u00a0 in \u00a0 the \u00a0 plaint. \u00a0 As \u00a0 soon \u00a0 as \u00a0 the \u00a0 amendment \u00a0 was\u00a0<\/p>\n<p>incorporated,\u00a0the\u00a0plaintiff\u00adpetitioner\u00a0took\u00a0a\u00a0somersault\u00a0and\u00a0made\u00a0an\u00a0application\u00a0<\/p>\n<p>dated\u00a012.07.2007\u00a0that\u00a0details\u00a0of\u00a0the\u00a0savings\u00a0bank\u00a0account\u00a0maintained\u00a0by\u00a0the\u00a0<\/p>\n<p>defendant\u00a0in\u00a0State\u00a0Bank\u00a0of\u00a0India\u00a0may\u00a0be\u00a0summoned.\u00a0The\u00a0trial\u00a0court\u00a0rejected\u00a0<\/p>\n<p>the\u00a0application\u00a0on\u00a0two\u00a0grounds.\u00a0Firstly,\u00a0an\u00a0earlier\u00a0application\u00a0with\u00a0the\u00a0same\u00a0<\/p>\n<p>prayer\u00a0has\u00a0already\u00a0been\u00a0rejected\u00a0and\u00a0secondly,\u00a0that\u00a0plaintiff\u00adpetitioner\u00a0cannot\u00a0<\/p>\n<p>be\u00a0permitted\u00a0to\u00a0lead\u00a0evidence\u00a0in\u00a0view\u00a0of\u00a0the\u00a0statement\u00a0made\u00a0by\u00a0him\u00a0before\u00a0the\u00a0<\/p>\n<p>revisional\u00a0court.\n<\/p>\n<p> A\u00a0litigant\u00a0cannot\u00a0be\u00a0permitted\u00a0to\u00a0make\u00a0some\u00a0statement\u00a0whenever\u00a0it\u00a0suits\u00a0him\u00a0<\/p>\n<p>and\u00a0then\u00a0take\u00a0U\u00adturn\u00a0and\u00a0resile\u00a0therefrom,\u00a0when\u00a0it\u00a0suits\u00a0him\u00a0otherwise.<\/p>\n<p>In\u00a0view\u00a0of\u00a0above,\u00a0since\u00a0the\u00a0plaintiff\u00adpetitioner\u00a0has\u00a0himself\u00a0made\u00a0a\u00a0statement\u00a0<\/p>\n<p>before \u00a0 the \u00a0 revisional \u00a0 court \u00a0 that \u00a0 he \u00a0 will \u00a0 not \u00a0 lead \u00a0 any \u00a0 evidence \u00a0 after \u00a0 the\u00a0<\/p>\n<p>amendment\u00a0application\u00a0is\u00a0allowed,\u00a0the\u00a0application\u00a0for\u00a0summoning\u00a0the\u00a0record\u00a0<\/p>\n<p>from\u00a0the\u00a0Bank\u00a0in\u00a0the\u00a0form\u00a0of\u00a0evidence\u00a0has\u00a0rightly\u00a0been\u00a0rejected\u00a0by\u00a0the\u00a0trial\u00a0<\/p>\n<p>court.\u00a0\n<\/p>\n<p>The\u00a0writ\u00a0petition\u00a0being\u00a0devoid\u00a0of\u00a0merits,\u00a0stands\u00a0dismissed\u00a0in\u00a0limine.<\/p>\n<p>02.04.2010<br
