Justice K.HEMA\n\n Dated :16\/08\/2010\n\n O R D E R\n                              K.HEMA, J.\n                           ------------------\n                        B.A. No. 4315 of 2010\n                  ------------------------------------\n                Dated this the 16th day of August, 2010\n\n                              O R D E R\n<\/pre>\n<p>      Petition for bail.\n<\/p>\n<p>      2. The alleged offences are under Sections 143, 147, 148,<\/p>\n<p>452, 427, 428, 324, 395 and 506(i) read with Section 149 of the<\/p>\n<p>Indian Penal Code. According to prosecution,       petitioners(accused<\/p>\n<p>nos.2 , 12 and 15 respectively) along with other accused (total 15 in<\/p>\n<p>nos), formed themselves into an unlawful assembly and committed<\/p>\n<p>house trespass into the house of the de facto complainant and<\/p>\n<p>committed mischief by breaking the window glasses etc. They also<\/p>\n<p>assaulted the de facto complainant using sticks and committed theft<\/p>\n<p>of 5= sovereigns of gold, Rs. 8000\/- and 35 kgs of pepper. The<\/p>\n<p>incident happened on 29.05.2010 at about 3.30 P.M.<\/p>\n<p>      3. Learned counsel for petitioners submitted that accused nos.<\/p>\n<p>1 and 15 were arrested on 29.06.2010 and accused no.12 was<\/p>\n<p>arrested on 30.06.2010 and they are in custody for the past 49 and<\/p>\n<p>48 days respectively.\n<\/p>\n<p>      4. Learned Public Prosecutor submitted that taking into<\/p>\n<p>consideration, the general allegations made against petitioners, this<\/p>\n<p>petition is not opposed, but stringent conditions may be imposed, it<\/p>\n<p>is submitted.\n<\/p>\n<p><span class=\"hidden_text\">B.A. No. 4315 \/ 2010               2<\/span><\/p>\n<p>      5. On hearing both sides, I am satisfied that bail can be<\/p>\n<p>granted to petitioners on conditions. Hence the following order is<\/p>\n<p>passed:\n<\/p>\n<blockquote><p>                Petitioners shall be released on bail on their<\/p>\n<p>         executing bond       for Rs.50,000\/- (Rupees fifty<\/p>\n<p>         thousand only) with two solvent sureties each for<\/p>\n<p>         the like sum to the satisfaction of the Magistrate<\/p>\n<p>         Court concerned on the following conditions:<\/p>\n<blockquote><p>              i)   Petitioners    shall   report   before     the<br \/>\n                    Investigating Officer on every Monday,<br \/>\n                    Wednesday and Saturday, between 10<br \/>\n                    A.M. and 1 P.M.\n<\/p><\/blockquote>\n<blockquote><p>              ii)   Petitioners shall not enter the limits of the<br \/>\n                    police station within which the crime is<br \/>\n                    registered,   except   for  compliance     of<br \/>\n                    condition no.1.\n<\/p><\/blockquote>\n<blockquote><p>              iii) Petitioners shall not influence or intimidate<br \/>\n                    any witness or tamper with the evidence.\n<\/p><\/blockquote>\n<blockquote><p>              iv)     In case, petitioners are involved in any<br \/>\n                    similar offence, their bail is liable to be<br \/>\n                    cancelled.\n<\/p><\/blockquote>\n<\/blockquote>\n<p>       This petition is allowed.<\/p>\n<p>                                         K.
