SHAH<\/p>\n<p>Date<br \/>\n: 13\/06\/2011<\/p>\n<p>ORAL<br \/>\nJUDGEMENT<\/p>\n<p>[1.0]\t\tBy way of<br \/>\nthis petition under Article 227 of the Constitution of India,<br \/>\npetitioner   original defendant (now his heirs and legal<br \/>\nrepresentatives) have prayed for an appropriate order to quash and<br \/>\nset aside the impugned judgment and order dated 07.07.2008 passed by<br \/>\nthe learned Presiding Officer, 10th FTC, Vadodara<br \/>\nAppellate Court in Miscellaneous Civil Appeal No.120\/2002 by which<br \/>\nthe learned Appeallate Court has allowed the said Appeal preferred by<br \/>\nthe respondent herein   original plaintiff and has quashed and set<br \/>\naside the order dated 30.07.2002 passed by the learned trial Court<br \/>\nbelow Exh.5 in Civil Suit No.496\/1998.\n<\/p>\n<p>[2.0]\t\tAt the<br \/>\noutset it is required to be noted that initially the learned trial<br \/>\nCourt granted the order of status-quo below Exh.5 in favour of the<br \/>\noriginal plaintiff in the year 1998 which came to be continued upto<br \/>\n30.07.2002 i.e. till the learned trial Court passed the order below<br \/>\nExh.5 dismissing the same.  It appears that even thereafter also, the<br \/>\norder of status-quo was continued by the learned Appellate Court till<br \/>\nthe impugned order came to be passed and the said order of status-quo<br \/>\nhas been continued till date.\n<\/p>\n<p>[2.1]\t\tIn view of<br \/>\nthe above, more particularly, when the order of status-quo has been<br \/>\ncontinued since 1998, this Court is of the opinion that if the order<br \/>\nof status-quo which has been continued till date is directed to be<br \/>\ncontinued till the final disposal of the suit and the suit is<br \/>\ndirected to be expedited and is ordered to be decided and disposed of<br \/>\nwithin stipulated time, it will meet the ends of justice, however,<br \/>\nthe same shall be without prejudice to the rights and contentions of<br \/>\nthe respective parties to the suit.\n<\/p>\n<p>[3.0]\t\tIn view of<br \/>\nthe above and without further entering into the merits of the case<br \/>\nand\/or expressing anything in favour of either parties, both the<br \/>\nparties are directed to maintain status-quo till final disposal of<br \/>\nthe Civil Suit No.496\/1998, however, the same shall be without<br \/>\nprejudice to the rights and contentions of the respective parties to<br \/>\nthe suit and the learned trial Court to decide and dispose of the in<br \/>\naccordance with law and on merits and on the basis of the evidence<br \/>\nled and without in anyway being influenced by the present order of<br \/>\nstatus-quo and\/or any observations made either by the learned trial<br \/>\nCourt in its order passed below Exh.5 and\/or Appellate Court and\/or<br \/>\neven by this Court.\n<\/p>\n<p>[4.0]\t\tIn the<br \/>\nfacts and circumstances of the case and as the suit is of the year<br \/>\n1998, learned trial Court is directed to decide and dispose of the<br \/>\nsuit as expeditiously as possible but in any case not later than<br \/>\n30.12.2012 and all concerned are directed to cooperate the learned<br \/>\ntrial Court in early disposal of the aforesaid suit.\n<\/p>\n<p>[5.0]\t\tWith this,<br \/>\npresent Special Civil Application is disposed of.\n<\/p>\n<p>\t\t\t                       (M.R.\n<\/p>\n<p>\t\t\tShah, J.) <\/p>\n<p>*menon<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Whether vs Kanubhai on 13 June, 2011 Author: M.R.
