Thakur, Panel Lawyer for the respondent\/State.<\/pre>\n<p>      Arguments heard.\n<\/p>\n<p>      This petition under section 482 of Cr.P.C has been filed<br \/>\nby the applicants for quashing the proceedings pending before<br \/>\nthe JMFC, Chhindwara vide criminal case no. 659\/2009 for<br \/>\nthe offence punishable under sections 498-A, 325, 34 of IPC<br \/>\nand section 3 &amp; 4 of the Dowry Prohibition Act.\n<\/p>\n<p>      In nutshell the prosecution case against the applicants is<br \/>\nthat the complainant Shabnoor Bano was married with<br \/>\napplicant no. 4 Irfan on 30\/03\/03. After marriage her husband<br \/>\nalongwith other applicants used to demand dowry and harass<br \/>\nher. It is also alleged that applicants have beaten her therefore,<br \/>\nShabnoor Bano came back to her maternal home where a child<br \/>\nwas born to her. Thereafter, on 27\/04\/2005 Shabnoor Bano<br \/>\nphoned applicant no.4\/husband and asked to take back her but<br \/>\napplicant no.4 has told her that unless the demanded money<br \/>\nand a Maruti Car is given to him, he will not take her from<br \/>\nChhindwara. On 28\/04\/2005, a FIR was lodged in Police<br \/>\nStation Junnardeo, District Chhindwara u\/s 498-A\/34 of IPC<br \/>\nand section 3\/ 4 of the Dowry Prohibition Act.\n<\/p>\n<p>      Shri Khalid Noor Fakhruddin, learned counsel on behalf<br \/>\nof the applicant submits that complainant Shabnoor Bano was<br \/>\n never harassed at Chhindwara therefore, Chhindwara Court has<br \/>\nno jurisdiction to try the case. Learned counsel further argued<br \/>\nthat the telephone call was made by Shabnoor Bano to her<br \/>\nhusband Irfan and because Shabnoor Bano has made the call,<br \/>\ntherefore, Chhindwara Court has no jurisdiction. He further<br \/>\nargued that at the most applicant no.4 can be tried at<br \/>\nChhindwara Court.\n<\/p>\n<p>      On the other hand, learned counsel for the State Shri G.S.<br \/>\nThakur, Panel Lawyer submits that the offences u\/s 498-A of<br \/>\nIPC is a continuing offence and cruelty is defined in<br \/>\nexplanation to section 498-A of IPC. This analogy will not<br \/>\nmake any defence that who made telephone call but if any<br \/>\ndemand of dowry is made on telephone call while Shabnoor<br \/>\nBano was living at Chhindwara then Chhindwara Court has<br \/>\nalso the jurisdiction to try the case.\n<\/p>\n<p>      In Dhananjay Jaiswal Vs. State of M.P., 2006 (1)<br \/>\nMPWN SN 13 it has been specifically held that if any demand<br \/>\nof dowry is made on telephone even then at concerned place,<br \/>\nthe Court will have jurisdiction to try the case. The Apex<br \/>\nCourt in the judgment Sujata Mukherji Vs. Prashant Kumar<br \/>\nMukherji, AIR 1997 SC 2465 held in the factual background<br \/>\nof clause (c ) of Section 178 of Cr.P.C that in such cases both<br \/>\nthe places should have jurisdiction. In the case at hand there is<br \/>\nspecific allegation in the statement of Shabnoor Bano that her<br \/>\nhusband Irfan demanded dowry on telephone therefore,<br \/>\n Chhindwara Court has also the jurisdiction u\/s 177 of Cr.P.C.\n<\/p>\n<p>      In consequences of aforesaid legal and factual position<br \/>\nbecause act of demand of dowry was made at Chhindwara as<br \/>\nwell as at Nagpur therefore, no case is made out for exercising<br \/>\nof jurisdiction u\/s 482 of Cr.P.C by this Court for quashment<br \/>\nof the proceedings pending before the JMFC, Chhindwara.\n<\/p>\n<p>      Consequently, this petition fails and is hereby dismissed<br \/>\nat the motion stage.\n<\/p>\n<p>      Copy of this order be sent to concerned JMFC,<br \/>\nChhindwara. Applicants shall remain present before the trial<br \/>\nCourt on 19\/07\/2010.\n<\/p>\n<p>                                              (S.C.
