Respondent\/s<br \/>\n                 ======================================================<\/p>\n<p>3   30-09-2011                 Heard the parties.\n<\/p>\n<p>                               In the facts and circumstances of the case, the prayer<\/p>\n<p>                 to condone the delay of 47 days in preferring this appeal is<\/p>\n<p>                 allowed.\n<\/p>\n<p>                               On hearing the parties and perusal of the order under<\/p>\n<p>                 appeal we find that the Writ Court has rightly held that the writ<\/p>\n<p>                 petitioner\/appellant has statutory remedy of appeal under Section<\/p>\n<p>                 20 of the Recovery of Debts due to Banks and Financial<\/p>\n<p>                 Institutions Act, 1993. In that view of the matter, we find no good<\/p>\n<p>                 reason to interfere with the order of the Writ Court. The appeal is<\/p>\n<p>                 dismissed.\n<\/p>\n<p>                               It goes without saying that as observed by the Debts<\/p>\n<p>                 Recovery Tribunal in the impugned order dated 29.10.2010, if a<br \/>\n<span class=\"hidden_text\">  Patna High Court LPA No.741 of 2011 (3) dt.30-09-2011<\/span><\/p>\n<p><span class=\"hidden_text\">                                                         2<\/span><\/p>\n<p>              compromise proposal is submitted by the appellant with a genuine<\/p>\n<p>              intention to settle the dues as per recovery policy of the Bank, the<\/p>\n<p>              Bank will consider the same as per its policy.<\/p>\n<p>                                                             (Shiva Kirti Singh, J)<\/p>\n<p>                                                             (Shivaji Pandey, J)<\/p>\n<p>sk\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211;
